5 Years Of Shreya Singhal Judgment : Apar Gupta (Internet Freedom Foundation)

Today marks the 5th anniversary of Shreya Singhal v Union of India. It is an integral piece of India’s wider internet rights tapestry.
Shreya Singhal v UOI was viewed by many as a seminal constitutional win for people's civil and political freedoms over the internet. However, five years hence political, public policy and legal development cast those victories in doubt.
Five years on and even the victories offered by Shreya Singhal feel diluted. For instance our work at IFF has demonstrated that despite Section 66A being termed as unconstitutional it has continued to be applied. Even when it comes to social networks we see new challenges with trust and safety, and online misinformation/disinformation campaigns. Yet this is used as an impetus for the Government to get online intermediaries to self-censor/pre-filter online content. Second, the rules governing these players are being viewed as a backdoor to compromise encryption, people’s privacy and fuel surveillance. Finally, website blocking orders under the Information Technology Act, 2000 continue to be administered with no transparency.
