Legal Mindset just dumped the Nijisanji contract. The same contract both Sayu and Dokibird had to sign when they joined. It's as exploitative as one would think, if not worse. For even the most minor breach of contract, Anycolor could go back and seize a YEAR'S worth of your pay, for example.

The fact that Offkai claimed that this decision was made 2 weeks ago but only released the information recently, suggests behind-the-scenes negotiation that supports this theory. JP higher-ups might have had to intervene and go "Hold up, absolutely not Ethyria right now" but the communications took forever because Nijisanji.

It would have been better if Nux had watched False’s video as he actually talked to the people behind OffKai who explained that they’re a volunteer staff which was small at the time and that they couldn’t announce anything until the negotiations with Niji about terminating the contract were complete They knew that they couldn’t remove Niji from the guest list before finishing negotiations without risking legal issues, and that they would have to refund tickets which they did not have enough staff to handle at the time. So they waited until the negations were complete and they had enough staff to handle all the refunds If they had pulled Niji from the guest list before making an official announcement they would’ve gotten backlash from Niji fans for siding with Doki, or worse legal issues from Niji for damaging their brand, if they made an announcement without having enough staff they would’ve gotten backlash for not being able to handle the number of refunds. No matter when they made the announcement OffKai was going to get some amount of backlash putting them in a no win situation. So they opted for the choice that presented the least amount of problems and backlash

This said, I think he was booked for some regardless and then Funimation people pressured them to cancel his booking… I may be misremembering though… My understanding of the court case is that Vic’s team were unable to provide enough conclusive evidence to convince the judge of the claims he was making about them in regards to tortious interference and so on… This doesn’t necessarily mean they were in the right and he was in the wrong or vice versa… Some were critical of the lawyer, but whether it was their fault or not, I’m not sure…

Not passing judgement on the convention's quality or anything, but I've heard too many stories about bad conventions turning into PR nightmares after having to last minute cancel a guest for one reason or another. This move isn't out of the realm of possibility for any somewhat internet savvy convention staff to pull Is it incredibly professional? No. Does it seem like something weird happened here? Very much so. Will we ever know what exactly happened? Probably never.

I don't think people should be harassed, but I also have no sympathy for anyone who chooses to remain associated with Niji EN. Whether they were one of the bullies or stood idly by and watched it happen, they're part of the problem. Knowing niji the contract termination and negotiations with offkai probably took nearly 2 weeks to conclude. Or offkai just gave up trying to get them back after falses tweet blew up.
I think the safety concern are more of a cherry on top of the cake. They didn't want them mainly because of the fact they are a liability but it also makes the convention safer as a result. Also I think Niji's silence is mostly them recruiting new CMs and a new marketing team x))
nux and many others are right to give sympathy to the livers. sure, its unfair to them that they cant make it, but at the end of the day - theyre not going just on their own to have fun and enjoy a convention, theyre going as representatives of nijisanji. theyre basically going there to work for all intents and purposes, whether niji covers travel/lodging expenses and actually pays them or not.
TL;DR- A simple mistake and a bad judge caused Vic's lawsuit against the people who called him a r@pist to not be considered. A quick catch up for people unfamiliar with Vic Migniona's situation. (This is not a timeline, while I have the events as close as I can remember them, it's definitely going to be out of order.) A literal who posted that he touched her inappropriately while hugging. (This will be returned to.) Seeing that the accusations were gaining traction, fellow VAs and people who Vic viewed as some of his best friends Monica Rial and Jamie Marchie also give vague, nebulous accusations that can't be confirmed because there is zero detail. The literal who is informed that the person who allegedly groped her was in fact not Vic Migniona, but it's still good that she accused him because "fuck that guy." Monica finally describes the alleged situation where Vic invited her to his room to view his Star Trek fan project he had just wrapped. She names the con, hotel, floor, and room; saying he pinned her to the balcony door and did the bad things TH-cam won't let me say. The hotel owner comes out saying the floor she claimed didn't exist, nor did the rooms have balconies. He provided a floor plan, backing what he says. Rial changes her story, a common tactic of people caught in a lie. Monica, Marchie, and some others are alleged to contact Vic's upcoming cons he is to be appearing (one Con owner provides a transcript of the call, in which they claim criminal charges definitely will be filed against Vic before the con date. These charges were never filed. Vic files a lawsuit for defamation and tortious interference of a contract (a third party contacting parties involved in the contract to coerce one party to break the contract) The defendants file an "Anti-SLAPP" motion, which is designed to prevent free speech from being repressed by a lawsuit; the first step basically anyone should probably take if they are being sued for Defamation. There are a few factors that go into determining how anti-SLAPP are to be ruled, such as if parties are found to be public figures, if the actors had malicious intent or gross negligence. Over a few months, the details were laid out, parties were deposed, etc. However, due to a miscommunication, a document in Vic's side is improperly notorized, and the paperwork to correct the error is delivered literally minutes too late (we're talking if the deadline is 12, they arrived at 12:04) and the judge rules that it cannot be considered, and therefore concludes that the Anti-SLAAP motion is permitted, and the actual lawsuit is to be dismissed before trial. This definitely has nothing to with the judge being up for re-election during the apex of # "MeToo."
The only Niji fans that would get harassed are the ones that go looking to start trouble. Seeing how toxic and in denial Uki's fans are, my guess is it would have been primarily them.
I get it, Nux, I do. The Niji talents didn't do anything wrong. But if the internet is intent on making Niji suffer non negligibly, the talents will suffer even if they are not directly targeted.
I'm starting to think of this in two ways, either the changes to management from the main branch are the reason niji pulled and it took two weeks to get it out. Or niji was threatening to pull off certain others were allowed to attend or vend their products and Kai was left with no option but to let them leave or just cut them.
I also think all harassment claims are fake till I see it on video. I don't trust anyone, there's too much clout in being a victim these days for me to blindly trust anyone saying, "I'm a victim". As for online harassment unless i see a large amount I always suspect people of harassing themselves from sock accounts for that victim clout.

Iirc Offkai eventually came out saying that they intended to release the statement ASAP some two through three weeks ago but they had sent a statement to Niji for their approval hoping to make it more of a mutual separation but Niji didn't get back to them. I've also heard rumors that the Offkai expo organizers were pretty big Niji stans and out of all the anime/vtuber related cons (in the U.S. at least) Offkai had the closest relationship business wise with Niji. So, assuming the prior to be true, I imagine a.) that they wanted to do this in as amicable a way as possible so as not to sever their relationship/future opportunities with Niji and b.) that they were reluctant to make this decision but did so anyway. That last bit is just my speculation though.
My money's on this being a calculated move by Niji. THEY pulled their talent, paid off the Con to say they were booted because having Niji there made the situation unsafe, and they did it all to make themselves and their talent look like victims of online hatred.

But it wouldn't surprise me if it's exactly what you said. Especially since one of the big issues with Niji is they're extremely sluggish with their responses to their talent's needs.

Probably because the only conventions I've been to have had meet and greets with actors/artists (I've met and got to talk with Ernie Hudson, Sean Patrick Flannery, and Rob Liefeld) and it just never occurred to me that they could just set up the equipment there. Do they actually go to the convention and setup the streaming equipment there? Or do they just stream from home directly to the convention? That would probably be a lot cheaper, but then they wouldn't be able to enjoy the convention for themselves as an anonymous guest.

Nux... The whole weeks (or at least a period of time from the decision) is very understandable and not malicious. Just guess the reaction if the Niji vtubers had been removed from the page 2 weeks ago, or even a week ago with no statement as contracts & agreements haven't been finalized correctly. Offkai may be held liable for breaking a contract with Niji. Having worked for a volunteer Con for five years (& being one of the founders of that Con) I can say these things take time if you don't want to take some harsh penalties. I'll even go so far as to say Offkai may have reached out to Niji 2 weeks ago over concerns and it may not even have been decided that Niji would pull out until a day or two ago. The situation has likely been in flux for that whole time. The rumors False heard may be them getting things organized behind the scenes and they finally got the ok for an official announcement earlier. Offkai didn't need to be malicious in any way for this to have taken two weeks and it isn't fair to say they were specifically advertising on the Niji presence while knowing it wouldn't happen.
Given that the OffKai Expo doesn't take place until the beginning of June, it really seems unlikely that the appearance would be cancelled based on the current furor. A lot of water will pass in 3 months, which makes me think Nux's hunch is closer to the real story. I think the most likely reasoning is that Niji HQ can't guarantee that all of the Ethyria members will still be in a position to attend conventions when the time comes.
Honest opinion purely from optics? After what was going on with Uki, they didn’t want to put niji talent in front of people (specifically Enna) who currently is already deep in the niji drama, so she doesn’t say/do something to add to it. They sent the notice to Offkai, Offkai had no idea how to break it to people so they were asking for advice with people they trust and a couple whispers made it to false unknowingly. False releases this and they fell ass end into a reason to “release” this news. Niji benefits from not being the one to say “hey, sorry we can’t make it”, getting pity for being “unjustly excluded” and Offkai gets a reason to break the news.

Not passing judgement on the convention's quality or anything, but I've heard too many stories about bad conventions turning into PR nightmares after having to last minute cancel a guest for one reason or another. This move isn't out of the realm of possibility for any somewhat internet savvy convention staff to pull

Knowing niji the contract termination and negotiations with offkai probably took nearly 2 weeks to conclude. Or offkai just gave up trying to get them back after falses tweet blew up.
People blaming false for niji not being there is ridiculous. Some of them are even content creators like Evan.
I think the safety concern are more of a cherry on top of the cake. They didn't want them mainly because of the fact they are a liability but it also makes the convention safer as a result.
Also I think Niji's silence is mostly them recruiting new CMs and a new marketing team x))

TL;DR- A simple mistake and a bad judge caused Vic's lawsuit against the people who called him a r@pist to not be considered.
A quick catch up for people unfamiliar with Vic Migniona's situation. (This is not a timeline, while I have the events as close as I can remember them, it's definitely going to be out of order.)
A literal who posted that he touched her inappropriately while hugging. (This will be returned to.)
Seeing that the accusations were gaining traction, fellow VAs and people who Vic viewed as some of his best friends Monica Rial and Jamie Marchie also give vague, nebulous accusations that can't be confirmed because there is zero detail.
The literal who is informed that the person who allegedly groped her was in fact not Vic Migniona, but it's still good that she accused him because "fuck that guy."
Monica finally describes the alleged situation where Vic invited her to his room to view his Star Trek fan project he had just wrapped. She names the con, hotel, floor, and room; saying he pinned her to the balcony door and did the bad things TH-cam won't let me say.
The hotel owner comes out saying the floor she claimed didn't exist, nor did the rooms have balconies. He provided a floor plan, backing what he says.
Rial changes her story, a common tactic of people caught in a lie.
Monica, Marchie, and some others are alleged to contact Vic's upcoming cons he is to be appearing (one Con owner provides a transcript of the call, in which they claim criminal charges definitely will be filed against Vic before the con date. These charges were never filed.
Vic files a lawsuit for defamation and tortious interference of a contract (a third party contacting parties involved in the contract to coerce one party to break the contract)
The defendants file an "Anti-SLAPP" motion, which is designed to prevent free speech from being repressed by a lawsuit; the first step basically anyone should probably take if they are being sued for Defamation. There are a few factors that go into determining how anti-SLAPP are to be ruled, such as if parties are found to be public figures, if the actors had malicious intent or gross negligence.
Over a few months, the details were laid out, parties were deposed, etc. However, due to a miscommunication, a document in Vic's side is improperly notorized, and the paperwork to correct the error is delivered literally minutes too late (we're talking if the deadline is 12, they arrived at 12:04) and the judge rules that it cannot be considered, and therefore concludes that the Anti-SLAAP motion is permitted, and the actual lawsuit is to be dismissed before trial.
This definitely has nothing to with the judge being up for re-election during the apex of # "MeToo."

I get it, Nux, I do. The Niji talents didn't do anything wrong. But if the internet is intent on making Niji suffer non negligibly, the talents will suffer even if they are not directly targeted.
I'm starting to think of this in two ways, either the changes to management from the main branch are the reason niji pulled and it took two weeks to get it out. Or niji was threatening to pull off certain others were allowed to attend or vend their products and Kai was left with no option but to let them leave or just cut them.
I also think all harassment claims are fake till I see it on video. I don't trust anyone, there's too much clout in being a victim these days for me to blindly trust anyone saying, "I'm a victim". As for online harassment unless i see a large amount I always suspect people of harassing themselves from sock accounts for that victim clout.

Iirc Offkai eventually came out saying that they intended to release the statement ASAP some two through three weeks ago but they had sent a statement to Niji for their approval hoping to make it more of a mutual separation but Niji didn't get back to them. I've also heard rumors that the Offkai expo organizers were pretty big Niji stans and out of all the anime/vtuber related cons (in the U.S. at least) Offkai had the closest relationship business wise with Niji. So, assuming the prior to be true, I imagine a.) that they wanted to do this in as amicable a way as possible so as not to sever their relationship/future opportunities with Niji and b.) that they were reluctant to make this decision but did so anyway. That last bit is just my speculation though.
My money's on this being a calculated move by Niji. THEY pulled their talent, paid off the Con to say they were booted because having Niji there made the situation unsafe, and they did it all to make themselves and their talent look like victims of online hatred.

But it wouldn't surprise me if it's exactly what you said. Especially since one of the big issues with Niji is they're extremely sluggish with their responses to their talent's needs.
While probably not dangerous, if there is a timeline where they continued having Ethyria, the chances are low but never 0 that it will be remembered as the start of the Menhera Wars

I hate to say this (j/k I lied I don't), but I don't feel bad for Kurosanji's talent at all. They read the contract, and they signed it. They knew what they were getting into. And if they didn't leave the company of their own volition after knowing exactly what the entire internet knew would happen, they only have themselves to blame.
Honestly I feel this is a cover up, option 1, their was a deal behind the table to avoid more drama, or the one I think might of happen. Option 2, they kept quiet has a no call no show, to make it look like we been harassed petty us, and the con with ninji agreed that B's last min excuse has a way to turn it around but might of back fire.
But then again it's just a theory
It would have been better if Nux had watched False’s video as he actually talked to the people behind OffKai who explained that they’re a volunteer staff which was small at the time and that they couldn’t announce anything until the negotiations with Niji about terminating the contract were complete
They knew that they couldn’t remove Niji from the guest list before finishing negotiations without risking legal issues, and that they would have to refund tickets which they did not have enough staff to handle at the time. So they waited until the negations were complete and they had enough staff to handle all the refunds
If they had pulled Niji from the guest list before making an official announcement they would’ve gotten backlash from Niji fans for siding with Doki, or worse legal issues from Niji for damaging their brand, if they made an announcement without having enough staff they would’ve gotten backlash for not being able to handle the number of refunds. No matter when they made the announcement OffKai was going to get some amount of backlash putting them in a no win situation. So they opted for the choice that presented the least amount of problems and backlash
That is what I mean. then again can't say I'm captain insight, but can't throw baseless assumption without fact... All this smell rotten behind the scenes, legal matter or not, feels like off Kai was giving a bad deal has a scapegoat.

Probably because the only conventions I've been to have had meet and greets with actors/artists (I've met and got to talk with Ernie Hudson, Sean Patrick Flannery, and Rob Liefeld) and it just never occurred to me that they could just set up the equipment there. Do they actually go to the convention and setup the streaming equipment there? Or do they just stream from home directly to the convention? That would probably be a lot cheaper, but then they wouldn't be able to enjoy the convention for themselves as an anonymous guest.
@@elvennations They usually stream from home like usual. The convention would set up cameras and mics so the Vtuber can see and hear us as well. I've heard that some stream from the convention greenroom itself when they happen to live nearby, though.

if you look at the Niji contracts Niji decides what happens to the talents, they can send them to North Korea and fire them if they refuse, that is how their contracts are written.
Nux... The whole weeks (or at least a period of time from the decision) is very understandable and not malicious. Just guess the reaction if the Niji vtubers had been removed from the page 2 weeks ago, or even a week ago with no statement as contracts & agreements haven't been finalized correctly. Offkai may be held liable for breaking a contract with Niji. Having worked for a volunteer Con for five years (& being one of the founders of that Con) I can say these things take time if you don't want to take some harsh penalties.
I'll even go so far as to say Offkai may have reached out to Niji 2 weeks ago over concerns and it may not even have been decided that Niji would pull out until a day or two ago. The situation has likely been in flux for that whole time. The rumors False heard may be them getting things organized behind the scenes and they finally got the ok for an official announcement earlier. Offkai didn't need to be malicious in any way for this to have taken two weeks and it isn't fair to say they were specifically advertising on the Niji presence while knowing it wouldn't happen.
Given that the OffKai Expo doesn't take place until the beginning of June, it really seems unlikely that the appearance would be cancelled based on the current furor. A lot of water will pass in 3 months, which makes me think Nux's hunch is closer to the real story.
I think the most likely reasoning is that Niji HQ can't guarantee that all of the Ethyria members will still be in a position to attend conventions when the time comes.

Honest opinion purely from optics? After what was going on with Uki, they didn’t want to put niji talent in front of people (specifically Enna) who currently is already deep in the niji drama, so she doesn’t say/do something to add to it. They sent the notice to Offkai, Offkai had no idea how to break it to people so they were asking for advice with people they trust and a couple whispers made it to false unknowingly. False releases this and they fell ass end into a reason to “release” this news. Niji benefits from not being the one to say “hey, sorry we can’t make it”, getting pity for being “unjustly excluded” and Offkai gets a reason to break the news.
