    The day the defendants moved in the utilities should have been put in their name. The electric company would have seen that the meter was rigged. You move into a rental, live there 2 years, and never wonder why you never got an electric bill? The plaintiff's son may have rigged the electric, but the defendants went along with it for 2 years. The plaintiff should have been more diligent, making sure the utilities were taken out of her name the day the defendants moved in.

      Unless there is a separate meter, which is the responsibility of the property owner, the cost of the power would be part of the rent as there is no way to track usage. The landlady’s failure to manage her own property is all on her. The terms are set forth in the written lease. Those are the only conditions that apply. The same applies with water usage, gas and cable. No separate connections, that falls on the property owner who decides to rent. No tenant has to go out of their way to request a separate meter if the owner hasn’t installed it.

    • @AdoreiMandy
      @AdoreiMandy 7 หลายเดือนก่อน +4

      @@jdsiv3 it did. The defendants presented that lease with her signature and compared it to the first lease and the signatures were the same. @@iykeharrison9161 if you're living somewhere and lease states you're responsible for utilities and you've paid $0 for electric then you KNOW something isn't right. After a month or two they should've have been questioning either the landlord or the electric company. Either the landlady is an idiot for not verifying the tenants had the electric in their name or her and the tenants were in on scamming the electric company together. The tenants definitely knew from the lease they were responsible for utilities and didn't question not having paid for 2 years. It only became an issue because electric company finally busted them.

    If I am a renter, I know to call the electric company and get it put in my name. So I have to wonder if the tenants knew it was rigged? If so, that makes them liable too. Landlords generally switch service into their own names after a tenant moves out and before the new one moves in because they need services in order to clean and whatever to get the place ready. Also in the updated lease she says electricity is included so I don’t believe they were ever supposed to pay this.

    As an electrician I can tell that sometimes there is a shut off switch ahead of the electric meter. The son would have disconnected the wires from the switch to the electric meter. He would have installed new wires from the shut off switch to the electric panel.
    When the hydro company discovered this I am sure that they would have disconnected the electric service and had an electrician run new wires to the electrical panel. The electric meter would likely have been moved to outside the house. I wonder if the hydro company fined the homeowner for tampering with their meter. Maybe they even charged her an estimated bill for electrical usage. The electrical meter is the property of the hydro company. Only the hydro company can service the meter.

If he was prepared to steal from her, what makes her think he wouldn't steal from the leci company or the neighbours or whatever supply he tapped in to. Delusional. With the defendants never getting a bill it was reasonable for them to then assume electricity was included especially as the hand-written notes in the lease only referred to refuse and septic tank.
    Also, something dodgy about the plaintiff creating a new signature for JJs statement and her lease copy which bears no resemblance to the signature she was using prior to this issue manifesting. Maybe the son learned from the master. 🤔

    I'm glad the defendant was called out for getting free electricity for 2 years. Yeah, it was a scam perpetrated by the plaintiff's son, but the defendant knew damn well that they were supposed to be paying for electricity. They chose to do nothing and not inquire as to why they were not receiving a bill. The old excuse of 'I didn't pay because I never received a bill' is NO excuse. The amount of $ they saved by not paying for electricity far outweighed anything they would have received in the countersuit.

    • @shendisackett
      @shendisackett 7 หลายเดือนก่อน +1

      Do you get compensation from the power company? We do in the UK if the power cut lasts more than 12 hours. We pay a daily standing charge (currently capped at 53p per day) for electric and then the units we use, so even if the power is off you are still paying the daily rate. So when my power went out twice in December 2022 14 hours first time and 25 hours second time I was given £255 compensation (£75 for the first 12 hours and then £35 for every 12 hours following). I think the compensation has gone up since then as Putin made global energy prices go crazy with his war. The compensation is capped depending on what caused it. If it's a severe storm it's about £500 and like my case where it was lack of maintenance as the pipes are underground it's around £2000. I think if I remember correctly people in some European countries also get compensation. It certainly helped with having to replace a freezer full of food right before Christmas.

      In my previous house with my dad our ac didn’t work at all but I don’t like living that way. I know it’s very different in EU countries with how that works.

      @shendisackett 7 หลายเดือนก่อน

      @@elvickRULES see in the summer we all want air con as our summers are getting hotter but they don't last very long so it's a lot to pay for a few weeks. The people I know who have treated themselves to ac only had it installed in their bedroom some the living room as well. The mobile units you can buy are so ridiculously loud you still wouldn't be able to sleep. A downside to living in a bungalow is I can't throw my windows open wide either! Our power companies keep us so up to date calling and texting you end up having to ask them to stop because your phone will die... although last time we found out that their vans are all equipped to charge people's phones or tablets. So if you did run out you could go and ask them. I live in the same small town as my parents and luckily we are on different circuits so if my power goes they usually still have theirs and vice versa. Our compensation only starts after 12 hours, their view is that you can cope for that amount of time and if you don't touch your freezer nothing will thaw. In 2022 I lost count of how many power cuts we had, there was a problem on our cable and it takes a while to track an underground fault.

When my friend's bill skyrocketed the power company came out, cut the line the son had slaved in and but a lock on the box. The landlord and her son blamed my friend for the trouble they got onto.
