Rice V Connolly 1966 means he has no legal obligation to talk to the Police, in fact he was free to walk away. And, it is lawful to film anything and anyone from a public place, which negates Section 50 as the law provides no expectation of privacy in public. Therefore, the Police Office acted contrary to his right to remain silence, which is a Section 26 Offence with up to 14 years in prison. The Police Officer went from criminal catcher to being a criminal himself.
Yup. Not many people seem aware of section 26 of the 105 criminal justice and court act....that would make them think long and hard. The threat of civil action does not dissuade the police.
