  • Press conference by Francesca Albanese, Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967.
    The Chair of the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and in Israel, Navi Pillay, said that there are “clear indications that international crimes have been committed” in the current conflict.
    Briefing journalists in New York today (25 Oct), Pillay added, “So accordingly in line with our mandate, we began collecting evidence of war crimes committed by Hamas and other Palestinian armed groups and by Israeli security forces, and we issued a call for submissions later last week.”
    Pillay also said, “I assure you that we intend to continue pursuing the fulfilment of our mandate, including in relation to making recommendations, in particular on accountability measures, with a view to avoiding and ending impunity and ensuring legal accountability, including individual criminal and command responsibility.”
    The Commission's Chair noted, “International law has clear obligations on every state whether they exercising self defense, or hostile warfare to protect civilians, and I fear that this is not happening. Civilians are being targeted and civilian objects, structures are being damaged, irreparably, so it's a huge concern and we are going to be looking into this, expanding on this.”
    Another member of the Commission, Chris Sidoti, noted that the law of armed conflict applies in this case.
    Sidoti added, “That does mean that the State of Israel has the obligation to defend its citizens. But it means that it must be done in accordance with international law, and the principles of necessity, reasonableness, proportionality, discrimination, precaution and so forth. And it's those principles and the observance of those principles that becomes the critical question. And that's the question that we are going to have to examine in the investigation that, as our chair has indicated, we've already announced.”
    The expert concluded, “Is it possible to conduct the kind of military operation that Israel is conducting in Gaza and still comply with international law? That is a live question, we don't have conclusions, we need to investigate. But that is really the fundamental question that confronts the international system at the moment. Israel has an obligation to defend its citizens, no doubt about that. But is it possible to do that in the way in which it is being done and still comply with international law? That's the question.”

      Me too. Mr Guerriez has spoken the truth. The Israeli leadership is reeling from shock, grief, anger, disbelief, and shame, for not protecting its citizens. This carnage will achieve nothing but further shame for Israel. How ever will they live with this in the world? Are the leaders of Israel putting their own mad hubris above the safety of their hostages?

      Hamas invaded Israel and murdered 1400 innocent civilians. They also beheaded about 40 babies, raped women, and took more than 200 hostages mostly children and the elderly into Gaza. Please note that Israel left Gaza in 2005. The people in Gaza were free to do whatever they wanted. Egypt has a border with Gaza, yet Egypt had a blockade on Gaza even before Israel occupied Gaza.

    Thank you Francesca for your hard work, deep analysis and reporting the truth to the world exactly what has already been said out loud and to the UN for decades by the Palestinian people. Their cries for help have fallen on international deaf ears. Many world leaders have turned a blind eye, some have even supported violence towards them. And then there are the cowards who sit on the fence and wish to stay “neutral”. The facts you stated are not anything many of us citizens of the world didn’t already know but they have needed to be said aloud since we are seeing the full vengeance and continued murder of Palestinians for the last 18 days now. As a Doctor I am horrified that the hospitals have now run out of energy and this can only described as mass murder. I want to ask the UN, what happens now? What actions will be taken if Israel do not stop, because it does not seem like they are stopping or influenced by the UN? What actions will the UN take to make them stop? And a very important question I have from the UK right now is, how and when will world leaders and governments be trialled in criminal courts for supporting the genocide of the Palestinian people by providing, essentially, weapons of mass destruction over them? There are one too many leaders who have stood up and said that "Israel has a right to defend itself". The citizens of the world - 7 billion of us - can clearly see that this is not defence at all. How will these war-mongers be treated alongside Israel for what can only be described as crimes against humanity for 75 years.

      Which is why the UN must sanction Israel, ban their passports and deny them entry to any country, seize all israeli assets, after all that sort of thing has been precedented and used against Russia by western war criminals who did the coup in Ukraine and then supported the systematic genocide in Eastern Ukraine...

      Perhaps if decent people in Israel arrested their war criminals and stopped the genocide of Palestinians ww3 could be avoided?

    I really hope these words have value in our world. I give them huge value. It hurts mt heart, living 68 years with episodes of this at random. Im so sad for Palestinian people, especially last 18 years. I imagine how they feel and really hope they are given life, during my life.

    If you are the occupier/enslaver/prison warden (Israel), what right do you have to "SELF-DEFENSE" when your own prisoners/slaves (Palestinians) - forcibly being detained in a concentration camp/prison (Gaza), rebel? ... NONE... As occupier of stolen lands belonging to the killed parents of those you now imprison in Gaza, you have no right of self-defense! ... NONE... Furthermore, Israel's collective punishment of the entire prison population (Palestinians) patently violates moral and international law.

      Furthermore, self defense is something you do when you are attacked, during an attack, towards the attacker. If someone mugs you on the street, you don’t follow them to their home, and then burn their house, children and wife. Crimes against humanity

      Israel has the Right to self-defense and is defending itself, a country that is at war with Hamas and still World leaders visiting Israel safely without any risk and but in Palestine , it's even risky for WHO and the Red Crescent to enter Gaza to provide humanitarian aid ,as in Gaza is there is no where safe due to Israeli air strikes. youtube will remove my comment

      Gaza is not a concentration camp/prison. There was serious oppression but there were options. You should not listen to the one-sided propaganda, from either side that is.
      The right to resist occupation or however the exact wording was does not mean the right to terrorize. Hamas has genuinely gone too far, so have the Israeli.
      You are only considering one side of the story. Palestinians have Arab roots. Arabs have conducted many pogroms against the Jews too. And there have been wars against Israel. Both sides have genuine grievances for which both sides should be considerative towards each other.
      You should relisting the following part:

    This was a heartbreaking but well sad speech. What’s really eye-opening is the realization of how we’re always kept in the dark about things that are going on in the world and also makes you seriously wonder about history and what really happened. But as I said we’re always kept in the dark until something horrible happens and someone else brings it to light. Heartbreaking all around. One would hope that after all this time and almost at the year 2024 that the world would be more civilized.
