I fully agree that sale deed can not be proof of title. It is only transaction between two parties. Similar situation is with me that my grand father and my father were tenant and in between consolidation
Agreement to sale is just an agreement to mention the terms and condition of sale and it is never a proof of sale & whereas sale deed is a document that shows proof of transaction...
But how could a person made such sale deed as fake owner? As registration is done in front of a magistrate then why can't such things is not handled there itself.

Or Maine CO ko dakhil kharij na karne ka aavedn diya hai . Meri us jamin pe 3rd generation hai ... Kya wo aadmi mere jamin le sakta hai ??? Ya Mera hi rahega ??
No without partition 3rd person dont have any right to get possession.. Aplly under order 39 rule 1&2 for injuntion order to stop them to get possession
Eetna sub legal clearance hone k bavjud bhi ye Waqf_board wale kaunsi basis pe Parliament, temples, hotels, houses etc pe dava....claim kur rahey hai????
Cheque bounce hoga toh cheque bounce ka case karo,fraud ka case kr skte ho, civil me money suit kar sakte ho and cancellation of sale deed k liye b civil suit kr sakte ho.

The truth/ logic behind this is.. Registrar is not having any obligation to minutely scrutinize the title prior to registration and he is only concerned about state revenue (stamp)... Court can thus declare invalid sale to be void. Nothing new in this judgement..since without any challenge in sale deed it would definitely be treated as title deed for ever.
