      My first 3years contract expired this month and i have only spent 2 years and 10months. My employer only gave me 2more years extension meaning I will be 2 months less than 5yrs by the time the visa expires. Will I be able to apply for ILR by then or will I have to spend 2 more months?

As the main applicant, normally regardless of the COS duration, the work visa would typically be issued for a duration of at least 2-3months additional to your years (i.e. 2 years with be around 2 years, 2 months, etc.). So that should not be a problem. Otherwise, if you were indeed given initial entry permission for 3 years, but have only been physically in the UK for 2 years 10 months, then depending on the circumstance of your initial entry, your continuous residence requirements may not have been impacted (i.e. you should be fine).

    Old expired BRPs are by law expected to be returned but you should keep a scanned copy or picture of the BRP for future reference.

    Why not as the main applicant has gotten ILR, So the dependent as well. Why extending your visa. Anything what main applicant entitles should apply for the dependent visa applicant too. Sooner or later you will get it in due time.

      It doesn't work like that in the UK. Until you have lived 5 years in the uk for skilled workers and dependents , you don't qualify for ilr

    Great content. How long is this new extension due to expire? Will it be sufficient to cover him to reach the 5 year requirement for ILR? I'm assuming the the UAN of the of your last application will expire at the expiration of the COS reference used for that application. This may also define the new visa extension which might not be sufficient to make him eligible for ILR. Could you please confirm the new visa limit, that it will be sufficient to make him eligible for ILR?

      Currently there is no limit to the number of times an existing dependant (skilled worker) visa extension can be made. It is practically limitless regardless of COS references originally used (as they are considered valid at the time the first dependant visa was issued).

    I have a question:
    If someone came to the UK on a Student visa, then switched to a Graduate visa, and their partner joined them six months after the start of the student visa on a Skilled Worker visa, getting married two years into the Skilled Worker sponsorship, would the dependent qualify for ILR after the five-year period?

    Thanks for this Nanelle. I wish you had done this before my kids and husband extended their visas months back. I have my ILR by the way. I had to do it through a lawyer. One of my kids’s ILR is due next year and others 2026. Can she apply for it next year or wait till 2026 for my husband and other kids

      Depending on your circumstances, your kids may not need to apply for ILR, but instead apply directly for citizenship assuming they apply at the same time as yourself (regardless of whether born in UK or abroad). If you can arrange to make your citizenship application at the same time as when your spouse has his ILR, then you could add your kids to your citizenship application (this saves the cost of ILR for each child).

      @@olumayowaolanipekun2916 If any of your children was born in the UK whilst you've been on a work /work dependant visa, once you both qualify for and at least one of you have applied for an ILR, you can apply for citizenship for them directly. If any of your child was born abroad, the ability to apply directly for citizenship (after you've both had ILR) will depend on their own current dependant visa validity. i.e. if their dependant visa is valid until either of you qualifies for citizenship application, you can add them to that application directly. Otherwise, you'd have to either get them the ILR at the same time as yourselves (quite an expensive venture right now!) or simply extend their dependant visa for a year (which is cheaper) before applying for citizenship for everyone together.

    Thanks @NanelleGriselda Your videos are really helpful. I got my ILR and my wife is in the same situation. She will be eligible for ILR in 2026 and her extension for dependant visa is on March 2025. I have a couple of questions.
    1. How soon can we apply for the extension? Can I apply on December 2024?
    2. How about the IHS charges, did you have to pay for 3 years even when the dependant is eligible for ILR in 1 year?

      Hi Nanelle, my situation is very similar but a bit tricky. I will be due for ILR 2yrs 5months before my dependants, when they extend theirs using my UAI number (of my extended visa), they they will only be able to achieve 4yrs 5months, so are they to extend further with thesame UAI number for another one year?

      If yours is Five years then no need to renew . After being in the uk for 5 years you qualify to apply for ILr

    Hii Nanelle, sorry I'm digressing small, I need advice and it urgent,,
    I came to the UK last year December under a Tier 2 visa, and I just had a baby in September, because it just me here no help, and I'm not due for maternity leave with pay, I decided to rather send baby back home for my mum, so that 3years time she can come back, by then I could have settled in well, I have applied for her passport, but my dilemma is should I apply for a dependent visa for her, even though she is Leaving the UK,I plan on rather visiting her myself yearly.

      @@DedeDede-db9vd Not judging here, but never an ideal scenario to separate mother and baby. It is possible to make it work but admittedly may not be the easiest. If you intend to bring her back in 3 years, the baby will need to have a dependant visa herself now. That is the only way she will be admitted back to the UK by then. Otherwise you may have an uphill task applying for and proving she is your dependant from OUTSIDE the UK.

    Nanelle pls I need clarification if u cannot get the answer now, can u ask your Ghanaian group. I am currently on health and care worker visa, I have spent 2 years already already with my husband and daughter. I have twins now. My question is when I apply for their own visa, am I going to pay for 5 years visa fee as mine is 5 years or pay 3 years visa fee since I have spent 2 years b4 their birth.

      Pay for only the remaining years towards your ILR (in this case 3 years). You may then be able to apply for your twins' citizenship directly after you have received your ILR, (assuming your hubby will have gotten his ILR by then as well).

      @@NanelleGriselda we just extended our visas in September and we had to go through the Evisa process which was successful but no new BRP cards were issued to us. The ones we had expired in Sept.

      Of course you can. The evisa doesn't affect the count towards ILR

    Really complicated. It asked if my partner or spouse has applied to work or study in the UK and I said yes boom it asked for Cos details not sure what am not doing right

      Use the last-issued COS details for any subsequent dependant application extension.

      @@GrandPlato even if its already expired? There is a part they asked for expiry date of my visa as I already have ILR and this is my husbands application do I then use the 31/12/2024 as epiry or date as per last Cos? I will try this and see what it will ask further.

    Can a dependent Visa of a student apply for ILR after her 5years? Obviously I know a student visa turns work visa cannot count the student year.

      Student route is a 10-year path. Skilled Worker route is 5 years.

The student concerned changed to skilled worker route after a year. Someone said the wife who came in together with the student could be eligible for ILR after 5 years of Living in the UK while the main applicant will be eligible after 6years of living in the UK because the 1yr student visa will not be reckon with. Is it true that the wife can apply for ILR?

      @@tosinariyo4837 In this hypothetical case, the wife cannot apply for nor be granted ILR if the lead/main applicant (assuming the husband in this case) has not applied for or been granted ILR first, regardless of how long the dependant has stayed in the UK. The exception will be if the wife chooses to go onto the 10-year route.

    Pls @NanelleGriselda I have a direct 5yr visa, and would not need to extend my visa. My question is this, since I came before my dependant and when I will be due to apply for ILR; my dependants visas would only be 4yrs 4months old .. what link will they use to extend and knowing that I would then be a settled person and without a valid Cos? Thank you

    Looks like a loophole, not sure if this is the correct advice. Ideally your husband should have applied for a dependent of a settled person. It has worked for you but good chances it would be rejected for others.

      Nah, not a loophole and nothing wrong with the advice. It is the easiest and valid option to follow. Any existing dependant can extend their skilled worker (Dependant) visa as often as they want on the basis of their main applicant's last valid permission before ILR (in this case, Skilled Worker visa). The alternative you are suggesting may be most applicable to people who are NEWLY-dependant on someone who already has ILR (e.g. through marriage, bringing over their kids/parent from abroad, etc.)

      @@polite153 Still don't get it eh?😆I could go into the technical details regarding continuous residence/qualifying period requirements, etc. but suffice to say that's the current UK immigration rules, and very much legit. The COS may have expired, but the route is still valid. If you are so keen, you can look up the relevant published UK Home office guidance to case workers dealing with these applications.
