you didn't even have to open the box to know it was a scam. that box has the iphone with iOS 4 because it has a wallpaper. the 2009 3Gs had a black background and it came with iOS 3.

Amazon has scammers too, even Google, you just have to be careful and chat with the seller first and check their reviews. also always use Paypal and not your actual card holder, Paypal also has a buyers remorse so that's double the trouble if you were scammed. i only used Ebay twice, sadly for some dead stock shoes, first time was scammed and luckily was able to catch the fake before dude shipped it and got my money back, second time i got thru with it and chatted with the seller first, gave me all the evidence and talked me thru the shipment all the way till it arrived to my door.
That's too bad because there's some really good deals over there. As long as you stay vigilant and use paypal, it shouldn't be a problem

Buying on ebay is no big deal. You just have to buy from reputable sellers. You can get scammed just as easy anywhere. ebay also protects their buyers fiercely. Like, literally ALL the rules are meant to protect the buyer not the seller, so it is incredibly rare to get scammed on ebay and then them not turning around and making it right for you.
Selling on ebay is stupid however, especially for an honest seller. I use to sell on ebay all the time and never had a problem cause buyers were always honest, gave good feedback and I never once lied. Then one day people began lying and said what I sold them wasn't correct and ebay white knighted for them so quickly and got them a refund without even asking me.
If anything, its THE BUYERS on ebay who make it hard for honest sellers to be on the site, cause it is way easier to rip off a seller than it is to rip off a buyer.
If it says sealed Brand New. It's probably fake

another sign is that you didn't need iTunes to set the iPhone up, the first update that could let you setup any iPhone, iPad, etc. was iOS 5, which was released in 2011, and that phone was released in 2009. Also the first phone to come with iOS 5 in the box was iPhone 4s.

Just like they still sell the iPhone 7 from 2016 today they still sold the iPhone 3GS in 2011 at apple and the phone would come with iOS 5 which came with iCloud.
Apple still sold the iPhone 3GS as a cheaper option when the 4s was around. It’s definitely been resealed but iPhone 3GS’ did ship with iOS 5.

Sorry to hear you got scammed :-( I should point out though, the 3GS was still available new until September 2012, so the last ones made did come with iOS 5 and iCloud

your correct except that the 3GS supported right up to iOS 6 support stopped at iOS 7in 2013
The Italian dude actually the last iOS version to run on the 3GS is 6.1.6, released in early 2014 as a post-iOS 7 update for the 3GS and 4th generation iPod touch. But it was already obsolete, for example Snapchat would already refuse to log in in late 2015

I've got an eBay horror story for you.
Once, I was trying to purchase a Batman DVD and as soon as I agreed to purchase it, the seller messaged me saying that he doesn't accept PayPal (even though PayPal was listed as a payment option) and wanted me to continue the transaction outside of eBay. So I messaged him back saying that it was violating eBay's Terms of Services and he must either cancel the order or I will report him to eBay. And you know what he said to me? He said: "I don't accept paypal. Report whatever you want, stupid." So not only was he attempting to violate eBay's Terms of Services, but he was being a total assh*le to me about it. So after a bit of arguing with him, I finally called eBay and they took the immediate corrective action and now, he is no longer a registered user. BTW, for those curious, I did eventually get the DVD from somewhere else and at a much better price.
Christopher Malone well that's good. I learned to interrogate the hell out of a buyer on eBay. I would buy anything unless they answered by questions and I am ok with the answer. Most times the seller if fine with that. If they get mad over simple questions I am like ok I will take my service elsewhere

Yeah. I got suspicious too. iCloud made me realize that it was a scam. I never bought any of Apple's old phones, but it was kind of eerie to see iCloud in 3GS.

It's moments like this that make me happy buyers almost always win on eBay but there are times it's abused too like when I sold my old 2tb hard drive as none working faulty and the guy opened a case saying it didn't work when he bought it knowing it was broken and didn't work........
Its definitely resealed, but iCloud isn't a sign that it is though, they were still selling them for a few years and that one just had the new iOS.

Agree, if anything, eBay is the safest place to buy anything online. You get the eBay guarantee, if it’s not as described you get all your money back. Ignorant people are the worst.

i buy stuff on ebay all the time. and ive had some bad experience i got scammed twice on ebay. but with ebay 99% of the time you can get your money back and in both times i got scammed i got my money back no problem. and aslong as you buy from reliable sellers(by looking at their feedback)you should have no problems

ebay is pretty safe tbh. you just buy from reliable sellers by looking at their rating plus with ebay money back guarantee its pretty simple to get your money back if you do get scammed. been scammed twice but got my money back both times with little effort
The 3GS is the only iPhone I've ever used as my daily driver and it was great. I will use phones until they die and sadly the 3GS went when the housing around the power button pretty much shattered and the button itself became unusable.
I knew at that point, given that if the phone ever got turned off somehow I'd never get it on again, that it was time to move on. Since then I've had a variety of Android phones and I'm currently on a Galaxy S7 that I got second hand for £330 middle of last year.
However I'll always remember that iPhone 3GS very fondly indeed.
