If you ever go on a cruise out of SF Bay, the Coast Guard gives the ship an escort (2 Coast Guard boats), with gunners on the bow. Sometimes they give us a show and start hot dogging their boats showing us off under the Golden Gate Bridge. I have a lot of respect for our military. Makes me want to book a cruise just to see the Coast Guard escorts. You should see them get after the wind surfers who look like they want to get close to the ship.

To let everyone know who has not gone through this. This is an inspection not a search. The coast guard does not need any warrant to conduct an inspection of required safety gear. It's called federal law. If your curious Google it.

How is this constitutional? Stopping Vessels for life jackets and other BS because 14 U.S.C. § 89(a) trumps the Constitution? This needs to be challenged in the supreme court. Two major issues with this:
      1. Military being used against United states citizens is almost a form of marshall law. Even though they Claim DHS.
      2. There is no Reasonable articulable suspicion that they are in violation of any law.
3.when it comes to search and rescue local LE, fire, commercial salvage, and other nearby mariners beat USCG to saves because they have to wait for multiple persmissions from every level of command to launch. They cant even put out a vessel fire unless it almost kills somebody.
      4. USCG should just break ice because thats all there efficienct at.
      5. I joined the army because the CG is a joke.

    • @SHADOW848DUCATI
      @SHADOW848DUCATI 5 หลายเดือนก่อน

@@RMwalkwithJesus Yes its an inspection of required equipment as per 46 CFR 25 for recreational vessels and part 28 for commercial fishing vessels. You don't have a right to own a boat. To many idiots were dying out at sea because they thought they could just launch a vessel they just bought with zero safety gear on board. Yes we the Coast Guard inspect that gear to ensure that lets say if you forget to put your drain plug in or want to go fishing during a tropical storm that you have the required gear to possibly save your life until help arrives. Speaking of which we are a branch with 44k active duty and a budget that is probably as big as the Army's ammo budget yet we actually perform more missions on a daily basis.

Jeremy, great video and great channel. If any boater is unsure of what they need on their vessel while underway, the Coast Guard actually has a great phone app that will tell you that and more. The app also has a float plan you can fill our before getting underway to send to someone you trust as an added safety feature. Also, the Coast Guard Auxiliary does free vessel safety checks. The will go thru your vessel just like the active duty does and let you know whether or not you have everything you need. And the great thing is they do not report anything to law enforcement.
Fair Winds and Following Seas and keep up the great work.

I’m with y’all on the not drinking part. And if I do have guests, I make sure the boat stays clean (no empties flying around).
One thing that’s important for all boaters to learn is when you’re getting pulled over...is to simply stop the boat and let them come to you (pending the spot is generally safe for a non-moving boat but signal by hand acknowledging contact if you need to move before stopping).

They probably signed up thinking it was going to be like something out of "Bay Watch": hot girls, beautiful beaches, awesome weather, laid back atmosphere, cool cars and gear.....only to find out that they're having to deal with fat drunks at Bob's Biker Bar, college kids OD'ing on drugs, and things like that.

They won't say it when they are inspecting your boat for all the required safety items but they are also looking for drugs and weapons being smuggled and also they are looking for humans who are being smuggled into the U.S.
I have been searched by the Mexican border guards going into Mexico and they flat out told me to empty all the firewood I had in the back of my truck. We were just on a surfing/camping trip. They said they thought I had guns under the firewood. I told them to unload it themselves and they peeked under a few pieces and let me go on through.

Seeing the black boots being worn by the USCG boarding party reminded me of this story. In 1977, as a brand new USCG Ensign, I was assigned to the USCG Eighth District, Intelligence and Law Enforcement Branch, New Orleans, LA as the Assistant Branch Chief AKA: Shitty Little Jobs Officer. My first project was to write a response to a Congressional Query about a USCG boarding somewhere in the Eighth District ( St Marks River in the panhandle of Florida to Brownsville, TX). A person wrote a letter to his/her Congressman complaining about “black scuff marks” left on the deck of his boat by the black hard rubber soles of the work shoes of the USCG boarding party. So, I wrote what I thought was a professional response telling the complaining boat owner “Sorry about the scuff marks, but the USCG has a maritime law enforcement job to do and our boarding crew was doing their job”. Did I mention that prior to joining the USCG, I’d been a police officer for three years. I had to tone down the “Admiral’s response”. I completed my three (3) year commitment after getting my commission and went back to being a police officer/deputy sheriff. Eventually, I was hired by the US Customs Service as a US Customs Patrol Officer and US Customs Special Agent. My time in the USCG was a valuable learning experience.

For all of of you people talking about this being "unconstitutional" know that when the revenue cutter service was created in 1790, it was America's only maritime law enforcement not to mention the only seagoing military branch. We had a strong need to enforce tariffs and defend our ports. The laws the coast guard have today are still the same as they were then and the coast guard is the only branch that has total jurisdiction of us waters and can board any US vessel anywhere. A quick look into the history of our country has shown many times the coast guard has used their law enforcement capability to save lives of many and defend America from countless threats. 14 USC 86 may have been written in the 40s but it comes from policy that was written pre constitution

Unconstitutional law is not law. Pigs could have legally been shot. A case like this already happened and the mans charges were dismissed by a federal jury, setting federal precedent, cases below.
"A federal jury has found a man accused of firing at a U.S. Coast Guard crew not guilty of both weapons charges handed down in an indictment by a grand jury in September.
Daniel Michael Szabo, 41, was facing a possible life prison sentence for charges of trying to kill a Coast Guard officer during a boarding and using a firearm while committing a violent crime.
But jurors on April 6 only found Szabo guilty of failing to stop his vessel when ordered to do so by the Coast Guard."
“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.
“These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence.” Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903."

Within 15 miles you can get boarded by the city police of Marine City, Marysville, and Port Huron, the U.S. Border Patrol and the St.Clair County Sheriff Marine division....Oh! I can't forget to mention the DNR stopping to inspect you in their "gun boat" too. However if you want to try and enjoy your day on the water, just travel on the Canadian side of the river. They just occasionally have the OPP patrolling the water. Nothing is more fun than taking guests out to a restaurant on the water where you have reservations just to be stopped and inspected for 45 minutes to an hour (and miss your reservation) and then be stopped again after you leave the restaurant and spend another hour having another inspection. If you are on a Power Watercraft you can definitely expect to be stopped as those poor souls seem to be a magnet for the authorities. It is out of hand.

If you get your boat safety checked every season by the coast guard, it will stop a lot of these stops looking for safety equipment checks. They will give you a sticker (at least in Jersey they do) and at the very least it will give them a reason NOT to stop / board your boat to do a safety check and move onto those without the stickers... Now a check for what you caught or for proper licenses not so much so they may still stop you for that. We do it every year at our marina in Jersey at the beginning of boating season and get the sticker just one less hassle to deal with.

The USCG has enough problems without boaters trying to persuade them otherwise, I actually am always thrilled to have them on board, OK so it bothers the people on the boat for 15 mins guess what who cares, their doing their jobs to help us safe, just sit back, thank them for their service and all they do and then go about your day, simple and easy!

Great video. USCG boarding teams have a tough job, just be respectful and it will go well. However, the USCG boarding team needs to zip up those PFDs for them to be effective. I know it is hot and uncomfortable but if they fall in, especially with all the other gear, having the PPE slip off makes a bad situation worse. Semper Paratus!

Too many folks would buy a $4 rowboat and take it out to the ocean with expired safety equipment only to find themselves in a whole heap of trouble later on. The CG would then have to go save them, putting their lives at risk when a simple safety inspection or common sense could have prevented it.

To all the commenters that keep posting the lines about unreasonable search and forth amendment.
    This is not a search.
They are not going around the boat searching for anything.
    This is a safety inspection.
They are asking if he has all the required gear to be on the water.
All any boater is required to do is show the CG all the gear they say is asked for as required by maritime laws.
    Thats it.
    Just like a car inspection.
Also, if you were inspected that year/season already, just show them the receipt and they dont inspect again.
It turns into a search if they have probable cause of a crime committed, not because they cant see all the life vests on board.
As for the firearm, they asked. If you are legally allowed to carry in the waters off the state you are floating in, then there is no problem with telling them.
If they dont ask, you are not required to tell them anything if the state laws says you do not have to during a boat safety inspection.
    Check your laws.
And before folks start quoting federal statutes ... They apply in federal waters. As a boater in state waters you are bound by state laws and they cannot conflict with federal laws. If they conflict, state laws win so long as you reside the state.
Venture out into federal waters then obey those rules.
I'm no lawer, just read a lot of law. Check these yourself, or just go ask them at the CG station to provide the statues. Being nice and polite goes a long way.

They do not need a search warrant to board any boat, jet-ski, canoe, kayak or vessel. They do not even have to ask permission to board you. You have no 4th Amendment rights on the water. They can board and check your equipment anywhere in the world. They can come and check your equipment while tied up in a slip at your marina. If the local police have a marine division, same for them. You need to understand the laws of boating before you leave the dock, better before you even get to the dock.

So they are cops similar to other federal law enforcement agencies, but have no jurisdiction for state or local ordinances.
