      A corrupt tyrant will want to hide their actions. A civic patriot will want to reveal corruption and hold all who serve accountable.
      The 1st amendment, freedom of the press, exists for all people to observe actions of our government and report to everyone so that corruption and tyrants can be rooted out. If tyrants can hide their actions, they can hide their corruption. There is no excuse to prevent transparency and accountability.

    It would have been so easy for the cop at the station to say: " yep, the officer jumped the gun and it's a good thing you pointed out the fact that the beer was non-alcoholic". He would have looked and sounded great....but.....no.....defend the blue line at all costs. No wonder the public has lost so much respect for law enforcement.

      Thinking outside the box, there is no evidence to confirm that what was in his bottle was non alcoholic. He could have filled it up earlier with real alcohol. The label means nothing, they should have something to test the actual liquid.

      @@AAAA-hm6xqthere’s no evidence to confirm that it’s _not_ a non-alcoholic beer. He wasn’t acting drunk in public. The burden of proof is on the accusing party, it’s not up to the civilian to prove that it’s actually what the label says.
      Following your logic, every water bottle or literally any container with a clear liquid could be vodka “unless proven otherwise”. We are innocent until proven guilty, not the other way around.

    We all know nothing will happen as this supervisor is already dismissing the complaint w/o even looking into it, you can clearly see that in his body language. The auditor needs to come back in the morning and file a formal complaint with the IA section if even wants a chance to have some corrective action taken, which we know won't happen.

      they wash out good ppl in the academy and then pair them with bad mentors and partners. Calling them in for backup then allows them to set the scene by first moving an innocent ( needs to be innocent for max effect)person to front bumper .This keeps dash camera and newby backup from seeing full actions and as the screaming siren gets close a false scuffle is acted out so that there is nonchoice but jump in . That is " caught ,hook and sinker for the rookie as he now will be forced by the blueline culture to write a" same same " report as the other cops. This and any court testimony to come not only reels the fish in...it decapitates and guts them . Later on they will realize what was done ,how they went along and now have no choice but deal with it silently , become non - human or quit . There is no therapy allowed ,and no way to make the info known ,esp to family or friends so that ends up allowing them only to harden their faces,their moral turpitude and and avert their eyes from other officers offenses...both for legal reasons and to be sure none see their disgust ...as that may end up causing them to be shunned and serpicoded. The booticians do the rest by always saying great job ,you did no wrong and allowing for no humanity within leading to sleepless nights and anger filled self-med until we reach what is the new reality . Number 1 now out numbers 2 and 3 combined (auto crashes and by ppls actions ) where loss of personal. Is concerned and number 1 is now self- checkout . This is why booticians do not annoy me any longer .

      I would slightly disagree with that. As sure as the upper ranks don't look to keep their officers in check and condone improper actions like this, it will only foster more violations of the public. However, the PEOPLE of that town/city need to wake up or simply get tired enough to want to put a stop to all the public tax dollars going out paying for lawsuits. State reps and senators need to be called continuously about getting this type of behavior stopped until they act on it..

      I've been watching these "audits" for a long time. In most cases the supervisors are grossly ignorant of the actual laws. They have been doing things the "old way" for so long that their ego and ignorance of laws refuse to allow them to relinquish any power that they think/believe that they have. The vast majority of cops, except for the very rare exceptions, truly believe that their powers are far greater than they actually are. Most cops do not realize that they have zero power/authority over any citizen not breaking the law. One must also remember that cops almost NEVER stop a crime but get there after the crime was committed, i.e.. robbery, battery, murder, etc.

    This lieutenant/'supervisor' is completely missing the point because he is too busy trying to provide cover for the street cop's incompetent behavior, trying to UNLAWFULLY obtain I.D., attempt to escalate to an actual arrest, lack of attention to detail & proper procedure! Cop would have gone all the way to that point if you had not stopped him!!

      DA in a separate jurisdiction needs to look into police complaints. DA in county (or parish or burrow or whatever it's called where you live) A investigates complaints from county B. DA from county B investigates complaints from county Z. Mix it up. make Leo's jump thru the hoops for a change. Most importantly, settlements need to come from offending Leo's next years budget, then their pensions.

    If the cop never checked the beer, then locked you up for it, that chief would still manufacture endless excuses to defend the way he handled it. Above all else the chief knows he must never entertain, much less admit to, any accusations of wrongdoing or incompetence by his officers. That's a given. Bearing that fact in mind, your conversation with the chief then unfolds as it must.

    Put in a use of force complaint: Handcuffing generally constitutes a use of force and the application of the handcuffs must be reasonable. I hate it when these so called supervisors are willing to overlook bad cops. This is what is driving the wedge between the cops and the public. It is also responsible for their recruitment problems.

    Failing to conduct any investigation before handcuffing you.
    "Section 594:2 - Questioning and Detaining Suspects
    A peace officer may stop any person whom the officer has reason to suspect is committing, has committed, or is about to commit a crime. An officer may request the person's name and address, but the officer shall not arrest the person based solely on the person's refusal to provide such information." I see nothing in the statute that requires you to provide identification as part of the stop.
    I'd talk with a civil rights attorney about pursuing legal action against this officer and the supervisor. They need retraining.

    He admitted that the only reason he put you in cuffs was you exercising your right not to identify by saying 'then turn around and your hands behind your back'. 'Then' was in response to you legally denying his request for ID.

    With all the crime in this mess of a country, handcuffing someone when seeing a "beer" is incredible like it's the prohibition era. I like the dumb argument by the LT that the label doesn't mean there's not really beer there, this dept. should then detain people with water bottles because there could be vodka in there.

    So glad officer Dube learned from his training how to realize when a person is mentally ill or under drug influence. My son-in-law was arrested while under influence , got arrested, was put face down on the pavement in handcuffs and died after saying he couldn't breathe. If the cops had given help instead of arresting him, he would be alive today. My son-in-law left behind his wife and his 5 children. I have no respect for the police. Never will.

    The problem is that he cuffed you up... He put you in cuffs because you said you didn't want to identify. Cops use handcuffs on detained individuals at there discretion. At first he detained you without cuffs but when you didn't want to identify then suddenly he thought cuffs were necessary? Seems like retaliatory behavior more than inadequate investigation....
    See cops can put any detained person in cuffs for any reason... Even though they are supposed to be only be used for arrest or detained people who are behaving in a way that presents public/officer danger or a flight risk... So if you weren't presenting a danger or a flight risk and the officer wasn't going to arrest you without doing a proper investigation... Then obviously he was cuffing you in retaliation for not identifying since he cuffed you only immediately after refusing to identify. That's something the chief didn't seem to understand, and you should have explained that this is why his lack of investigation was so questionable because regardless of why he cuffed it was because he was going to wrongfully arrest you or he was retaliating against your 4th amendment right.
    Cuffs should only be used If you intend to make an arrest or because you believe the person is a risk of fight or flight.... If simply not identifying presents a risk then that means a cop can cuff ABSOLUTELY ANYONE they are investigating who exercises ANY of their rights even if the investigation is for a non arrestable offense..... You don't identify while you get investigated for jaywalking? handcuffs! Simple trespass but you evoke your right to be silent? Handcuffs! Failing to signal 100ft from a turn while practicing free speech? Fuckin' CUFFS!
    THAT'S the real issue here.

    The complaint is simple. He already had you detained when he took the beer out of your hand, that's technically a warrentless search and seizure. But he decided to put you in cuffs as though you were refusing a lawful command when all you did was decline a request for ID. There was no "officer safety concern" to put you in cuffs when he had already seized the subject of his investigation
