ഇപ്പോഴത്തെ ചീഫ് ജസ്റ്റീസ് ഇൻ്റെ അച്ഛൻ ചീഫ് ജസ്റ്റീസ് ഇന്നും ഓർമകളിൽ നിൽക്കുന്നത് ADM Jabalpur എന്ന കുപ്രസിദ്ധ വിധിയുടെ പേരിൽ ആണ്. അടിയന്തിര അവസ്ഥ കാലത്തെ ആ വിധിപ്രകാരം അടിയന്തിര അവസ്ഥകാലത്ത് ജീവൻ പോലും മൗലിക അവകാശം അല്ല എന്നായിരുന്നു. ഇപ്പോഴത്തെ മകൻ ചീഫ് ജസ്റ്റീസ് ഇടതു പക്ഷത്തിൻ്റെയും മാമാ മാധ്യമങ്ങളുടെയും കണ്ണിലുണ്ണി ആണെന്നുള്ളത് തന്നെ ഒരു ഭീഷണി ആയാണ് കാണേണ്ടത്. പിന്നെ ശബരിമല സ്ത്രീ പ്രവേശനവുമായുള്ള വിധിയും നിയമപരിജ്ഞാനം എത്ര തന്നെ ഉണ്ട് എന്നുള്ളതിൻ്റെ തെളിവാണ്. Art 25(b) യും Art 26 ഉം തമ്മിലുള്ള വ്യത്യാസം പോലും അറിയാത്ത വുക്തി ആണ് ഇപ്പോഴത്തെ നമ്മുടെ ചീഫ് ജസ്റ്റീസ് എന്നത് ഒരലങ്കാരം ആയി കാണാൻ സാമാന്യ ബുദ്ധിയുള്ള ആർക്കും കഴിയില്ല.
കൊളീജിയത്തിന് പകരം വരുന്ന സംവിധാനം സര്ക്കാര് നിയന്ത്രണത്തിലായിരിക്കും അതോടെ തീര്ന്നു..

How can a judge or a justice decry a system of which they hv bn direct beneficiary. All directly or indirectly benefitted by collegium. It is not someone is more comoetent or kess competent. From among whom hv they bn found competent and by whom? Judges to d highest court shd hv passed thru at least 3 levels of screening and experience from sessions, thru to district court, hi court and then to Supteme court.

Once parliament passed an amendment , and ratified by states. and signed by president, it became part of the constitution. Any order, decision or judgement of supreme court is law to all courts. in India, but NOT law of the land unless sanctioned by both houses of parliament

How do a judge's son becomes a judge in a higher judiciary? How did this collegium system came in to being? It is only in this country, that this type of illegitimate system remains. The parliament and state assemblies must pass a bill de recognising this collegium system, and the president must give assent to that bill. Otherwise the status of our judicial system will be in question. The constitution envisages the executive the aughority to appoint judges to high courts and supreme court, in consultation with the CJI and this is to be re instated.
