Dad was a farmer, and after he sold the farm being ill and unable to continue farming, he farmed me out to his brothers to work their farms, having trained me to be a farmer with intentions of me taking over, however I was but 7 when we moved off the place. Well I was working for my uncle haying one year and every day when I went out to the field, my tractor's fuel tank was empty. I knew I had filled it for the morning with what ever gas I had left in the two 5 gallon cans I took to the field every day. When I told my uncle of it, he sent me out with one can of gas and one can of Diesel for the next day. Well at the end of the day I checked and my gas tank was nearly empty so I filled the tank on the tractor with the Diesel. The next morning my tractor was empty and there was a 1953 Buick sitting on the field road leading to the gravel country road nearby. She was without driver but we all knew who's car it was. My tractor was never empty again,, and during my last few fields to mow, I noticed several young men at that car, draining the diesel from the tank and pouring gas from their own gas cans into the tank till they finally got the old Buick started and she went down the road SMOKING like a semi!
My brother was having similar difficulties with gas being stolen. He did something similar and the neighbor who had been stealing the gas actually had the nerve to demand my brother pay him for repairs to his vehicle. Of course my brother refused!
You're gonna have a hard time convincing most normal people that damaging property, after being physically assaulted, is unreasonable and disproportionate force.
I live in the country on 45 acres. I’ve had to call the police multiple times to force people to move off of my driveway. For some reason people thing because you’re in the country you can park anywhere you want to for however long you want to, and it’s perfectly okay.
What gets my goat is the fact that the farmer was prosecuted in the first place. There seem to be more and more stories here in the UK about victims of crime being prosecuted for defending themselves. It really is turning into a police state over here.

I love it when farmers get creative when dealing with rude people. There was the guy who plowed an 18" trench around cars parking illegally in his field. Then there was a farmer who used his manure spreader on a Mercedes that was parked in this field while the owners were at the beach.
Another Brit farmer used a manure spreader on the town council / municipal house. (Also on TH-cam somewhere...) I don't recall exactly what they called that building - only the glorious sight of some bureaucrat's den of inequity looking, and smelling, as it should.
Near my home town about 30 years ago… a farmer deduced that someone has been stealing fuel from one of his elevated tanks. Back in those days most farmers had at least a pair of tanks - one diesel and one gas. This was way before video cameras btw… so when the gas tank got close to empty he drained it dry into cans and put 40 or 50 gallons of water in it with his spray rig on a Friday. Come Saturday morning there were 3 or 4 vehicles broke down along the road to his barn lot. Turns out it was teenagers that hopefully learned a good lesson.
The lack of parking areas in rural Britain tempts the frustrated into bad decisions. While I sympathize with people wanting to enjoy a day in the country, one still must respect the property owner's right.
Some lady blocked my driveway while on a field trip, I live across from a middle school, and needed to get to work, so I waited awhile, just in case she was around, but then I called the police, and they towed her, she came back 6+ hours later and complained why I had her towed, and that she couldn't afford it, I felt bad, but I didn't stop her from going to work, she got what she deserved, a lesson.
MH1670: While I can understand feeling bad about her ticket, this would have caused you to miss work and miss income as well. As MR1982 says as well, this is a costly lesson not to be forgotten.
Good on the farmer and the jury. This reminds me of the video I saw of a farmer in another country who kept having a problem with commuters parking on his land all day to catch mass transit to work, preventing him from working his fields. After being repeatedly ignored, he waited one day until they all had parked their cars on his land and went to work before plowing the field between their cars and the road making it impossible for them to leave that evening.

My late friend Wayne was a welder/fabricator, had grown up on a Michigan farm, and was an electrical engineer in the Army. Amongst our circle of friends, folks liked to play little pranks on each other. Early on, I made the decision not to play any tricks on Wayne. He was way too smart, and had access to way too much heavy equipment. I know that random loads of dirt, and large logs had shown up blocking people's driveways in the middle of the night or day, as a response to someone's prank. Gotta be careful who you mess with.

It's hilarious when people are caught breaking the law (trespassing), are asked to stop (leave), refuse to do so, then suffer because of their choices. If someone politely asks you to leave their property, you deserve whatever comes to you if you refuse to comply.
Tbf, this case that is true but in England trespassing isn't quite like it is in the US, and if they were just on his land, providing they weren't on crops and weren't causing damage to property, and presuming it wasn't his home or garden, he actually wouldn't have the right to stop them. This case was based in large part on the trespassers being loud, obnoxious, drinking, threatening him, and assaulting him, which lead to the finding of reasonableness. You can't do this just because someone refuses to leave your property, that would be criminal damage under English law.
@@thisbushnell2012 Only if you can prove that he did actually drive the car whilst drunk, and unlike the US you don't sit in jail awaiting bond in England, you have a right to bail (and bail isn't cash bail its just release subject to conditions which can include cash bonds and sureties but are extremely rare especially since the invention of GPS tagging), so they'd just be in police custody until they sobered up, and only if the police could establish he was driving and prove he was drunk at the time. Even so, police custody in the UK just isn't at all like jail in the US, and on conviction, if he hasn't got a list of priors and nobody was hurt, he's getting a fine and a community order, not a prison sentence (all jail terms in the UK are prison sentences as neither English (and Welsh), Scots, or (Northern) Irish Law recognise a distinction between prison and jail.
For me, thats the root of the trouble, I meat it many times as a teacher. People just wont listen and complie, when you ask them nicely and get all flustert and surprised when that brings a consequence their way. They never want to belive, that it was their Action, that caused this Reaktion.
This is what's wrong with the criminal system, the farmer never should have been charged. Because of those guys creating a problem the farmer had to spend thousands of dollars and countless hours to defend himself.
Once violence has been initiated, the reaction to that is rarely logical or rational. Military and law enforcement do train for this, but the rest of us aren't as well prepared. I think this farmer was more level headed than many I know.
I remember a case a few yrs back in California: guy was counting out payroll in his own home... Suddenly got human bodies through a window w/guns...tied him up, emptied the open safe, then took off out the same Windows... Guy got himself untied, got into his HUMMER, chases down the thieves & pins them in the car by running over the car with his HUMMER!!! Snatches back his cash, then sits in his vehicle till cops arrive to arrest the crooks. He was cleared of any wrongdoing as well.....😜💜

Steve, I know of a story were a person was butchering a stolen steer about 100 metres of the road in a remote area of Western Australia. Two station owners (farmers) had observed him commit the shooting of the beast and commence to butcher it. They decided to do bush justice, they snuck up to his vehicle and using a bunch of spinifex set fire to it . The culprit had to walk back to town, about 25 kms, explain to his insurance company and convince the police that it was an accident so they would not investigate the fire and find a half butchered cow not far from the fire scene. I understand there was no longer cheap meat available in town any more after this!

When I was a kid I used to like to ride my bike along a road that no longer exists between my home town (Fairfield) and the next town to the North, Vacaville, in California. The area has since been developed but at the time there was a rural strip between the towns that made for an extremely pleasant bike ride. The entire area is called "Steinbeck country because it's where John Steinbeck's came from and he wrote about it, describing the landscape in great detail. There was a little cattle ranch out their and all us kids knew to stay the hell off that land because the land owner was known to shoot at trespassers with a shotgun loaded with rock salt (because it's non-lethal but hurts a lot). Looking back, I'm pretty sure it was BS, even in 1982, if you shot a kid, even if he is trespassing on your land with anything, you'd be getting a rather intense visit from the police. But at the time I totally believed the stories. I would often stop to say high to the cows but also keeping a sharp eye out for cowboys with shotguns (I never saw any of those). One day I saw one of the cows seemed to be in distress. When she turned her back to me I saw why. She had started to give birth, but something had gone wrong. The calf had died with only it's head sticking out, It was covered in dirt and grass and bugs. The bugs had already been to work on it's eyes, so this poor cow had been in this position already for hours. I'm no farm kid, but even a city kids knows an emergency when he sees one. What the hell should I do. Do I dare trespass and knock on the guys door? Would he shoot me on sight before I could explain why I was on his land? Then I realized how unreasonable such an action would be. The cow had obviously been in distress for hours and hours already. How much longer before it was too late to save her? So, I jumped back on my bike and for the first time in my life I disobeyed a "No Trespassing" sign. I was kind of sure the farmer wouldn't shoot me on sight, but I wasn't totally sure, and I really didn't want to get shot with rock salt. Turns out the farmer was extremely friendly and would never ever shoot a kid with anything for any reason (but don't tell anyone that, okay?) It turned out the farmer was able to save the cow, but it was a close thing. Not much longer it would have been too late. Just goes to show, you can't believe everything they tell you.

I grew up in the country and we had to deal with such entitled / drunk clowns on a number of occasions. While I very much doubt events occurred (exactly) as reported I still have to say "good for the farmer"... and I'm a lawyer... Sounds like the jury took one look at the person(s) complaining and thought they didn't like the look of them one little bit and they'd got what they deserved (and it would also serve as a warning to others)
I used to live on family owned farm, we get all kinds of people destroying our property for their pleasures. One guy cut hydraulic hoses on our backhoe because he thought it was a demon (high on something). We had a guy tried to rape a cow. We had a couple had sex in the chicken coup, destroyed many eggs using them as whatever I cannot imagine. So much... I am not a farmer, and my family sold the farm for medical reasons.
We will never know what happened. These drunks may very well have had a flat. And did nothing wrong . The farmer might have been mad from the last drunk or kids who came on his property and took it out on these folks. If you live in a rural area the court will find for There own over an outsider 99% of the time.
I think you are correct. This decision seems very out of sync with other decisions you hear from the UK. Had this been a warehouse forklift in an urban area I suspect the operator would be prosecuted. Punches or no.
I've been on jury duty 3 times. One rape case, one cocaine case, and one DUI . I was the foreman on the drug case. The camera footage from the dui, and the drug case were what we based most of our decisions on, because it showed us a bit of the state of mind and rationality of the people involved at the time of the incident.
That old english law helps to set the precedent for today's castle law or castle doctrine, which many states, including my own, subscribe to. Your home or your vehicle are your castle and you have the right to protect yourself within them with any means necessary, including deadly force. I have watched many videos from England, where government and court officials are under attack, and it takes 30-45 minutes for the cops to show. Sometimes one must take matters into their own hands.
If only.....Sadly, most places in the states, the legislators, judges, & prosecutors will have the jury thinking; " He was able to leave the seen. He chose to return with the tractor. He had time to call the police." This is of course bull scat. But be careful trying to protect your property in the states because we don't have a justice system We have a conviction system.
@@jupitercyclops6521 I dunno, If I were on the jury I probably would of found him not guilty because of the facts of the case, specifically that he was defending his property against an ongoing threat and I think the amount of force used was justified for the situation, he was already assaulted by the hooligans and the car was interfer with the use of his property so moving it was justified in my opinion. The fact that he had a good reason to believe that law enforcement could not arrive in a timely fashion also bolstered his case. And I'm not someone who believes that castle doctrine gives you the right to shoot someone in the back just because they trespassed onto your property.
Had a local kid who would always park in my field approach during hunting season while I was harvesting a particular field. He was only hunting in the ditch which is totally legal. I had not cut grass in my ditches for the purposes of the birds and hunting. After third day of him being in the way, he got one to two birds each time good for him. But he was two stupid to realize his blockade even though another approach was half mile away. When he left happy, I drove straight back to farm hooked up mower and spent next 6 hours mowing my 5 miles of road ditches. Next day I’m back harvesting he parks realizes no more grass, gets out looks up and down roadway, sees all roadways are bare both sides, puts gun back in car and drove to my next field which he was to find I had also cut. I never left tall grass in roadways again to be nice.

This reminds me of the case where the farmer had all those people parking on his land in his field even though he's told everyone in town not to park there but they decide to park there anyways so what does he do he does what he planned on doing start turning the field start plowing it do you know what happens when you have 25 vehicles parked on your land and you plow all around them especially when they're mostly cars lol well everyone tried to charge the farmer with all the damage from their vehicles from getting them pulled out of the field after he plowed it. They asked him to pull the vehicles out he said no there's a tow company that will do it for you but you guys are going to have to have permission to get it off my land. Well it went to the court and the judge looks at the case looks at the farmer he's like hey did you have any signs that said no parking Farmers lake yes I did I had him up for 6 months before I was going to plow my field and I went out to plow my field in a bunch of vehicles were there so I plowed around them it's not my fault they got damaged getting off my property well the judge ruled in the farmers favor and everyone that tried to sue the farmer got a countersuit lawsuit against them and the farmer won. One of the vehicles or a few of them ended up having oil leaks and radiator fluid leaks that leaked on the ground which we all know will destroy your crops or poison them.
One of the best trial results I've seen here in a while. The alleged "victims" are typical drunk townie scum. There was another near me last year, where visitors blocked a farmer's access to fields he was working on by illegally parking on a narrow country road. He ran his tractor through with the plough on & wrecked about 30 of them. Police refused to charge him with anything.
I read a farmer in Croatia plowed around cars making it impossible for them to leave his field. They held a flea market near his property I guess the towns folk were thinking they could park wherever they chose , it was only fields. They could not charge him , he broke no laws
I live near this area in the UK and I think most people in the UK were amazed that the farmer won the case, not because we think the farmer was wrong but so many times in the past people in similar situations people have lost. I can totally relate to the fact that it would take an hour for the police to arrive as that has been my experience even in an emergency, for most crime in UK they don’t even come to see you on the same day. I lived in Virginia in the 1990s and was frankly amazed when I had $100 some stolen out of my bank account and had a visit from the police asking where I had used my debit card. In the UK they are not interested and leave it up to the banks to deal with.
This all happened during lockdown, the men involved were using the road past his farm as a race track, and parked across his gateway so he couldn't drive on to the road and spoil their fun. You should see the video, it's hilarious!

I remember seeing that video and the amount of people saying the farmer had NO RIGHT and they "broke down" and the farmer was angry and out of line, shows the decline in society in 1: they see an out of context clip and think what they say on the matter is like the word of god and no one can tell them different and 2: how sad it is that people don't think people have a right to defend themselves or their property. IMO if they refused to move off of MY property while blocking me in, i would take that as a threat and should be within my rights to remove them and their property by any means. I'm sure there are places you can be shot just for stepping on someone's land when no trespassing signs are posted everywhere. When i saw the clip i was leaning more towards the farmers side because (if I remember correctly) it appeared to be a very low traveled road and the guys "broke down" right into and the middle of this mans driveway. I knew something else had to be going on but didn't think about a scenario that the young guys were drunk.
If I’m breaking down an get unlucky enough to stop in front of a driveway, sure as heck I’ll be pushing that car out of the way pronto. There was a couple of lads there. They should have had no trouble pushing it a couple dozen feet down the lane. It’s astonishing that’s something that people would need to be told about. Sure, if that was someone physically unable to push the car - that’s another story. But a car that’s not on fire and a couple of lads not falling over drunk - I just shake my head.
I’ve seen the video of him removing the car with the guy kicking his tires. So glad the court ruled for him hearing the rest of the story gave explanations his reaction.

I think I might have seen that incident on TH-cam on one of those accident driving channels. I remember a forklift type of tractor flipping a car and doing just as you described. It was funny to watch but I do remember it
If these doofuses actually had 2 flat tires most farmers would have plugged their tires, aired them up and sent them on their way then called the law on the drunk driver..
The car was *backed* into the driveway, but not past the gate so there would be room to get past the car. That makes me very skeptical that there was anything wrong with the car.
In my opinion, moving an illegally parked car off your property, shouldn't be looked at any differently than having the city tow a car off the street. If the Government is allowed to tow an illegally parked car, you should have the same rights on your private property.
Yeah he would have been more careful when he was moving the car. The issue was he was blocking the entrance to his property. That's what needed to be rectified. He likely wouldn't have even said something if the person was just parked there on the edge of the property not interfering with anything

I never heard about the assault. I am so in support of the farmer. If it had been just a broken down car that would have been a bit different. But the assault changes it from a parking problem to a defense of his life and liberty.

(This is a further problem for the "lager louts", but many UK farmers have weapons licenses, but generally they get serious problems if pointed at a person, even when the gun is "broken", gun open for loading).
I was shocked by my professional, Conservative father. When his Grade school friend and son (all Adults ) where leaving a Canadian Hunting/fishing trip in their "Moonie" (airplane type)as we would be driving 7 hrs back to Minnesota ,I suggested we moon them. With A gleam in his eye,he laughed and Said "show'em the full fruit basket Boys"(sic)....and we did..lol.
I had once put my tent on a British farmer's property over night, because my bicycle broke (one of the pedals broke off, so quite serious and not easily repairable). The farmer came to me in the morning and asked me what I was doing there. I pointed to my broken pedal. He said: When I am back, you are gone. And so I packed my bagages and my tent, and when he indeed came back, he brought a big cup of milk coffee and a list of nearby bicycle shops. I guess, if they didn't punch him in the face but pointed to the punctured tire, he might not used his forklift on the car to flip it, but to lift it gently and help to change the tire.
A similar thing happened to me a few weeks ago car camping in Scotland. Not parked on his land but on the side of the road within view of where he was working around midnight. He asks if I'm ok, says goodnight, then 15 minutes later returns with snacks and coffee for me. Later on I crashed and had to be rescued by another farmer with his tractor - so it seems like they're generally good guys
Glad it went his way. I did something very similar about 25 years ago. We live on a 60 acre rural property in a small town in central Ohio. Actually in what is referred to here as an "unincorporated township", meaning that we are not actually in a "town", just a county. Law enforcement from county sheriffs, fire from community next door. well, I came home from work to find our front hay field wrecked, covered in tire tracks. And down in a hollow to one side, stuck in the mud was a very expensive, customized jeep. Still with dealer plates. No one in site. No note. Now, being a helpful person I got my tractor (with front end loader) and moved their jeep about 200 yards out to the road. Flipping it end over end and side to side. Dragged it with a chain, upside down part of the way. Left it on it's roof at the edge of the road. Then I washed down my tractor, put it away and had a beer while waiting for the show... About an hour later a tow truck and several young men showed up. Much screaming about "my dad is going to kill me!". Father arrives. Police are called...county sheriff who lives out in the country like us. I denied any knowledge of moving the jeep. "maybe the kids did it, trying to get it out after doing the thousands of Dollars of damage to my field and fences". Sheriff just smiles and tells the group to forget about it and just leave. If anyone was going to get ticketed it would be the boys.

Good. I grew up rural and the majority of the farmers I know don't have much tolerance for tomfoolery. Some of them, if you punch them in the face, might feed you to the hogs.
In the US the farmer would have grabbed his shotgun and told them to move the damn car. Flat tire or not, a car can be driven far enough to clear a driveway. I am a big believer of "you get what you give" in this world. You give two punches to a man on his own property, what happens afterwards has been brought on yourself. Also, maybe don't drink 7 lagers while driving.
In the early 90s, as two US people we were driving in Scotland in our rental car. Turned down a one lane track. Here's a HUGE flock of sheep approaching. The farmer is on an ATV, wearing a terrible frown. We thought fast, and backed off the track, so we didn't impede the sheep. The farmer gave us a smile and polite nod. I took multiple photos. Wish we'd had a video device, it was such a lovely sight! Attempting to drive through the sheep could have been a disaster! Confusion and probable injuries to the sheep, who were trotting at a good pace. This was a great experience for us, seeing the sheep and receiving a nod for acting responsibly and respectfully.

Dad was a farmer, and after he sold the farm being ill and unable to continue farming, he farmed me out to his brothers to work their farms, having trained me to be a farmer with intentions of me taking over, however I was but 7 when we moved off the place. Well I was working for my uncle haying one year and every day when I went out to the field, my tractor's fuel tank was empty. I knew I had filled it for the morning with what ever gas I had left in the two 5 gallon cans I took to the field every day. When I told my uncle of it, he sent me out with one can of gas and one can of Diesel for the next day. Well at the end of the day I checked and my gas tank was nearly empty so I filled the tank on the tractor with the Diesel. The next morning my tractor was empty and there was a 1953 Buick sitting on the field road leading to the gravel country road nearby. She was without driver but we all knew who's car it was. My tractor was never empty again,, and during my last few fields to mow, I noticed several young men at that car, draining the diesel from the tank and pouring gas from their own gas cans into the tank till they finally got the old Buick started and she went down the road SMOKING like a semi!
My brother was having similar difficulties with gas being stolen. He did something similar and the neighbor who had been stealing the gas actually had the nerve to demand my brother pay him for repairs to his vehicle. Of course my brother refused!

I live in the country on 45 acres. I’ve had to call the police multiple times to force people to move off of my driveway. For some reason people thing because you’re in the country you can park anywhere you want to for however long you want to, and it’s perfectly okay.
What gets my goat is the fact that the farmer was prosecuted in the first place. There seem to be more and more stories here in the UK about victims of crime being prosecuted for defending themselves. It really is turning into a police state over here.

I love it when farmers get creative when dealing with rude people. There was the guy who plowed an 18" trench around cars parking illegally in his field. Then there was a farmer who used his manure spreader on a Mercedes that was parked in this field while the owners were at the beach.
Another Brit farmer used a manure spreader on the town council / municipal house. (Also on TH-cam somewhere...) I don't recall exactly what they called that building - only the glorious sight of some bureaucrat's den of inequity looking, and smelling, as it should.
Near my home town about 30 years ago… a farmer deduced that someone has been stealing fuel from one of his elevated tanks. Back in those days most farmers had at least a pair of tanks - one diesel and one gas. This was way before video cameras btw… so when the gas tank got close to empty he drained it dry into cans and put 40 or 50 gallons of water in it with his spray rig on a Friday. Come Saturday morning there were 3 or 4 vehicles broke down along the road to his barn lot. Turns out it was teenagers that hopefully learned a good lesson.

I live on a farm, farmers action was appropriate.
Some lady blocked my driveway while on a field trip, I live across from a middle school, and needed to get to work, so I waited awhile, just in case she was around, but then I called the police, and they towed her, she came back 6+ hours later and complained why I had her towed, and that she couldn't afford it, I felt bad, but I didn't stop her from going to work, she got what she deserved, a lesson.
A life lesson that is expensive WON'T BE FORGOTTEN ANYTIME SOON.

This reminds me of the video I saw of a farmer in another country who kept having a problem with commuters parking on his land all day to catch mass transit to work, preventing him from working his fields. After being repeatedly ignored, he waited one day until they all had parked their cars on his land and went to work before plowing the field between their cars and the road making it impossible for them to leave that evening.
Had he been a bit brighter he might have built a gravel lot and made some bank charging for parking

My late friend Wayne was a welder/fabricator, had grown up on a Michigan farm, and was an electrical engineer in the Army. Amongst our circle of friends, folks liked to play little pranks on each other. Early on, I made the decision not to play any tricks on Wayne. He was way too smart, and had access to way too much heavy equipment. I know that random loads of dirt, and large logs had shown up blocking people's driveways in the middle of the night or day, as a response to someone's prank.
Gotta be careful who you mess with.

It's hilarious when people are caught breaking the law (trespassing), are asked to stop (leave), refuse to do so, then suffer because of their choices. If someone politely asks you to leave their property, you deserve whatever comes to you if you refuse to comply.

Tbf, this case that is true but in England trespassing isn't quite like it is in the US, and if they were just on his land, providing they weren't on crops and weren't causing damage to property, and presuming it wasn't his home or garden, he actually wouldn't have the right to stop them. This case was based in large part on the trespassers being loud, obnoxious, drinking, threatening him, and assaulting him, which lead to the finding of reasonableness. You can't do this just because someone refuses to leave your property, that would be criminal damage under English law.
@@thisbushnell2012 Only if you can prove that he did actually drive the car whilst drunk, and unlike the US you don't sit in jail awaiting bond in England, you have a right to bail (and bail isn't cash bail its just release subject to conditions which can include cash bonds and sureties but are extremely rare especially since the invention of GPS tagging), so they'd just be in police custody until they sobered up, and only if the police could establish he was driving and prove he was drunk at the time. Even so, police custody in the UK just isn't at all like jail in the US, and on conviction, if he hasn't got a list of priors and nobody was hurt, he's getting a fine and a community order, not a prison sentence (all jail terms in the UK are prison sentences as neither English (and Welsh), Scots, or (Northern) Irish Law recognise a distinction between prison and jail.

Once violence has been initiated, the reaction to that is rarely logical or rational. Military and law enforcement do train for this, but the rest of us aren't as well prepared. I think this farmer was more level headed than many I know.

Steve, I know of a story were a person was butchering a stolen steer about 100 metres of the road in a remote area of Western Australia. Two station owners (farmers) had observed him commit the shooting of the beast and commence to butcher it. They decided to do bush justice, they snuck up to his vehicle and using a bunch of spinifex set fire to it . The culprit had to walk back to town, about 25 kms, explain to his insurance company and convince the police that it was an accident so they would not investigate the fire and find a half butchered cow not far from the fire scene. I understand there was no longer cheap meat available in town any more after this!

When I was a kid I used to like to ride my bike along a road that no longer exists between my home town (Fairfield) and the next town to the North, Vacaville, in California. The area has since been developed but at the time there was a rural strip between the towns that made for an extremely pleasant bike ride.
The entire area is called "Steinbeck country because it's where John Steinbeck's came from and he wrote about it, describing the landscape in great detail.
There was a little cattle ranch out their and all us kids knew to stay the hell off that land because the land owner was known to shoot at trespassers with a shotgun loaded with rock salt (because it's non-lethal but hurts a lot). Looking back, I'm pretty sure it was BS, even in 1982, if you shot a kid, even if he is trespassing on your land with anything, you'd be getting a rather intense visit from the police. But at the time I totally believed the stories.
I would often stop to say high to the cows but also keeping a sharp eye out for cowboys with shotguns (I never saw any of those).
One day I saw one of the cows seemed to be in distress. When she turned her back to me I saw why. She had started to give birth, but something had gone wrong. The calf had died with only it's head sticking out, It was covered in dirt and grass and bugs. The bugs had already been to work on it's eyes, so this poor cow had been in this position already for hours. I'm no farm kid, but even a city kids knows an emergency when he sees one.
What the hell should I do. Do I dare trespass and knock on the guys door? Would he shoot me on sight before I could explain why I was on his land? Then I realized how unreasonable such an action would be.
The cow had obviously been in distress for hours and hours already. How much longer before it was too late to save her? So, I jumped back on my bike and for the first time in my life I disobeyed a "No Trespassing" sign.
I was kind of sure the farmer wouldn't shoot me on sight, but I wasn't totally sure, and I really didn't want to get shot with rock salt.
Turns out the farmer was extremely friendly and would never ever shoot a kid with anything for any reason (but don't tell anyone that, okay?)
It turned out the farmer was able to save the cow, but it was a close thing. Not much longer it would have been too late.
Just goes to show, you can't believe everything they tell you.

I grew up in the country and we had to deal with such entitled / drunk clowns on a number of occasions. While I very much doubt events occurred (exactly) as reported I still have to say "good for the farmer"... and I'm a lawyer... Sounds like the jury took one look at the person(s) complaining and thought they didn't like the look of them one little bit and they'd got what they deserved (and it would also serve as a warning to others)
I used to live on family owned farm, we get all kinds of people destroying our property for their pleasures. One guy cut hydraulic hoses on our backhoe because he thought it was a demon (high on something). We had a guy tried to rape a cow. We had a couple had sex in the chicken coup, destroyed many eggs using them as whatever I cannot imagine. So much... I am not a farmer, and my family sold the farm for medical reasons.

We will never know what happened. These drunks may very well have had a flat. And did nothing wrong . The farmer might have been mad from the last drunk or kids who came on his property and took it out on these folks. I think you are correct. This decision seems very out of sync with other decisions you hear from the UK. Had this been a warehouse forklift in an urban area I suspect the operator would be prosecuted. Punches or no.
I've been on jury duty 3 times. One rape case, one cocaine case, and one DUI . I was the foreman on the drug case.
The camera footage from the dui, and the drug case were what we based most of our decisions on, because it showed us a bit of the state of mind and rationality of the people involved at the time of the incident.
That old english law helps to set the precedent for today's castle law or castle doctrine, which many states, including my own, subscribe to. Your home or your vehicle are your castle and you have the right to protect yourself within them with any means necessary, including deadly force. I have watched many videos from England, where government and court officials are under attack, and it takes 30-45 minutes for the cops to show. Sometimes one must take matters into their own hands.

@@jupitercyclops6521 I dunno, If I were on the jury I probably would of found him not guilty because of the facts of the case, specifically that he was defending his property against an ongoing threat and I think the amount of force used was justified for the situation, he was already assaulted by the hooligans and the car was interfer with the use of his property so moving it was justified in my opinion. The fact that he had a good reason to believe that law enforcement could not arrive in a timely fashion also bolstered his case.
And I'm not someone who believes that castle doctrine gives you the right to shoot someone in the back just because they trespassed onto your property.

Had a local kid who would always park in my field approach during hunting season while I was harvesting a particular field. He was only hunting in the ditch which is totally legal. I had not cut grass in my ditches for the purposes of the birds and hunting. After third day of him being in the way, he got one to two birds each time good for him. But he was two stupid to realize his blockade even though another approach was half mile away. When he left happy, I drove straight back to farm hooked up mower and spent next 6 hours mowing my 5 miles of road ditches. Next day I’m back harvesting he parks realizes no more grass, gets out looks up and down roadway, sees all roadways are bare both sides, puts gun back in car and drove to my next field which he was to find I had also cut. I never left tall grass in roadways again to be nice.

Side note: The farmer probably has a shop where he fixes his own flat tires. This reminds me of the case where the farmer had all those people parking on his land in his field even though he's told everyone in town not to park there but they decide to park there anyways so what does he do he does what he planned on doing start turning the field start plowing it do you know what happens when you have 25 vehicles parked on your land and you plow all around them especially when they're mostly cars lol well everyone tried to charge the farmer with all the damage from their vehicles from getting them pulled out of the field after he plowed it. They asked him to pull the vehicles out he said no there's a tow company that will do it for you but you guys are going to have to have permission to get it off my land. Well it went to the court and the judge looks at the case looks at the farmer he's like hey did you have any signs that said no parking Farmers lake yes I did I had him up for 6 months before I was going to plow my field and I went out to plow my field in a bunch of vehicles were there so I plowed around them it's not my fault they got damaged getting off my property well the judge ruled in the farmers favor and everyone that tried to sue the farmer got a countersuit lawsuit against them and the farmer won. One of the vehicles or a few of them ended up having oil leaks and radiator fluid leaks that leaked on the ground which we all know will destroy your crops or poison them.

There was another near me last year, where visitors blocked a farmer's access to fields he was working on by illegally parking on a narrow country road.
He ran his tractor through with the plough on & wrecked about 30 of them.
Police refused to charge him with anything.
I read a farmer in Croatia plowed around cars making it impossible for them to leave his field. They held a flea market near his property I guess the towns folk were thinking they could park wherever they chose , it was only fields. They could not charge him , he broke no laws
when I was growing up I was taught to respect farmers because they are self sufficient and they have the means to easily dispose of bodies😂

I live near this area in the UK and I think most people in the UK were amazed that the farmer won the case, not because we think the farmer was wrong but so many times in the past people in similar situations people have lost. I can totally relate to the fact that it would take an hour for the police to arrive as that has been my experience even in an emergency, for most crime in UK they don’t even come to see you on the same day.
I lived in Virginia in the 1990s and was frankly amazed when I had $100 some stolen out of my bank account and had a visit from the police asking where I had used my debit card. In the UK they are not interested and leave it up to the banks to deal with.
This all happened during lockdown, the men involved were using the road past his farm as a race track, and parked across his gateway so he couldn't drive on to the road and spoil their fun. You should see the video, it's hilarious!

This makes me soo happy. I remember seeing that video and the amount of people saying the farmer had NO RIGHT and they "broke down" and the farmer was angry and out of line, shows the decline in society in 1: they see an out of context clip and think what they say on the matter is like the word of god and no one can tell them different and 2: how sad it is that people don't think people have a right to defend themselves or their property. IMO if they refused to move off of MY property while blocking me in, i would take that as a threat and should be within my rights to remove them and their property by any means. I'm sure there are places you can be shot just for stepping on someone's land when no trespassing signs are posted everywhere.
When i saw the clip i was leaning more towards the farmers side because (if I remember correctly) it appeared to be a very low traveled road and the guys "broke down" right into and the middle of this mans driveway. I knew something else had to be going on but didn't think about a scenario that the young guys were drunk.
If I’m breaking down an get unlucky enough to stop in front of a driveway, sure as heck I’ll be pushing that car out of the way pronto. There was a couple of lads there. They should have had no trouble pushing it a couple dozen feet down the lane. It’s astonishing that’s something that people would need to be told about. Sure, if that was someone physically unable to push the car - that’s another story. But a car that’s not on fire and a couple of lads not falling over drunk - I just shake my head.

I’ve seen the video of him removing the car with the guy kicking his tires. So glad the court ruled for him hearing the rest of the story gave explanations his reaction.
I happened to see a clip of this the other day. I thought it was great but assumed the farmer was gonna be screwed for doing it. So glad to hear he wasn't, maybe there's a little sanity left in the world.

I think I might have seen that incident on TH-cam on one of those accident driving channels. I remember a forklift type of tractor flipping a car and doing just as you described. It was funny to watch but I do remember it

They had damaged their tyres beyond easy repair from racing up and down the lane before hand

The car was *backed* into the driveway, but not past the gate so there would be room to get past the car. That makes me very skeptical that there was anything wrong with the car.
I don't believe there was a *legal* justification for wrecking their car. It's jury nullification in Old Blighty. I fully approve.
In my opinion, moving an illegally parked car off your property, shouldn't be looked at any differently than having the city tow a car off the street. If the Government is allowed to tow an illegally parked car, you should have the same rights on your private property.
There are laws against parking in a driveway, even if it's your own.

Yeah he would have been more careful when he was moving the car. The issue was he was blocking the entrance to his property. That's what needed to be rectified. He likely wouldn't have even said something if the person was just parked there on the edge of the property not interfering with anything

I never heard about the assault. I am so in support of the farmer. If it had been just a broken down car that would have been a bit different. But the assault changes it from a parking problem to a defense of his life and liberty.

There has to be consequences for shitty behavior of individuals. People have the right to defend themselves and they should have full rights to defend their property.
Steve, plenty of support. BTW the offensive action is referred to as a "full moon" in English. (This is a further problem for the "lager louts", but many UK farmers have weapons licenses, but generally they get serious problems if pointed at a person, even when the gun is "broken", gun open for loading).

I had once put my tent on a British farmer's property over night, because my bicycle broke (one of the pedals broke off, so quite serious and not easily repairable).
The farmer came to me in the morning and asked me what I was doing there. I pointed to my broken pedal. He said: When I am back, you are gone. And so I packed my bagages and my tent, and when he indeed came back, he brought a big cup of milk coffee and a list of nearby bicycle shops.
I guess, if they didn't punch him in the face but pointed to the punctured tire, he might not used his forklift on the car to flip it, but to lift it gently and help to change the tire.
And if they didn't leave it smack in the middle of his drive......................
A similar thing happened to me a few weeks ago car camping in Scotland. Not parked on his land but on the side of the road within view of where he was working around midnight. He asks if I'm ok, says goodnight, then 15 minutes later returns with snacks and coffee for me. Later on I crashed and had to be rescued by another farmer with his tractor - so it seems like they're generally good guys

Glad it went his way. I did something very similar about 25 years ago. We live on a 60 acre rural property in a small town in central Ohio. Actually in what is referred to here as an "unincorporated township", meaning that we are not actually in a "town", just a county. Law enforcement from county sheriffs, fire from community next door.
well, I came home from work to find our front hay field wrecked, covered in tire tracks. And down in a hollow to one side, stuck in the mud was a very expensive, customized jeep. Still with dealer plates. No one in site. No note.
Now, being a helpful person I got my tractor (with front end loader) and moved their jeep about 200 yards out to the road. Flipping it end over end and side to side. Dragged it with a chain, upside down part of the way. Left it on it's roof at the edge of the road.
Then I washed down my tractor, put it away and had a beer while waiting for the show...
About an hour later a tow truck and several young men showed up. Much screaming about "my dad is going to kill me!". Father arrives. Police are called...county sheriff who lives out in the country like us.
I denied any knowledge of moving the jeep. "maybe the kids did it, trying to get it out after doing the thousands of Dollars of damage to my field and fences".
Sheriff just smiles and tells the group to forget about it and just leave. If anyone was going to get ticketed it would be the boys.
Judge: What happened?
Farmer: Idk, I just flipped out...

I grew up rural and the majority of the farmers I know don't have much tolerance for tomfoolery.
Some of them, if you punch them in the face, might feed you to the hogs.
In the US the farmer would have grabbed his shotgun and told them to move the damn car. Flat tire or not, a car can be driven far enough to clear a driveway.
I am a big believer of "you get what you give" in this world. You give two punches to a man on his own property, what happens afterwards has been brought on yourself. Also, maybe don't drink 7 lagers while driving.

The prosecutor is incompetent. His arguments were weak. The prosecutor should never have proceeded against the farmer.
These traveller types get all upset when anyone challenges or criticises them. They live off the proceeds of crime and cause misery wherever they go.

In the early 90s, as two US people we were driving in Scotland in our rental car. Turned down a one lane track. Here's a HUGE flock of sheep approaching. The farmer is on an ATV, wearing a terrible frown. We thought fast, and backed off the track, so we didn't impede the sheep. The farmer gave us a smile and polite nod. I took multiple photos. Wish we'd had a video device, it was such a lovely sight!
Attempting to drive through the sheep could have been a disaster! Confusion and probable injuries to the sheep, who were trotting at a good pace. This was a great experience for us, seeing the sheep and receiving a nod for acting responsibly and respectfully.
In Newport Beach California If someone parks on your property and you push their car off your property that becomes a violation. Yeah, I've helped block the alley a few times.🤠

He is a hero. He should have forked it through the windshield but he definitely made that car hard to operate after he dealt with it.
