      Wasn't this guy a part of a multi-million dollar criminal organization that sold ransomware to naive gamers so they could steal from them. He was their spokesperson, recruited resellers, and helped resellers keep setting up new websites every time law enforcement shut any of them down. For 7 years with just this particular operation and for at least 8 years prior to that with a different group.
      So it's not like he was just a small part time hacker who didn't know better he also received multiple warnings from Nintendo themselves about this and kept on going

    And there's a kicker. The severity of punishment indicates one of the worst crimes is hurting a corporation, not worse moral evils which only get a slap on the wrist. Which is messed up.
    As a disclaimer, I'm not saying companies shouldn't protect their properties. Just that the punishment should match the crime.

    In Japan, this shit is just common. Their copyright law is as ancient as thr dinosaurs, and their enforcement is way tighter here than in America. There's a law that could land you two years in prison for LINKING PIRATE SITES FOR MANGAS. They don't fuck around with the crackdowns either. They worked together with the ISPs to track down your address and your activities, and can immediately send the police for accessing pirate sites. There's a person who downloaded ROMs at a site, and the next day the police immediately showed up in front of his house. Add to the fact that they don't have "fair use" too, and you have a country that basically treated copyright as a criminal case rather than a civil one.

      In japan its the other way around, specially because of how corrupt the legal system there is, i wont say that it doesnt really matter who you are, because it does, if you are a foreign and get into the smallest of legal troubles, you are fucked, same reason why scamming is so prevalent there, in most cases its best to just pay the scammer than for them to get you into court, because of how you, the defendant, have to prove you are not guilty, and how the system itself will try all they can to make sure you dont.

      Usually companies just send a cease-and-desist for this sort of thing since it wouldn't be financially worthwhile to pursue further charges. Generally people back off when they get one, or try to pursue a case in court otherwise. Given that this guy was making a profit off of his hacks, that's likely why Nintendo went for something harsher.
      I feel the punishment is too much, but at the same time, what did he expect to happen for making a profit off of pirating a company's products? Even doing so indirectly (e.g., Patreon) can be enough to be raked over the coals.

      If it went to court, and based on the level of infraction, you bet they would. I've seen it happen, on a lower scale, to a brick and mortar store. They got hit with a pretty strong and stiff sentence and they hardly sold more than maybe 15 modded Xboxs with pirated software preloaded on it. If they profited on a level like Bowser's company here did, it would probably be similar. If Disney got a guilty verdict on someone for the same amount, with a typical judge following state law, expect to pay that for life.

You and everyone hating on Nintendo in this situation are acting like "Gary Bowser" is an innocent victim who was just playing Mario on his couch and got slapped with jail time and this sentence. If this dude wasn't trying to profit from piracy this never would have happened. You can talk all day about how the punishment isn't proportionate to the crime (Which is up for debate. Stealing IP property isn't a small thing) but at the end of the day, if he didn't commit the crime this never would have happened. It never would have went to court to see this guy punished. Don't do the crime if you can't do the time or pay the fine.
      It's not like Nintendo is going to take you or myself to court because we're playing super smash brothers.

      Yep. It's not so much about the punishment itself (or that this is just Nintendo sending a message), it's about how this could set a dangerous precedent.
      All efforts to preserve video games, develop emulators and modifying systems to extend and/or augment them (especially when it's Nintendo's games and consoles involved) could become a massive risk. Nintendo has enough money that they could possibly make the mere act of preserving video games (even at a personal level on games they legally own a copy of), developing emulators (even if only to be used to play personal backups) and/or modifying systems (even if only for homebrew use) a federal crime worthy of harsh punishment.

      Or a Pandora's Cube. Microsoft did a pretty strong thing, including an FBI raid for selling Modded Xboxs with preloaded games on them. This was back in 2004. Sure, their overall infractions were lower, but the sentence was of a similar level if you take into consideration the severity of profiteering. And yes, if done without profit, such wouldn't happen. As why Fansubs of Anime often place text in there stating, "Do not sell this" or something of the sort. (A rule Pandora's Cube also broke. They recorded other people's fansubs and sold those too.)
      I'm not outrightly condoning piracy here for anything, but it's been pretty common knowledge, for decades, that if you start a business to profit off it, you crossed a line you just don't cross.

You may not be aware, but all of Nintendo's "Nintendo Switch Online Back Catalog" are run on Emulators. That's how they are able to update a lot of the old games and include Online Multiplayer Support for games that weren't designed for it. It's not that they reprogrammed the game to allow it, but rather they're using a ROM in an Emulator that, as the name suggests, emulates local multiplayer over the Internet. Also, all of those Micro Systems? You know, NES Classic and SNES Classic? Yeah... those are Emulators that run ROMS. So uh... Nintendo has made money off Emulation and continues to make money off Emulation every day with Nintendo Switch Online.
