Most likely screen was replaced with non OLED cheaper LCD or it was dropped that caused the flex cable to get damaged.

Look up “device info” and see the OS. It should say it is on iPadOS/iOS/MacOS. If it says Android, it is fake.

I just brought refurbished iPhone XS Max 512gb from back market. When I was setting up for the first time I had to update it to the latest IOS update 15.3. Will a fake one ask you do that? Fake won't have iOS software as they long on Android software and it's normal for warranty to expire as its been 3 years already. As long as you can sign in to iCloud account.
