    Simiar situation, however much darker, happened in Poland in 2010.
    In 2010 Lech Kaczyński, who was the President of Poland, was killed in a plane crash. The vacancy was filled by the Marshall of Sejm, and that position was held by Bronisław Komorowski. That meant, he was the acting President of Poland. It so happened, that Komorowski won the presidential election in the second round of voting on 4th of July, defeating Jarosław Kaczyński, Lech's twin brother. Unfortunately, you cannot be both President of Poland and the Marshall of Sejm, so he had to step down from his current office. He resigned on 8th of July, and because the first two positions in the hierarchy were vacated, the role of acting president was given to the Marshall of Senate. Bogdan Borusewicz held the role at the time, so he became the acting president. Few hours later at the same day, Grzegorz Schetyna was elected as Marshall of Sejm, taking over the role of the acting president from Borusewicz, and he held it until 6th of August, when Komorowski was sworn in, ending the reign of the three Acting Presidents of Poland.

      Reminds of that time the Senator from Missouri lost re-election to a dead guy.
      His opponent was the term-limited governor of Missouri who died in a plane crash 2 weeks before election. Given the proximity to the election date, Missouri law barred his name from being removed from the ballot, even though he died.
      In the end, the late governor managed to beat the incumbent.

      Taylor was technically President since the Constitution doesn't specify one has to take the Oath of Office before they become President. Logically, Taylor would have become President at 12:00am of Inauguration Day. The 20th amendment now clarifies this.

  • @forgottenfamily
    @forgottenfamily 4 ปีที่แล้ว +70

    First, it sounds like due to religious convictions (1:27), a fundamental human right and a right enshrined in US Law (The Bill of Rights), Mr. Taylor was ' _unable_ ' to accept the Presidential duties right away.
    3:42
    Second, it sounds like the conclusion is that being sworn in isn't necessary to serve. (4:45).
    Lastly, it seems like Mr. Atchison was probably at least close enough to being in a position that could be described as President for a day in that he was recognized by the de facto powers of the land at the time as being in charge if anything went down, even if the de jure reality wasn't so. While the oath is required of the office it is not required to attain the office. The oath follows the attainment of the Office of President. For that reason Lyndon Johnson was addressed as "Mr President" after President Kennedy was pronounced dead on November 22, 1963. He didn't take the oath until he was on Air Force One, but that could have been delayed until after his arrival at Washington without ant doubt as to who was the actual, lawful President.

    Interesting video, thanks. I would just note that Article 2(1) at 3:24 of the video only seems relevant if we have already concluded (as indeed we might do, for separate reasons, for example as concluded at 4:53 of the video) that Taylor was indeed, from noon on 4th March 1849 despite non-inauguration, already President and not merely President-Elect (because Article 2(1) seemingly does not address Presidents-Elect).

      not necessarily, the key here is he was only unable to execute the duties up until he was sworn in, which was barely 24 hours, so as long as no duty was assigned to him in that time or any duty assigned had a longer more relaxed deadline to be fulfilled, he was fine.

  • @warlockpaladin2261
    @warlockpaladin2261 2 ปีที่แล้ว

    Technically, he was President-elect already, and with the previous President having vacated automatically at the end of his term... yep, there was a vacancy of the office for that one day. However, since the inauguration of a Vice President is a distinct event that merely occurs on the same day (normally), there might be a good argument that he would also assume the duties of the "regular" President for that day until the President-elect is properly inaugurated. This would no more affect the list of office holders or its sequence than the temporary assumptions of duties/powers do when a President undergoes surgery (for which there are plenty of examples of over the last half-century).
