This woman says she has kept fish for 16 years. That either means she's lying, or has never learned a thing about fishkeepinng in all that time. You NEVER put new fish, regardless of where they come from, into an established tank without quarantining them first. It's fishkeeping 101.

I am not very experienced in keeping exotic fish tanks, but any person who owns animals (especially a large collection of animals) should know that if you are getting exotic fish (or any other animal) that you should quarantine that animal for a certain period of time (ESPECIALLY if you are ordering this animal from a source that you know very little about) to ensure that they are free of any diseases that could potentially affect the rest of your tank BEFORE you add them to your own tank. You should also acclimate them to the tank before you release them. If the temperature and tank parameters are not the same as what the fish is used to, they could get stressed and go into shock and die. Especially if you just toss them in the tank without first taking the necessary precautions (as he says in his contract that she didn't bother to read) And while this woman DID say she had a 75 gallon tank, she ordered a dozen fish from the defendant and she already had at least 9 fish in the tank to begin with....so in addition to his fish being sick, she could have over-stocked the tank and that, combined with the sick fish led to the fish dying. And from the Google search I just did, Cichlids (which is the fish she says she ordered from him) are a very beautiful, but very active and aggressive species and they can grow rather large. Their recommendation is to have 6 Cichlids in a 75 gallon tank....so if she had a dozen Cichlids (PLUS at least 9 other fish in the tank) that was DEFINITELY an overpopulated tank, based on what I am reading. They might have attacked each other because there wasn't enough space for all of them. Another thing to consider is water parameters. If her tank parameters and temperature were not stable, THAT might have a part to play in why the fish died.

When you have a new fish and you want to add him to a large think you’re supposed to quarantine them for a while and treat them for a possible disease before adding them to your tank……

I take care of fish. If she’s been keeping fish for 16 years… she should know to always quarantine outside fish from your tank. This is all her fault for not having a quarantine tank for the fish she just bought.

If she was so diligent, why did she not see it when it arrived? And if she did, why not keep it in a separate tank until the fish either died or had completely gotten better? She did that to herself. You NEVER leave a sick fish with healthy ones. And as for the other fish he delivered, the second that I saw it on the one, I would quarantine them as well just in case. Not sure why she didn’t - was it pure negledgence or stupidity

Plaintiff acts like the Defendant was at fault for putting the diseased fish into her tank. She was at fault, for she put the diseased fish into the tank and the disease killed the remaining fish. She put them into the tank, not the defendant.

Every fish and reptile keeper I know knows you have to quarantine new animals because of this exact reason. The new ones may be sick or have a parasite that you can’t see so you keep them separate to make sure they’re not sick before you introduce them into your collection. Parasites and illnesses can wipe out a large collection very quickly.
