What Happens When You Fail A Drug Test?
In 2017, there were more failed workplace drug tests than ever before. This alarming trend appears to be continuing. Some of the contributing factors include access to cheap illegal drugs, the legalization of marijuana in some states, and movements that some say enable drug users more opportunity to ingest illicit substances.
While we find that employers have many questions, the one we are asked the most is: "What happens when someone fails a workplace drug screening or drug test?"
First, let's consider the case of a job applicant who fails a pre-employment drug screening. The first thing to understand is that a company should not conduct a drug test until there is an offer of employment. Employers should make a job offer conditional on passing a drug test. In this case, if the applicant fails a drug test, the job offer is immediately withdrawn, and the applicant no longer has an opportunity to work for the company.
Next, let's look at the case of an existing employee who is selected to take a drug test. If the employee fails the drug test, in other words, tests positive for drug use, the company managers along with Human Resources should refer to the drug-free workplace policy. The policy is where they will find the process and procedures for dealing with the situation.
If it is the case that there is no drug-free workplace policy, then the company needs to put one in place immediately. Moreover, the company must communicate all aspects of the policy to all employees.
If there is no policy in place, then the employee who tested positive for drugs will get a second chance.
If you and your company have a drug free workplace policy, when an employee tests positive for drug use, you should follow the outlined protocols.
In many cases, the protocols will call for immediate termination of the employee. Sometimes, though, a second chance might be offered, based on a specific set of conditions. When an employee is given another chance, it is commonly referred to as a Second Chance Agreement.
Further, the employer and employee should discuss any performance issues that might be related to drug use while at work.
Typically in a second chance agreement, employees get some sort of assistance in dealing with a substance abuse issue. This help comes in the form of an Employee Assistance Program or EAP, where the employee can get confidential help.
EAPs are often included in company health insurance programs but are often not as well known by the employees or the employer.
Smaller companies may not have an EAP. These companies should, at a minimum, provide employees a resource page of local resources, and websites that offer assistance and treatment for a substance abuse problem.
Now, State laws vary; and some state laws require that you cannot terminate someone on the first instance of a positive drug test.
For that reason alone, it's essential to work with an expert to make sure you do not write a policy that violates state laws which would open up the employer up to a lawsuit.
DOT regulated companies like trucking companies, public transportation, etc. are required to have a drug and alcohol testing program. If an employee tests positive for drug use, that person should be removed from any safety-sensitive position.
What happens from the employee's perspective when they fail a drug test?
The employee, in most cases, will know about the positive drug test results before the employer finds out. The Medical Review Officer will get the lab results and will call the employee asking if there is a medical explanation or prescription they would like to reveal.
Every employee that tests positive has an option to contest the result. When they elect to contest the results, they communicate with the MRO and reveal that they think the test is wrong.
The next step is for the original collected sample to be retested at another drug screening facility. In our experience, an overwhelming majority of about 98% get the same result back.
Sometimes, an individual does not communicate with the MRO, if there is a legitimate medical explanation, just as though they learned the results from the MRO, the MRO will need to review the newly acquired information with the pharmacy and other medical professionals.
The employer and the employee will need to follow the company's policy based on the findings of the MRO.

I get your point. I smoked weed for 15 years before I took my current job. I'd love to light up a joint right now. I never went to work high.
OTOH I also have seen how people act. So many people just can't grasp the idea of LEAVING IT THE FUCK AT HOME! I work in a steel mill. We go up 100 feet in man lifts. Our crane operators transport 100 ton heats of 3000* steel. The loader operators have to maneuver huge pieces of mobile equipment.
If they didn't test I wouldn't work there.

If I was an employer, I would use only blood testing as it only detects what has been in your blood for about 12 hours. Metabolites (which can last weeks) should not be tested for.
@@Jemalacane0 cost to much for the employer. They would rather test for metabolites with a two dollar strip and disqualify you based on that then actually try to see if your impaired. It makes it easier to pend something on someone and deny them worker's compensation

Why do these people think that if you use a drug once you automatically have a “substance abuse problem”? Just because someone smokes weed every other weekend or something does not mean they have a problem with substance abuse. Plus even if they did, weed is relatively harmless and as long as you are totally sober at work there should be no reason to drug test you. Especially not when these tests can see drug use from literally months ago! Go forbid you smoke a bowl 3 months ago, but if you show up to work hungover every day after getting completely wasted every night hey it’s no problem!

@@davidperry4013 Totally agree and they're cheaper to produce. The problem with urine tests, aside from being more expensive to make. Sometimes, people take forever to pee. The mouth swab test takes 5 minutes and is much easier for getting pure saliva. Which means fewer cheaters and more working people.

we’re living in a country where a majority of our states are legalizing marijuana… So when it comes to testing for weed, I think companies need to grow up… I mean this is getting ridiculous… When it comes to real drugs, like methamphetamine or crack… Those substances appear to pass through the system so fast that drug testing seems pointless for those things… Half the time when people are really actually drug addicts you can usually tell visually
This is sad honestly. Someone who’s probably going through struggles of addiction being denied the ability to make a living because they failed a pre-employment drug test even tho they are more than capable of doing the job. This is not how you stop people who struggle with addiction from doing drug. However, this is how you stop them from putting food on the table.

My job gives you a chance to get it right. A co-worker once failed a drug test at my job and he told them that he was depressed and going through a lot. So they sent him to some kind of class or help and he eventually passed the second drug test. They should not be testing for marijuana no way.

What about false positives? I've read that occurs up to 10% of the time. Should somebody's life be destroyed because they ate a sesame or poppy seed bagel? The war on drugs is destroying many more lives that it's saving.
I have been in the industry for 25 years, I have never came across a false positive when the testing was done correctly at a certified laboratory with a certified medical review officer (MRO)

That is a combination strip search and voiding into a cup while the urine specimen collector stares directly at the test subject's groin. Isn't that the only sure way to confirm proper collection?.. During training, are urine specimen collector students subjected to this procedure? Do they realize how completely demeaning this is?.. I find the drug war to be far more offensive than drug use, and I support the legalization of recreational use (not abuse) of cannabis. One of the many problems with this drug war is that there is no distinction made between drug use and drug abuse.

If the pre employment test you failed is dot regulated such as a urine test, then yes. There is a government database called ClearingHouse that they are obligated to report to that everyone can see. If you pass that test, but fail an unregulated test such as a hair follicle test not formally recognized by dot, the only thing they can do is report you to a private company called DAC which is a website trucking companies to trash their employees

If it is a DOT test, it can follow you to next DOT company. For non-DOT testing, the test does not follow you.
Our neighboring countries have full legalization and our citizens use as well so it’s no surprise people fail. But you fail to see that a good economy and more people working cannot support the statement that drug users are a risk or a totally bad thing.
What happens when the employee is so valuable/ productive that the employer doesn't even care? question? I failed a drug test and was fired from work. I went to a DOT drug and alcohol class to revoke my twic card. years later I failed a hair drug test, but never bother to go back or fix it at that time. would my card be suspended by failing the test the second time and is there a level of suspension on this twic card? I am trying to go back to the oil field and hoping that I can still work in the oil field even if I was marked 2 times. I think it stays in the system for department of transportation jobs up to five years, or passing a test to have it removed.
I found a nice paying job I got all documents and all that's left was a medical drug test for job, I went and did that.. after couple of days they call my father and tell him that I was positive on morphine and opiates. Let me be clear I don't smoke weed or do any kind of drugs. I use creatine and I love sport drugs don't interest me. But still that stupid drug test shows that I am positive on that shit. There is no way I can prove them wrong. And that company that wanted me to do medical drug check doesn't want to let me to try again my drug test so now I'm unemployed because of that. I'm 20 years old and I live with parents who are angry and confused because of that situation. They think that I'm lying them. I can't change my situation and I feel so depressed.

DISA needs oversight and they need to change their name. They are not a Federal agency, they are a private company. A positive hair test for a prescription drug from, God knows how long ago. Should not end someone's career. Hair tests are inexact at best and inaccurate at best. This is a private company, there is no appeal or oversight. If they say you are guilty.. You are!

I ate a bagel 2 days before my test. It had poppy seeds on it. I should hear from the human resources department tomorrow. It was a pre-employment test. Maybe I will be Ok, but imagine your life being destroyed by eating a bagel?
Of course, many people will assume I am drug addicted and making excuses. It is absolutely possible to fail the test just by eating a bagel/muffin with poppy seeds. Hopefully, the time frame of 2 days will save me.
Many of these tests are false positives, 10 % or higher, Do they retest? Who tests? Chain of custody for the test?
