    The fact that just because Ashley miraculously survived means that guy wasn’t charged with murder and won’t spend his life behind bars is maddening. The success or failure of someone’s murder attempt shouldn’t matter.

    • @Jesusluvz

      This. I’ll never understand it myself. The attempt alone should warrant looking at the death penalty depending on how they were attempting to go about it. At the very least, life in prison.

    It's wonderful that she's alive and that she walks, talks and has even managed to have children - but I do hope no one plans to let her attacker out on parole. He may have initially broken her neck accidentally, but he spent a LONG time trying to strangle her afterwards. Effectively he's a killer and he should be treated as such.

      I don't like the word miracle as commonly used in America.
      Whilst clearly her being alive is not against the laws of physics, we could actually work out how she survived, and I'd begin with the belt breaking ie he would have continued to strangle her if the belt didn't break from the strain.
      However, when the word miracle is used in America (I stipulate America because really its not common elsewhere) its implied that some non evidence based supernatural cause was involved (when clearly this is not required here, or anywhere really).
      Basically religion has made the word miracle and say even spiritual and other such descriptive type words, highly tainted with nonsense.
      If however you weren't referencing a divine intervention was involved (Lol) then apologies for making a mountain out of a mole hill. But if you were in fact inputing some non natural agency? Then this only puts down what we know of biology and obviously modern hospital healthcare. Clearly she would have died in the 16th century, but we are now able to help many people even on the brink of death.

      @@awaken3840 We THREW out all claimed Jesus sins and replaced them with the far superior secular laws method. You know that right?
      A MIRACLE must be something that can not be done by naturally known things. Say like a second Earth all of a sudden popping into existence, or even a woman popping into existance out of nothing! So far no known miracles ever happened. BUT a lot of baseless claimes of miracles happening though.
      How did you rule out that she was clearly not dead and survived the 30hrs in the bush lying there? Did you think that's impossible? YOU have a very low level of understanding. And this was the very point of my earlier reply, how's America today?

    One theme I've noticed in many of Mr Ballen's stories is intuition: people ignore it and get into trouble, but sometimes they listen to it (like in this case where Ashley's mom and the police intuited that she was in real trouble) and that leads to a better outcome.
    I'm reading "The Gift of Fear" right now which sheds some light onto how our intuition is often very accurate. We're taught to ignore it, but it's a very important and often life-saving tool. I'm now re-learning how to heed my own intuition 💙

Otherwise you are almost as bad as he is. It's not like she was 16 and he hit on her and she decided he was too cute to say no to. He started years before that, when she was going through a lot of hormonal and physical and emotional changes. How many others agree, or think along the same lines:
    This case & others similar, are NOT "attempted" murders! Its MURDER, period!
    He had gone above & beyond, to strangle her, dumped her body. He THOUGHT he had truly killed her. That, is murder.
    Edit/Add on:
    A lot of commenters misunderstood. I'm not meaning the actual existing laws. What I'm meaning is: how many would agree, we should make a law like that.
    Where even though it was a failed attempt at murder, the ones who had definitely tried hard enough, done enough and thought the victim was dead!
    My apologies, I don't explain some things very well.
    Here's an example of what I was trying to say:
    I just saw a case this week: man kidnapped a little girl, raped, severely beat her, slashed her neck ear to ear, but miraculously missed her jugular. He thought she was dead, went on the run for 19 years! When they finally caught him, it seemed too little to charge him with just attempted murder!
    Who else thinks there should be an exception, a law for cases like that, and charge him with murder or culpable murder. Cuz, he did more than just "attempt".

      Maybe if the government cared about more than just money, real justice could be served. The government seems dedicated to ruining people's lives and doing horrible things one way or another. They put cannabis, which is an amazing medicine that stops seizures in children on Schedule 1, the same as heroin, because they do not care about people. They only care about money and controlling people, because they are weak and can't control themselves. They are not mature adults.

      It’s just a matter of technicality. He technically failed to murder her hence the attempted part. That said an attempted murder doesn’t automatically mean a lesser punishment. It’s all treated on a case by case basis. In the end he got a 20 yr sentence, which is the average sentence for most straight up murder charges.

    • @babblingbrook.
      @babblingbrook. 2 ปีที่แล้ว +1

    • @yorkiesweetpea23
      @yorkiesweetpea23 2 ปีที่แล้ว +4

      Look at all those cases where there wasn't even a real "attempt"? Where the wife was caught hiring hit men, and luckily the hitmen went to the police. The police staged the murder scene with help of the husband. And in end, those wives were all charged. Albeit charged for conspiracy to commit FIRST DEGREE murder, and were sentenced to huge sentences. (For ex. Dalia Dippolito case, is just one out of many.)
      These people weren't charged with conspiracy for "attempted murder". These spouses all thought the job was done.

  • @BelakorVenator

    Should have been more than “attempted murder” and 20 years. He had many opportunities to stop trying to kill her, and he didn’t stop until he thought she was dead. None of his actions would have been different if she had died, so none of the consequences should have been different just because she somehow survived.

      Attempted murder is to murder as manslaughter is to battery. Intent and outcome both matter. If you only meant to hurt someone and you kill them, we punish that more severely. If you meant to kill and only hurt, it’s less severe. It’s at least logically consistent.

He had a chance to stop and try to save her. Had she had died (THANK GOD she DIDN'T) he would be in Prison probably the rest of his life, but because she survived ( thank God) the charges are reduced quite a bit. Depending on the jurisdiction, the sentences for statutory rape and attempted murder may have been served concurrently (at the same time) instead of consecutively (one after the other). If that was the case, once they got the conviction for the longer sentence (attempted murder), there'd be no point wasting money on an trial for statutory rape since it wouldn't add it his sentence.
      Looks like he pled guilty, so the 20 years may have been a reduced sentence in exchange for avoiding a trial. He is eligible for parole in 2024.
