102-year-old Oakland man ordered to clean graffiti or face fines

- Wheelchair user, Oakland-born, 102-year-old, Victor Silva, Sr. often finds graffiti painted onto the back fence of his Oakland home. Earlier this month, he got a violation citation from the City of Oakland to remove it by Tuesday the 19th or face an $1100 fine, plus an additional $1277 for each failed re-inspection.

You wouldnt think so because to be part of the GI Generation you'd have to be 96 years and older. But with the advances of medicine a lot more people are living to that age than ever before. And so there still are tens of thousands of GI Gens living amongst us now. I mean Jimmy Carter is still around at the time of this writing, and so is Alan Greenspan. Plus we still have Mel Brooks, David Attenborough, Caren Marsh Doll and others. It all depends. Is the utility box owned or operated by the city? Is there a codicil in the contract regarding upkeep and maintenance? The bureaucratic wheels grind very slowly.

I hate to say it, but that happens in most major cities are used to be a police officer. I’m now a private investigator. I do a lot of work with unseen, accident, investigations, and majority of time we’re on hold for police.
It happens in Vegas happens in LA happens in Phoenix. Arizona happens in Tempe basically happens anywhere that’s not the middle of nowhere or isn’t the suburbs.

He didn’t graffiti his fence, it’s a criminal offence . The city of Oakland should clean it themselves irrespective of any home owners age.
We the people should write a citation to the city for every single city-owned building or piece of property that has graffiti unaddressed on it. $11,000 per major citation and $1200 per day unfixed, payments made directly to the people in that city. See if they like having to drop EVERYTHING they're doing to paint something others have deemed an eyesore.
Very possible a neighbor or someone passing by reported the graffiti to the city, rather than inspectors are roaming the streets looking for a land owner to cite for graffiti.
The City leadership should be fined and should step down for the failed government they’ve enacted.
The officials probably saw him as a easy target to extort money from through these ludicrous fines.

I doubt the city knew he was 102 years old. I wish more cities would force property owners to clean up graffiti as it’s a cancer. You don’t want to leave graffiti, garbage, etc. unaddressed. The theory is called “broken windows” and it was very effective in cleaning up New York City back in the 90s when the city actually cared, now it’s a trashed city. Unfortunately maintenance and up keep comes with owning property. The gentleman can get family, volunteers or hire someone to maintain his property as the neighbors and rest of the community don’t want to look at that each day. To those who say there is graffiti everywhere, why make this property owner clean it up? Unfortunately undesirables graffiti every day but you can’t just give up and not try and clean up the city. This guy is not the only person required to maintain his property. I was a Deputy Probation Officer back in the day and I always ordered offenders when caught to clean up graffiti as part of the terms of their probation.

@@lisacain1670 everyone is focusing on the property owners age. The city who notified him of the issue with his property wouldn’t know his age and frankly it’s irrelevant. Graffiti is a disease on a community and it needs to be cleaned up. The older gentleman can get help from family, volunteers, or pay someone to come maintain his property that he owns and is responsible for. Because of his age should he be allowed to store broken down appliances in his driveway? Cars up on blocks on the front lawn? After all he’s very old so standards and codes shouldn’t apply to him. I wouldn’t leave graffiti on my property for even one day, makes me look trashy. The city can’t use tax payers money and clean private property. As butt hurt as you realize that all cities require property owners to clean graffiti from their property, businesses. Stating that there is graffiti in other places including city property doesn’t mean that we should just give up and not clean up the mess in our cities including graffiti. I’m sure the city cleans up its fair share of graffiti on city property, it’s a never ending task but you can’t just except it and allow it to build up and stay, we already look like a 3rd world country in our cities, let’s take some pride.

What I heard from an insider (Mountain View PD) is the Oakland guys will respond if it sounds like potential injury/harm to a human, but beyond that, they pretty much ignore calls.
They intentionally targeted him because of his age they thought that he wouldn't be able to fix it so they would have more more or get his house.

The person who sited him isn't to blame. That's their job and if they don't do it, they can be fired. They probably have a family to feed. However there is some process for paying or contesting the fine. The people at that point in the process would have the discretion to do the right thing, and chose not too. They are the problem.

I think the city should be fined if there is any graffiti on any street signs, or utility boxes, or any buildings that they are responsible for. Local Government is not above the law, they should be held to the same (if not higher) standard that they impose upon their people.

The strongest generation. Such kindness in him. He doesn't even complain. He just says.. "It's easy, I used to be a contractor." What a good soul. Every generation after him is nothing in comparison to this generation we are losing. My grandma is 94, and she is just like Him. And so isn't her sisters and brothers. They were all like this. They raised me, so I follow in their footsteps. I would kindly paint that man's fence. And the criminals need to be punished. I am an artist, and that crap isn't art. Unwanted and ugly graffiti needs to be heavily criminalized. It makes entire cities look like trash. There is creative and artful graffiti. But gang and destructive graffiti is shameful.
How are you going to punish a senior citizen for something that criminals did?? Trifling.
This man has lived through the Great Depression, World War II, the Cuban Missile Crisis, the 60's, Vietnam, Watergate and 9/11 and they are still giving him this fine. He has seen more than any of those lawmakers or city inspectors. We need to treat our elderly citizens in this country better than this.

The real issue is that this old guy's property has been vandalized , and instead of working to catch and fine and punish the miscreants that have done it , they blame/punish the victim .
Not just that but he STILL has too pay property tax if you're 65 property tax should be null and void same as if you pay off the house on the spot ( unless you're renting it out)
