I mean of course in general I think the police and the prison system should be more about helping than punishing, so not just her. She could still be in danger or if she no longer is, someone probably is. I personally would be lenient about charging someone, if it's not a serious offence and it's clearly some type of a trauma response. Also being that drunk does make it harder to comprehend the situation, so I think punishing her for not giving away her address immediately wasn't necessary (and it likely was related to her fear related of trafficing aswell). The girl needs help, not punishment.

I'm sure you're familiar with courts not sending people to prison and instead sending them to get mental help..... In her case I didn't say she shouldn't have gotten into any trouble, only that some of those extra charges did not seem necessary and she should get help. People genuinenly do have issues which cause them to act a certain way, so it's not hard to understand that trying to solve those problems does more good than punishing the actions does (especially in her case when she didn't actually do anything that hurt someone, she was just hard to deal with).

Nah every time without fail. I had a white friend I constantly debated about cops, he would always tell me stories about how he and his hometown sheriff went back and forth like they were dukes of hazard characters. We were staying in my trailer one night and when the cops threatened to search us for guns he said sumn slick about a warrant, which lead to one of three officers mentioning they didn’t yet have body cameras in our towns police force, and the other two agreeing. This was at 3 am in like 40 degree weather after they literally shook my trailer to wake us up. They would always come by and harass us at that time for several months in 2017. Luckily things never got physical, but as scared as I was that night I knew my friend got a small taste of how naive his blanket statements about cops had been.

The “we can arrest you if you don’t take the breathalyzer” works like this: If you refuse the sobriety test or breathalyzer then it defaults to the “officer’s observations”, and if the officer believes you’re drunk then you are arrested. You should still always refuse the sobriety test because they are stupid and designed to make it look like you’re drunk even if you’re not. Refuse the sobriety test and just go to court where they will have no evidence against you other then the officer’s “word”.
In most states you still lose your license if you do that. Just refusing the breathalyzer alone is sufficient, it has nothing to do with whether or not you are convicted of a DUI. I think the first "offense" of refusing the breathalyzer is 1 year suspended. It isn't a criminal punishment, so you don't need to do a crime; it's the revocation of a "privilege" you received (the license) for breach of contract essentially because in the manual is explicitly says you will lose your license for declining a breathalyzer. I think most people are more concerned about that, because it is pretty uncommon to actually go to jail for just being "caught DUI" without having been in an accident. The license being suspended for a year is basically the first strike for a conviction of a DUI, and you can even get that shortened if you do some AA or something agreement in a plea, so there is no benefit to refusing it since failing a breathalyzer is NOT grounds for suspension, since they let the case play out to determine the penalty and so you then have to be convicted or plea. Maybe in some states your advice is valid, but certainly not in mine. You are just going to fuck yourself more and make the night go a lot slower. And people who are on their 3rd+ offense should be losing their license permanently, so I am only talking about first offenders; maybe on a third offense you are actually trying to avoid jail time so taking the guaranteed suspension is worth it to you. Unless you are black ofc, then obviously you are getting shot either way.

Where I live in Hasan’s favorite state (Ohio), there is no penalty for refusing sobriety tests, including breathalyzer, so the only reason to go along is if you believe you can *convince* the officer that you’re not drunk. But pretty much all of the time, they’ve already made up their mind, so here you should always refuse. They’re just doing the sobriety test to find additional evidence against you.

Secondly, consult a lawyer in your local area. You never need to consent to a roadside sobriety test, or to a preliminary breath test (breathalyzer) on the road. Especially the roadside sobriety test. Don't do it. Cops aren't realistic experts, and there are numerous ways that even sober people can fail. They can arrest you anyway. But usually, if they pull you out of the car to perform a roadside test, they're probably going to arrest you anyway and a failed roadside test can't help you in court. As for refusing to take a test at the station - in probably every state you are required to take a blood or breath test at the station/at a hospital, per the issuance of your license. I have heard some DUI lawyers in some jurisdictions argue around that, but it's real risky. Like I said, consult a local attorney in your area. A couple other things, never try to get out of one crime by admitting to another, such as "I was only speeding 5mph" - that's still admitting to a crime. Don't do that, lol. Don't ever admit to drinking. Please exercise your right to remain silent. Don't answer questions. Don't admit to "only one drink" or "I only had two drinks". For starters, almost everyone says they only had two drinks. It's a super common thing people say to make it seem like their being honest, but hiding the true number. The cops won't believe you. Moreover, even if you blow under the limit, you can get a DUI. If you admit to having a drink or two, you admit to breaking the law, basically. Speaking of exercising your right to remain silent, remember that in the US, this right is not self-activating. You need to declare that you are exercising your right to remain silent. @@christophergreen6595 personally, I don't drink and drive. I have no issue with taking a PBT (preliminary breath test.) If you read what I cautioned, it was too avoid the roadside sobriety test. PBTs are still inadmissable in court, but you won't fail one because the cop doesn't adequately understand gaze nastagnis, or because you have bad balance, etc. so yeah, feel free to take a PBT if you feel comfortable doing so. I just noted that they aren't ever legally required.
It literally says in the manual and on the paperwork when you get a license in my state that refusing a breathalyzer means your license is suspended even if you aren't later charged with a DUI. It is a contract violation more than a 4th amendment issue, because you don't have a constitutional right to a driver's license. This is just non-sense advice from sovereign citizens and from people on their 3rd+ DUI who are facing serious jail time so they are happy to eat losing their license to fight the DUI.
To be clear, my point was that most people can't afford to lose their license for a year, so potentially getting it back sooner via plea agreement rather than being guaranteed the maximum time you would lose it from a conviction anyway if you refuse the breathalyzer. It is not a philosophical question about the rights of the government or the principle. With a DUI, you fucked up, and you just have to take the least bad option to get past it. Either lose your license + have a court battle, or just have a plea and lose your license for a shorter time if you go to AA or whatever.

You can refuse the tests if you're smart enough and go right for a breath test. The SFSTs are intended to gather more evidence against you. I had a white friend I constantly debated about cops, he would always tell me stories about how he and his hometown sheriff went back and forth like they were dukes of hazard characters. We were staying in my trailer one night and when the cops threatened to search us for guns he said sumn slick about a warrant, which lead to one of three officers mentioning they didn’t yet have body cameras in our towns police force, and the other two agreeing. This was at 3 am in like 40 degree weather after they literally shook my trailer to wake us up. They would always come by and harass us at that time for several months in 2017. Luckily things never got physical, but as scared as I was that night I knew my friend got a small taste of how naive his blanket statements about cops had been.

The “we can arrest you if you don’t take the breathalyzer” works like this:
If you refuse the sobriety test or breathalyzer then it defaults to the “officer’s observations”, and if the officer believes you’re drunk then you are arrested.
You should still always refuse the sobriety test because they are stupid and designed to make it look like you’re drunk even if you’re not.
Refuse the sobriety test and just go to court where they will have no evidence against you other then the officer’s “word”.
In most states you still lose your license if you do that. Just refusing the breathalyzer alone is sufficient, it has nothing to do with whether or not you are convicted of a DUI. I think the first "offense" of refusing the breathalyzer is 1 year suspended. It isn't a criminal punishment, so you don't need to do a crime; it's the revocation of a "privilege" you received (the license) for breach of contract essentially because in the manual is explicitly says you will lose your license for declining a breathalyzer. I think most people are more concerned about that, because it is pretty uncommon to actually go to jail for just being "caught DUI" without having been in an accident. The license being suspended for a year is basically the first strike for a conviction of a DUI, and you can even get that shortened if you do some AA or something agreement in a plea, so there is no benefit to refusing it since failing a breathalyzer is NOT grounds for suspension, since they let the case play out to determine the penalty and so you then have to be convicted or plea. Maybe in some states your advice is valid, but certainly not in mine. You are just going to fuck yourself more and make the night go a lot slower. And people who are on their 3rd+ offense should be losing their license permanently, so I am only talking about first offenders; maybe on a third offense you are actually trying to avoid jail time so taking the guaranteed suspension is worth it to you.

Where I live in Hasan’s favorite state (Ohio), there is no penalty for refusing sobriety tests, including breathalyzer, so the only reason to go along is if you believe you can *convince* the officer that you’re not drunk. But pretty much all of the time, they’ve already made up their mind, so here you should always refuse. They’re just doing the sobriety test to find additional evidence against you.

First off, don't drive drunk. Get an Uber, a taxi, or arrange a ride.
Secondly, consult a lawyer in your local area. You never need to consent to a roadside sobriety test, or to a preliminary breath test (breathalyzer) on the road.
Especially the roadside sobriety test. Don't do it. Cops aren't realistic experts, and there are numerous ways that even sober people can fail.
They can arrest you anyway. But usually, if they pull you out of the car to perform a roadside test, they're probably going to arrest you anyway and a failed roadside test can't help you in court.
As for refusing to take a test at the station - in probably every state you are required to take a blood or breath test at the station/at a hospital, per the issuance of your license. I have heard some DUI lawyers in some jurisdictions argue around that, but it's real risky. Like I said, consult a local attorney in your area.
A couple other things, never try to get out of one crime by admitting to another, such as "I was only speeding 5mph" - that's still admitting to a crime. Don't do that, lol.
Don't ever admit to drinking. Please exercise your right to remain silent. Don't answer questions. Don't admit to "only one drink" or "I only had two drinks". For starters, almost everyone says they only had two drinks. It's a super common thing people say to make it seem like their being honest, but hiding the true number. The cops won't believe you. Moreover, even if you blow under the limit, you can get a DUI. If you admit to having a drink or two, you admit to breaking the law, basically.
Speaking of exercising your right to remain silent, remember that in the US, this right is not self-activating. You need to declare that you are exercising your right to remain silent. I know it seems stupid that you need to declare that you're being silent, but according to the SCOTUS, if you don't declare it, it actually can be used against you. Stupid as shit, but there it is.

If you read what I cautioned, it was too avoid the roadside sobriety test. PBTs are still inadmissable in court, but you won't fail one because the cop doesn't adequately understand gaze nastagnis, or because you have bad balance, etc. so yeah, feel free to take a PBT if you feel comfortable doing so. I just noted that they aren't ever legally required.

It literally says in the manual and on the paperwork when you get a license in my state that refusing a breathalyzer means your license is suspended even if you aren't later charged with a DUI. It is a contract violation more than a 4th amendment issue, because you don't have a constitutional right to a driver's license. This is just non-sense advice from sovereign citizens and from people on their 3rd+ DUI who are facing serious jail time so they are happy to eat losing their license to fight the DUI.
To be clear, my point was that most people can't afford to lose their license for a year, so potentially getting it back sooner via plea agreement rather than being guaranteed the maximum time you would lose it from a conviction anyway if you refuse the breathalyzer. It is not a philosophical question about the rights of the government or the principle. With a DUI, you fucked up, and you just have to take the least bad option to get past it. Either lose your license + have a court battle, or just have a plea and lose your license for a shorter time if you go to AA or whatever.

You can refuse the tests if you're smart enough and go right for a breath test. The SFSTs are intended to gather more evidence against you. Listen this comment doesnt matter that much specifically because it doesnt relate to the main point of the video but some of us really do have a tolerance for cannabis from using is medicinally and sometimes maybe more, but i genuinely do not get high off cannabis anymore, not enough to alter my mind enough that i lack control of myself, my thoughts, and my actions. as a white women in america, can confirm ive never had an interaction with a cop that left me fearful for my life or in any sort of legal trouble... and i was in a situation where we had officers pull guns out on us because they thought we were stealing cars (we were actually just smoking weed) anyways the fact that it didnt even occur to me to be scared speaks volumes.
the third one, the cop was so chill and had rizz, I think the woman flirted with her because she like him, not just because she wanted to get off easy
