Ang alam ko lng basta pre selling matagal tlga maturn over pero maaavail sya sa murang halaga unlike sa mga Rfo unit may move in fee pa kadalasan bukod sa umaabot na halos 20-30k ang basic salary para sure na makakaavail si client

    Fist time to watch your blog sir. What about wala man lang makuhang sagot sa developer kung Kelan maitatayo ang bahay.nagavail po aq nung 2018 pero hangang ngayon wala pa improvement sa location ng subdivision. Wala man lang Kami makuhang balita para man lang mabawasan Yun stress na nararamdaman naming mga nagavail.

    PROBLEMS COMMON TO SUBDIVISION AND CONDOMINIUM HOMEOWNERS AND THEIR DEVELOPERS BY ATTY. KARL FREDERICK S. BORJA
    1. Delay in Turnover
    One of the most common woes that subdivision or condominium unit buyers have is the delay in the turnover of their property. Most if not all developers spend millions in their pre-selling activities, luring buyers to make that down payment. When reality kicks in, however, these buyers say goodbye to their hard-earned money and wait for years, sometimes decades before realizing the fruits of their so-called investment.
    Sadly, very few know their rights with regard to any delay in the turnover of their newly-purchased property. Some turn to their sales agents and brokers for help. Unfortunately, these people are only good to you when they are about to make a sale. After which, buyers are left to their devices.
    The law protects subdivision and condominium buyers from a developer’s delay in turnover. A buyer needs to consult the documents surrounding the sale of the property and other materials such as brochures and advertisements. It should appear in those documents when the property should be properly turned over, as this should also be a subject of inquiry before a buyer purchases a property.
    A buyer has two (2) options. One is to write the developer a letter seeking an official response as to the time of the project’s completion. Likewise, the law also says that after such notice to developer, the buyer may desist from further paying amortization dues. Another option is to directly file a case with the Housing and Land Use Regulatory Board against the developer to completely refund all payments made.
    2. Delivery of Title
    A property owner cannot be fully considered as such until he has occupied the property and is in possession of a Transfer Certificate of Title (TCT) or Certificate of Condominium Title (CCT). Sometimes, because of excitement and overwhelming emotions, buyers forget that aside from the turn over, the developer should also hand over the title to the property.
    Developers oftentimes come up with endless creative reasons to delay the delivery of the title. The most common kept reason is that the mother title of the entire property is mortgaged to a bank or some lending institution. In such a case, a buyer need not worry because the law protects buyers of property that has been previously mortgaged by the developer.
    Furthermore, buyers must be aware that the title to one’s property should be properly delivered once full payment has been made. A developer cannot charge the buyer with any other fees, except the cost for transferring the title to the buyer’s name.
    3. Incomplete Development
    Now that the buyer has the keys to the property, it is not to be assumed that the unit is entirely ready to be moved into. One must first assess whether the entire place is complete and safe for habitation.
    It must be emphasized that just because the property has been turned over to the buyer, it does not automatically mean that the development is “complete”. The completeness of a unit depends on its adherence to the development plan and the advertisements or representations that came with it.
    For instance, the unit may have a missing faucet or a missing bathroom. When a unit does not faithfully conform with the approved plans and/or the advertisement or representations made by the developer’s sales agents, a buyer may demand either specific performance or even a complete refund of all payments made plus damages.
    4. Poor Workmanship
    Housing property, like any consumer goods, is subject to reasonable warranties by the developer. Properties such as a condominium unit or a house and lot are one of those goods that are given reasonable warranties wherein a buyer is protected by law from hidden defects and poor workmanship.
    Common complaints of poor workmanship includes but is not limited to cracked walls, roof leaks, uneven surfaces, bad paint job, and the like. Even if the development is according to plan, a buyer is still entitled to receive a house or condominium unit that is safe, comfortable and livable.
    If a condominium unit or house and lot suffer from poor workmanship, a buyer may sue for damages and/or compel the developer to rectify the substandard work. Property buyers should not be left at the mercy of large developers. As a matter of fact, there are several provisions in law that specifically protect the rights of property buyers against shabby and poor workmanship.
    5. Real Property Tax
    Also a common problem that hound property buyers is: who will shoulder real property tax (RPT)? More often than not, excited owners will just pay the RPT anyway even if the law does not require them to. The rule of thumb is, whoever has control of the property should be assessed RPT.
    In fact, the law is very clear that the developer shall shoulder the real property tax levied on the property until possession is turned over to the buyer. Unless the buyer has been previously occupying the property, the law specifically holds the developer liable for the payment of RPT.
    If a buyer is being assessed by the developer for the payment of RPT, a complaint should be filed against the developer.
    6. Concerns with Lease and Air BnB
    Property, just like any other investment, is always seen by the owner as a vehicle for extra income. In the advent of Air Bnb, property owners can now directly lease out their properties for long or short periods of time. The common question is, may property owners be restricted from listing their properties in Air Bnb?
    As a general rule, there is no limit as to how an owner may exercise control over his/her property. Such control includes the sale, assignment, lease, and so on. In the absence of any restriction, listing your property in Air Bnb is perfectly legal.
    However, there are exceptions to the general rule. A common exception is a restriction in the master deed prohibiting short-term leases on the property. Deed restrictions are involuntary covenants signed by the buyer the moment the property is bought. It is termed “involuntary” because the buyer’s consent is deemed automatically given at the time of purchase of the property. Most subdivisions have restrictions in the deed, stating that an owner of a property located within the subdivision automatically becomes a member of the homeowners’ association.
    Another exception is when a homeowners association or a condominium corporation adopts in its by-laws certain restrictions that would prohibit short-term leases. Provided that the process by which the by-laws were enacted is valid, these restrictions on one’s property are binding.
    These, however, are not hard and fast rules. There are also some grey areas when it comes to leasing or sharing your property because no level of deed restrictions may prohibit an owner from lending/sharing his unit to a relative or friend. These are strictly non-commercial transactions per se, thus, cannot be restricted by a homeowners’ association or a condominium corporation.

      Nagbabayad kc ako sa banko, Kaya non full pay na ako sa down payment; pumunta na sa office yon anak ko at kinuha lahat ang OR. Waiting pa rin after 1 year kc nga delay yon construction dahil sa pandemic. Yon phase 1 palang ang gawa.Namasyal yon anak ko sa Saffron Hills , hindi pa mga gawa ang units. Hindi ko alam ang sumasakop ng Blk. 23 eh.

      @@cresenciayanga6865 ,kami phase 1din ..Last February 2021 pa aq natapos sa equity q..Tas ngfollowup aq last Feb.15 lang this years,as of report nla January 2022 40%percent palang house construction ng unit namin..E dapat nga process nlang ang inaanty q ngaun sa pagibig hindi ang paggawa pa ng bhay...Kht pandemic tuloy tuloy namn aq ngbayad sa obligasyon q sa knila.Phase1ka po b?Lalo ngaun inaasahn q na sana na may call na maatrasado pa dahil sa di patapos ang bhay...Naupa pa nmn po aq.😢

      @@christianpianar7513 kapapadala lang ng list of requirements sa anak ko kanina hapon.Need to provide yon requirements for Pag ibig loan. Hindi ka nag iisa iho, marami tayong umuupa. Be patient tayo.

    Pa no kami ako 4 years na pong nag babayad hanggang ngayon wla parin ni isang hollowblock na nka lagay Yong ibang unit naka Tayo na pero di ma I turnover..Yong iba nga na MGA kasmahan na min nabayaran na lahat turnover nalang ang kulang wla pring bahay na nkatayo..pano po Yong gusto na po naming I refund kaso ang I abalik Lang eh 50 % maceda law daw gamitin nila Yong iba 35% nmn eh wla nga pong nakatayong bahay... Makatuwiran po ba yon?...

    Hi Sir sna po mapansin nyo po comment ko.. 2019 po kami Nagstart magbyad ng downpyment natapos po kmi ng march 2021 then june po tnawagan kami para magchange unit dahil nagkaproblema daw po sa contractor. Inaccept po namin RFO unit na offer nila Sept po na approve kmi sa bank for turn over na daw po.. pero sbi po nila january pa daw po turn over.. posible po ba ganto katagal process? Anu po pede namin gawin para mapabilis po turn over since nag rerent po kmi at start na dn po kmi ng amortization sa bank. Thank you so much po sa sagot sir

    Sir pano po if na loan take out na since June 30, pero d p maturn over sakn? Need kasi irepair yung unit dahil may sira, wla pang kuryente. Pero ang dahilan ng developer, hnd pa raw nagcoconfirm yung contractor at engr kelan ayusin. Palaging ganun ang dahilan, halos 1 month n. Hnd pre-selling. Matagal ng gawa yung subdivision at marami ng nakatira.

    Hello po sir.. ask lang po, What if po naka take home loan na sa pag ibig at nakuha na ni developer yong loan.. ang sabi ALL IN na.. but sad to say di parin na turn-0ver samin yong unit.. mag start na kami mag pay sa pag-ibig. tapos may babayaran pa daw kami sa developer kasi hindi daw buo ang nakuha nilang loan sa pag-ibig. pero napa claro sa documents na the processing fee and payments sa Registry od Deeds included na sa loan proceeds... Ano po gagawin namin kasi despite of keep asking them na e turn over na.. daming alibies nila.. ginagawa nilang dahil si COVID....

      ang processing fees po is sa Price of property po yan nakainclude, or not included. sa mga hawak namin, included na sa price ung miscellaneous. if not included at for the account ni Buyer dpat po nakaexplain sa inyo

    Question lang po. Kapag po ba nagbayad ng cash payment sa developer, hindi po ba talaga on the spot nakukuha ung notarized deed of absolute sale? Official receipt lang daw po muna tapos to follow pa ung notarized deed of absolute sale kase may iba pang signatories at dadalhin pa sa notary public. Ganon po ba talaga un? Salamat po.

    Marami ng nakatira sa Block na nakuha namin at sa block na higher than us.
    2018 August - nagbayad po kami ng down-payment for pre selling house
    2019 October - Done na with payment
    2020 March - approved and started Bank Finance/payment
    2021 May - no updates for turn over
    Salamat po. Nagdodoble gastos po kasi apartment at monthly po

    Hi po, Nagavail po ako RFO unit ng AMAIA.Fully paid na po ng bank at nagstart na ako ng monthly amortization last February, as per may agent 100% complete na dw po yung unit.30-60 days dw po yung turn over mag 60 days na po by March 31 pero wala pong mabigay na update 4:29 yung agent ko about sa date ng turn over. Normally po anu po yung process after mafully paid ng bank? Anu po yung next step? Once fully paid and signed na yung CTS pwede na po ba mavisit yung actual unit kahit di pa naturnover?

    Hi sir question po kapag ba sa punch listing sino ang mag dedecide ng inspection si developer po ba or si buyer? Ofw po kasi ako pero ang gusto nila mag inspection na through video nalang e ayaw ko po pumayag kasi mahirap ang ganon at gusto ko my friend kami na sumama sa inspection pero sinasabi nila na hindi pwede at automatic na accepted ng unit pag ganon na hnd pa din kami makapag pa inspect.     Sir Roger ask ko lng po, may cts napo kmi pero in the case that sinabi nmin na mag under pagibig loan kmi pero they transferred us to interim financing, lagi sinasabi ni lumina under prima casa land and houses, may problem prin daw lgu, hindi rin po nila lakad ung pagibig application nmin. Nung dadalawin po namin, sabi Di raw pwde silipin ung bahay dahil may problem pa s lgu, ng amort npo kmi, dipo kaya ngbabayad n kmi sa hindi nmin property or may problem kay prima casa land. Until now walang feedback kc eh. Di nmin mapunta han ung area. Slamat po s help.

      sa mga housing projects ay bago iprocess ang loan ay dpat may linya na ng kuryente. though iba ung pagpapakabit ng kuntador nito. if ang tinutukoy nyo ay sa project na inavail ninyo. icoordinate nyo sa inyong agent at sa developer.

    Sir question po, after mag sign ng NOA from pagibig, 3 months ago, will that guarantee na waiting nlng ako for take out? Ksi wala po ako nreceive na update from the developer, tpos pag chinecheck sa pagibig wala din po ngsshow na loan. Thanks in advance po.

      Puntahan nyo na po mismo sa office. Once loan take out na at nagbabayad na kyo ng amortization, for turnover na po dapat yan.
