You can submit any documents that prove that you were in your home country for at least two years,including flight tickets , any gvt document showing residency there, rental agreements, utility bills, work contracts , etc

Hi Hassaan, as for many of these processes it is highly variable. You don't get the employment authorization automatically, you need to wait until you get the EAD card and as i said this is variable, it can take weeks to months

I am a Filipino applying for EB2- NIW hoping to claim cross-chargebility as my spouse’s birth country is a country of less backlogged compared to the Philippines. In fact, since I’m applying from outside the US, should I be sending I-485 along with my I-140 petition in order to claim cross- chargebility to my spouse’s country or is it done at the consular processing stage followed by the initial approval of my I-140 petition. I am a bit confused because I’ve heard only the applicants in US should be submitting the I-140 along with form I-485 adjustment of status, and not those of us applying from outside the US. Hi, Philippines has the most advantageous date on the visa bulletin chart, so you will find no improvement using your spouse's country (whichever it is). Also , if you apply from abroad you cannot file adjustment of status, you would do consular processing instead

There is no I-485 for application from abroad. You would get a letter from the NVC to continue the process in the Consulate you indicated in your I-140 application

I am doing this because his priority date is not current. We are Indian citizens so we have a long wait time to get our green card. I think if I self petition an EB2-NIW we can get a green card in a few months. Do you suggest I go ahead and file the I-485? It is there anything else I need to take care of? I have a masters degree, 6 research publications, 52 citations and more than 13 global clinical trials that I have worked on since last four years in pharmaceutical. I think I have a good case for NIW. I am willing to take proper consultation from you if you offer that service. Thank you for your help.
Hi Alifiya, EB-2 and EB-2 NIW are in the same second preference green card category so the priority date situation is the same for both. you could research eb-1a to see if you think you are eligible for that one,the requirements are higher but India is current. Good luck

My immigration attorney told me that starting December 1st 485 will not be accepted with 140 concurrently

I was a J visa holder but not subject to the two year rule
You can submit any documents that prove that you were in your home country for at least two years,including flight tickets , any gvt document showing residency there, rental agreements, utility bills, work contracts , etc

That's correct, no stamped visa on passport anymore..you will get a green card in your mailbox.

Absolutely not true, however it is true that there is a delay based on the amount of people applying . Ask your lawyer for more accurate info
