Literally being prosecuted for not wanting a TV subscription. What a joke. Might as well put people in prison for not eating cornflakes or for not smoking cigarettes. Ludicrous

Well they weren't were they, they were prosecuted for watching live broadcast TV or using bbc iplayer while not having a valid licence. To be clear I am against the TV licence but if someone does not want to pay it then stick to the rules its that simple.
Most of these convictions are under the "Single Justice Service". The government's own web site says that, "A single magistrate, supported by a legal adviser, can decide adult, summary-only, non-imprisonable and victimless offences. They can do this when the defendant has pleaded guilty or has not responded to notification that they’re being prosecuted." This is what enables magistrates to process such a high number of cases. Each one may take only 5 minutes without him ever leaving his armchair at home. The last sentence is key - "when the defendant has pleaded guilty or has not responded to notification that they’re being prosecuted". The Black Belt Barrister has posted a number of videos where he has pointed out that, if one does not respond to a prosecution notice, one will be found guilty. Sadly, therefore, the high conviction rate will have much to do with the inaction of those being prosecuted.
I learnt about this well over 10 years ago after watching Russell Burton here on TH-cam, he set the record straight for me, people need to wake up and stop paying their TV licence and the BBC should be banished, it's well past it's sell by date.
For those of us who live outside London and the Home Counties, the BBC has been past its sell-by date for a century. But - like the Post Office scandal, it's the justice system itself that should be most ashamed. You only have to sit in the average magistrate's court for an hour (which I have twice in recent years, as a witness) to wonder if the entire pompous system - administered by people to whom strife means no ice for their gin - is long past its sell-by date.
Had a Court summons many many years ago. when I attended court it was an actual Hearing with a right jumped up Barrister acting on the BBC behalf, he actual said he was going to prove that I had watch tv. My fault should never of let the goon into the house, but needless to say this was way before the internet so I really didn't have a clue. To top it off there wasn't even a plug on the tv lol! In the end I did mange to get it thrown out of court with 'case not proven'. I dont have a licence today and God help them if they attempt that s**** again.
It is a much different system now. Most of these convictions are under the "Single Justice Service". I notified the licence agency that I do not need one, they responded by saying that they may still send an agent round to check if it was true and that my notification of not needing one only lasts a certain amount of time (which was not written anywhere on the letter). If I tell someone NO then that is the end of it, my rejection does not have a shelf life! It all came across as a scare tactic, which no other company would ever get away with. If I don’t like cornflakes and don’t buy them, Kellogs don’t send an enforcement officer round to make sure I’m not eating cornflakes unlawfully.
Exactly it's the biggest joke ever, it's even worse than your kelogs analogy since they deliberately make their service available on every single device whether you want it or not. It's like a window cleaner cleaning your windows despite you asking him not to then demanding payment.
I cancelled just over two years ago. So have just started to get letters from them, or rather the 'Legal Occupier' has got letters. There is no way on Earth I am contacting them every two years.
@@timg1246 12 years for me. No contact is the best way. Don't reply. Don't answer the door and if you do by accident just say bye bye and close it. Nothing they can do
I decided not to redeclare no licence needed after my first one expired after 2 years. During that 2 years, I still received letters but my main reason for not redeclaring was that I didn't see why any company I wished to have no dealings with should know who I am and where I live, let alone a disreputable company such as Capita. No they’re not. Magistrates are given the paperwork to sign (and it’s a lot) and because no-one is there to appear in front of them, it’s done in a back room. There’s a fine, plus the cost of a licence. The only time you need to appear is if the *_fine_* is not paid - they don’t care if you don’t buy a licence. Magistrates are as unhappy about having to do this as we are at them doing it. My late father was a magistrate.
@@enkisdaughter4795 I don't think appearances in court are the issue here. The fact remains that if you do not plead not guilty, or do not plead at all, the "Single Justice Service" will only take a few minutes to find you guilty.
"What's theTV licence for?" "To help people stay licenced" As a nation, we could end the BBC licence fee tomorrow if we coordinated against them. There is no divine right for the BBC to exist.
A Tax pays for funding of amenities or whatever else A Licence is not a tax its a one off Payment ie'Driving Licence; fishing Licence, Public performance Licence. So for example if you pass your Driving test its not the law that you should obtain a licence. If you don't have it you won't get fined or face Prosection. A So called TV licence is a tax to pay the BBC for funding there Extortionate Service on people who don't want to pay it.
About 40 years ago I was taken to court . The magistrates looked at my bundle of paperwork showing DD had been paid for years . I claimed it was an oversight, they agreed and case dismissed! Oh and now I haven’t had one for the last 3 years!😱😝
The Horizon scandal, which saw about 900 sub-postmasters wrongly convicted, has been described as the 'worst miscarriage of justice in British history'. With 44,000 convictions in one year alone (2021 - 2022) for tv licence offences (many without the defendant even being present) I find myself asking 'is it really?' I doubt it actually comes anywhere close to being the worst.
I user to appear in court on behalf of my employer, a local council. That didn't last long - I was replaced. My offence? I told the truth - the 'evidence' used against (by policy) the most vulnerable people was too often just nonsense paperwork, routinely rubber stamped by a local court. I once looked over the shoulder of a clerk (her title was exalted, but that's all she was) to see a template letter (carefully dated a fortnight before it was even composed) telling a complaining ratepayer that they were entirely alone in their concerns. I asked how many identical letters she'd sent that day? Oh - about 200 !
Yes, it’s probably better to keep the system they’ve got now than introduce some other method of extracting a ‘subscription’ from every adult in the country. I’m sure that whatever new scheme they cook up to replace the license will be worse, it always is.

So glad I came across Jon`s channel a couple of years back when I had cancelled my license. Jon`s posts gave me invaluable help in just how to progress from there. All the best to you Jon! 🙂
Thanks to Jon I talked my sister into cancelling hers. She never watched anything but repeats of decorating shows on digital channels! She needs that money more.

I work for Capita myself and I find the whole TV licensing thing a farce, I also never pay for a license either. People really need to stop being scared of them.

I've said this before, but some poor vulnerable person who doesn't need a tv licence will be harassed, bullied and end up topping themselves. Surprised it hasn't happened already. This is the next post office scandal. Could we convince Netflix to do a drama on this? Don't sign anything, don't talk to the goons, don't try to outsmart them as tempting as it seems. Say no thankyou, shut the door. Film it if you can, raise awareness.
Why does the Nation not get together and all cancell their TV LICENCE. This is the only way to put a stop to this. What will they do.,put the Nation in Jail? Please think about it, lets have somebody start this up please. It has become a big issue now for the Nation. Gouverment is a fool for not getting this sorted now.

Dude! Start a campaign to raise funds so that every household in England can be leafleted explaining their rights and what they do and do not have to pay for with the TV licence. Set it up and lead the campaign and I'll chip in and get others to as well. You could do a region, see how it goes and if successful expand the campaign. Come on, DO IT!
Thanks Jon for all the very supportive work here, I cancelled my licence some years ago as we don’t watch live programmes and play by the rules. Couldn’t fine the post re the prosecution of the vulnerable person, but I am so angry by the systems that we abide by, honesty and fairness, but the system is not is it. The BBC needs to be brought to task here, I am ashamed of them. ‘Portsmouth Bob’
Black belt barrister looked into this and you DO NOT need a License, apart from when watching LIVE BBC broadcasting…which amounts to about 3 F.A. Cup games… How they trap you is in their questions. ‘Are you the legal occupant of this property’ if you say yes…you enter into a verbal agreement! What annoys me is they involve the POLICE who are an emergency service! The TV van is a lie…a policeman told me that years ago. Ignore them and just shut your door. Do not say one word to them…

Here in New Zealand they tried the same thing, after a few years they realised no one was paying & the infrastructure needed to support & prosecute non payers was deemed uneconomical so they scrapped the whole thing.
I've said it many times, the government should be running an awareness campaign in making sure people understand exactly what a license is needed. Shocking that this isn't.
Tell them to sod off and don’t open the door even if the police knock because then they need a warrant to force an entry that they won’t get because they can’t prove any crime has or is being committed simple

Your videos are brilliant, that's why I cancelled my TV licence two years ago. The big problem I have is how to get the massage over. That’s like ATOS years ago. I had to go for a medical to do with my benefits after I’d come off them to work full time way back in 2003. I’ve been on benefits since 1992 due to disabilities, and I took a Permitted Work job where I did 15 hours a week. I was offered full time work from it and because I didn’t want to be on benefits for the rest of my life, I weighed up the pros and cons and was told by the DWP, that if I fell ill within the first 12 weeks of work, I would go back on my benefits at the original rate and I wouldn’t need to go for a medical. After 6 weeks of working 60 hour weeks (I should only have been doing 40 hours, but people who didn’t turn up for their shifts would have to be covered by whoever was on before them [me]), I ended up in hospital and I couldn’t walk; the DWP sent me a letter to state I was unfit for work and I must resign, and go back on my benefit at the full normal rate. 3 months down the line, I’m sent for a medical ! At this, I couldn’t understand half of what the doctor was saying due to his really thick foreign accent; I was asked how far I could walk without pain - 0, in constant pain but had to put a number, so I said 2 meters. After I’d read over the paperwork, I signed it and went back to resting at home. I then got a letter stating that I was ‘FIT FOR WORK’ and my benefits were all stopped ! I contested this decision and got a transcript of the paperwork. There were discrepancies on it - it now stated I could walk 200 meters, that I carried a ‘small suitcase’ - it was a satchel bag with a p/b book and ALL my medication in it, and the doc moaned that I ‘didn’t use the stairs to access the examination bench’ - that’s because I’m 6ft 5ins and it was at just the right height for me to sit on - why use something that’s going to cause me more pain when I didn’t need to ?! I also found out that ATOS were offering their doctors an extra £50 for every person they signed ‘FIT FOR WORK’ ! I took it to a tribunal and when they saw the DWP letter stating I had to resign, my full benefits were reinstated ! The problem was, I’d been expected to live without ANY money for months ! I ended up being told by DWP that I would have to sign on ‘as fit for work’ even though I wasn’t just so I had money to pay bills, and my best pal would lend me money and buy groceries for me. He only asked for £500 back. I was wracked with anxiety which didn’t help my other conditions and made me worse. Now, 20 years on, I’ve gotten worse and there’s talk that this government wants to get ‘longterm sick people back to work’ which is just going to backfire !
I'm considered disabled although there are no outward signs of my disability and I have a very well documented problem going back almost 40 years which has got steadily worse. I'm now at a point where a couple of minutes of anything physical leaves me in agony and I'm on Morphine for the pain but I've filled out the DWP form and I know they're gonna send me for an interview. That's fine, I understand that and have no problems going but I have no doubt they'll say fit for work and I'll appeal based on my doctor's evidence. I'd also like to say that I've paid tax and NI for almost 40 years so I'm not a scrounger or similar and only went onto benefits when my business failed because of the government lockdown and NO, I didn't get a penny from them. I know lots of self employed people who claimed the govt money and still worked, that's a benefit cheat!!
Other funny thing is that 47k prosecution to 44k convictions has to be one the most successful jobs the government ever did. I don't think any other crime has such a high success ratio, even murders where there is a body has more people avoid conviction.
Maybe you could but who has £1600 a day for a barrister (this is what I paid over 5 years ago). People are scared to go to court or even respond to the initial summons, they have no hope of appealing and this is due to ignorance of the proceedings as a whole.
I haven't had a TV licence for over 30 years. I've had a couple of licence enforcement people knock on the door, but I asked them to leave and that was the end of it.
I havent watched the bbc in years, but did see some whilst visiting at Christmas, it reminded me why I cancelled my licence, so called prime time bbc was absolute crap.
I know plenty of people that don't pay the licence and still watch live TV. Some have their TV in area's of there house where TV goons can't access to snoop and others are in upper floors/flats etc where unless the goon has a ladder they can't snoop. Many haven't paid for years and years. They also don't answer the door unless they know who it is. I haven't paid the licence for probably 10 years or so !
My "2 year No license required" submission. Ran out whilst I was in hospital for 6 weeks, after suffering 2 ischemic strokes c/o Covid. I finally got home to a letter demanding I pay my TV license. Claiming they had PROOF of me watching TV unlicensed.. HOW ????? I re-submitted my "NO license required" online and have not heard anything since.
So looking at what's been said here even if you don't talk to them and close the door, they can still possibly take you to court behind closed doors based on fabricated evidence by them only and that's it your done and convicted.
Only if you sign something. They have been accused of, essentially, filling in a 'confession' above your signature after you signed it. Then they claim that is how it was when you signed it. Personally, given their other, obviously vindictive, behaviour, I find the allegations believable. Recently they prosecuted someone with Downs Syndrome. Try telling me that was an 'error'. Nasty people working for TWO nasty companies, the BBC and Capita. Never let them on, never sign anything.
That’s why they should be called Poor Courts and not Magistrates Courts. Rubber stamp everything and then get BBC to report on how unjust other countries’ courts are. This country is nothing but an open prison Stasi state and there’s no chance of changing it by voting.
@@Frankie-c5x Trouble with ignoring the court's judgement is that the bailiffs are then given the job to retrieve the £1000 fine. The bailiffs are allowed to gain entry to your house and remove any goods that come to the sum of money owed to the BBC fine if you are not willing to pay the fine to the bailiff company when they arrive at your house, and you also then have to pay a ridiculous payment to the bailiff company that is asked on behalf of the court's judgement. So it all conveniently works in the favour of the BBC all win win case.
I hate the beeb I’ve been getting harassment for years and I find it weird that I don’t want or need it or require it in anyway whatsoever ! and I shouldn’t have to if I want a service whether it be internet or any other if I don’t use it or want it why should I , I have to have car insurance because I drive a car ! if I don’t even watch anything or have a tv why should be harangued into buying a license for things I don’t require it’s daylight robbery harassment and bully tactics that won’t work in the long run they will hopefully go under shame on them !
Yes I read about this TalkTV investigation in The National (Scotland's Independent Daily Newspaper) which is today 16/01/2023 on Page 2 thereof. whereby it sates; With nearly 150 people every day being prosecuted for failing to PAY their TV Licence Fee (Tax), with most of them being the poorest people in The UK it has been revealed. In the year up to June 2022, more than 47,500 people were prosecuted and more than 44,000 were convicted for failing to pay for a £159 TV Licence, whereby a total 70% of those convicted were Women with some of them being aged in their 80's or 90's whereby all of them were convicted under the controversial - Single Justice Procedure. Many are still found Guilt and are fined up to £1,000 despite having crippling medical conditions such as Dementia and Cancer. (At another past time a BBC Panorama programme would have investigated these types of Events). Talk TV has obtained Legal Papers revealing how seriously ill people were still prosecuted despite written Statements to the Courts to defend themselves. In response to the above a Ministry of Justice spokesperson said they are carrying out a review of TV Licensing prosecutions, and further stated - If you watch or record "Live" TV broadcasted TV Programmes then you must have a TV Licence as the Licence Fee pays for TV, Radio and Online Programmes plus BBC Services including iPlayer, Radio 1, CBeebies and The World Service. etc. Lord Ken MacDonald, a former Director of Public Prosecutions, said - there is a conflict of interest for The BBC in this matter of course with ensuring that people pay their TV Licence Fee, and that is a Corporate Interest which should not necessarily be wrapped up with a Prosecutorial Interest. Lord MacDonald further went on too say - " I think all criminal prosecutions should be brought by an Independent Prosecutor - The Crown Prosecution Service. The Drama Mr Bates vs The Post Office has highlighted the shocking treatment of more than 700 Sub-Postmasters being wrongly convicted of Theft and Fraud in a series of Private Prosecutions brought by The Post Office. Back during 2020 the Legal Charity Appeal warned MP's about what it saw as similar risks also facing TV Licencing by telling The Justice Select Committee, "We may see the same level of miscarriages of Justice as took place in The Post Office prosecutions.
NEVER cancel your license with the BBC. Simply don't pay for one. Then wait patiently for a goon to knock the door. Open door, film them, say nothing, wait for them to either slip up or leave. Publish video to TH-cam.
Perhaps the MPs should ask the BBC to explain exactly where all this money goes. Most of it goes on over the top salaries and pension pots you wouldn’t believe. MPs can’t say anything, because they do exactly the same thing. They have a book called The Bible, which lists every single thing they can claim for. As soon as they turn up for the new parliamentary session, they’re given this book. They’re advised to claim for every single thing possible *and* to go for the higher cost items.
I recently stopped paying for the TV licence after watching your channel, well done for informing us our real rights. Never watch normal TV anyway, I pay for TH-cam premium, Netflix, Amazon Prime, Discovery+ and Apple TV, there is literally nothing on normal TV that I would want to watch and certainly not on the BBC, they offer the worst programming of all the channels. Only thing I used to watch was Blaze and I now watch that on their app via streaming the pre-recorded programs to my Chromecast device.
Jon I’ve watched your videos for years now, your temper has certainly raised over that time! You’re an absolute legend though, your content is superb and owed a few 🍺 if I never bump into you in Maldon!
Excellent work, Sir, keep it up! Having recently realised that it's been several years since I've actually watched any 'live TV' (sic), last year I made the decision to renounce our TV License. All it took was to call them up, explain to them that we have no actual TV and only ever watch 'on demand' content from the Internet (Netflix, etc) - and, according to the Licencing people, as long as we do not watch anything other than 'on demand' content, then they are perfectly happy. So far it's been nearly 2 years, and we've only had a single 'just checking to see if you're watching anything 'live' yet?' confirmation/query from them. So yeah, while it looks like we're currently sorted on this front, it's an issue that I can see going South very fast if/when they decide to make it *all* content, live or otherwise, that requires their ... thing.
I’ve made this point on here before Jon. Talk TV are very good at saying the licence should be banned , they then have such ignorant debates about it they do more harm than good. You need to be their go to expert on this lad!

The government's own web site says that, "A single magistrate, supported by a legal adviser, can decide adult, summary-only, non-imprisonable and victimless offences. They can do this when the defendant has pleaded guilty or has not responded to notification that they’re being prosecuted."
This is what enables magistrates to process such a high number of cases.
Nothing they can do
Don't put ideas into their heads FFS 😂

It's not a Licence it's a Tax.
It's a subscription. I don't subscribe, so I pay nothing.
I had one of the goones at my door last week took great pleasure in saying no thanks and closed the door
Don’t have one don’t want one and certainly don’t need one!
About 40 years ago I was taken to court . The magistrates looked at my bundle of paperwork showing DD had been paid for years . I claimed it was an oversight, they agreed and case dismissed! Oh and now I haven’t had one for the last 3 years!😱😝
Nice one!
The Horizon scandal, which saw about 900 sub-postmasters wrongly convicted, has been described as the 'worst miscarriage of justice in British history'. With 44,000 convictions in one year alone (2021 - 2022) for tv licence offences (many without the defendant even being present) I find myself asking 'is it really?'
I doubt it actually comes anywhere close to being the worst.
Being fined for breaking the law is hardly a scandal . It's as fair as can be .
I cancelled mine two weeks ago and got a refund with in a few days and I feel liberated! ❤
And no questions asked

This same scenario had me paying for a licence for 8 years I didn't need 💯👍
We need a Mr Bates against the TV licensing as it’s as bad as the post office
Other funny thing is that 47k prosecution to 44k convictions has to be one the most successful jobs the government ever did. I don't think any other crime has such a high success ratio, even murders where there is a body has more people avoid conviction.
It's probably deliberate to manipulate statistics and just to make their conviction rate look good.

Great stuff Jon👏. keep up the good fight👊
Surely one can appeal the conviction then file a lawsuit for wrongful and malicious prosecution against TV licensing!
Maybe you could but who has £1600 a day for a barrister (this is what I paid over 5 years ago). People are scared to go to court or even respond to the initial summons, they have no hope of appealing and this is due to ignorance of the proceedings as a whole.

Let them. Ignore that as well.

Yes I read about this TalkTV investigation in The National (Scotland's Independent Daily Newspaper) which is today 16/01/2023 on Page 2 thereof. whereby it sates;
With nearly 150 people every day being prosecuted for failing to PAY their TV Licence Fee (Tax), with most of them being the poorest people in The UK it has been revealed.
Lucy, is just another puppet.
Only thing I used to watch was Blaze and I now watch that on their app via streaming the pre-recorded programs to my Chromecast device.
probably concerned about not enough folk being prosecuted
Thank you Jon 👏👏👏👏
Jon I’ve watched your videos for years now, your temper has certainly raised over that time! You’re an absolute legend though, your content is superb and owed a few 🍺 if I never bump into you in Maldon!
youre doing good work! keep up the good fight
If everyone over the age of 75 years refused to pay the licence fee then the courts would come to a stop
Thanks for the link. I told them my piece. Thank you for this information. You’re doing a great job and keep it up. 👍
Used to watch Match of the Day but the kneeling footballers at the start of every match convinced me to finish with it all. Don’t miss it at all.
The post office are going to be stopped from making private prosecutions. Why not TV licensing?
The question never brought up n answered is why the bbc is allowed a monopoly, no other company is allowed a monopoly in the U.K.
