Agreement to sale is just an agreement to mention the terms and condition of sale and it is never a proof of sale & whereas sale deed is a document that shows proof of transaction...

The truth/ logic behind this is.. Registrar is not having any obligation to minutely scrutinize the title prior to registration and he is only concerned about state revenue (stamp)... Court can thus declare invalid sale to be void. Nothing new in this judgement..since without any challenge in sale deed it would definitely be treated as title deed for ever.

Transfer Deed is to be registered with Registar of properties or sub-registrar. Ownership is transferred through transfer deed or sale agreement.
