PROGRESSIVE DISCIPLINE: give the employee the opportunity to fix the behavior or problems at the workplace.

You are correct if the company agrees to it, But it is not required by law. I've been in my Union for 38 years and the Union proposes progressive discipline every contract and the company refuses every time.

What can I do if my union didnt really give me a good defense. I felt my union reps were more on the side of my employer. I workd for a large healthcare organization and they have a lot of influence. I was set up to be fired, I my grievance hearing on Monday. They don't even prepare us to tell us exactly what will happen or how the employer works. I had to defend myself, and was yelled at by one of the union reps for defending myself and not keeping myself quiet. I was told that it was my fault they fired me and did more digging on the investigation. But I feel I was set up because I requested accomodations for my mental disability. I had to request fmla for all the stress I was having with daily migraines. And a few days later after returning from my disability I was terminated. I alos feel it they had put me straight on a level 4 due to retaliation and discrimination due to my age & disability. Please help, need guidance on how to properly defend myself and win my case. Thank you.

the union wil never allow its members professional representation. Like afscme-SERIUOS liars and cowards This bunch of backstabbing incompetents worship management and crap on its members. Bigger liars than politicians. These dishonoring cowards let me get fired for a reg that is not in the contract. Best part of that is the fact that the union reps didn't even know this. More they didn't care. DECERTIFY! Absolutely worthless. Members need to understand that afscme will take your money. A classic example of overpaid underworked union reps-worse than government workers. The gangs in Haiti have more integrity than afscme. DECERTIFY! An independent investigation will show that there is more corruption in afscme than in any government on the planet.

My employer refuses to include progressive discipline in our contract, Personally I have minor write ups from 12 years ago on my permanent record, So I have an excuse to refuse any of those jobs! What's really sad is that I've always busted my ass for the company until I got a chicken shit know it all manager.

Companies are not required to have discipline policies

Then how do they justify termination for just cause?

Union companies are - that's one of the protections bargained in the collective bargaining agreement.

There is no law that requires a company to have progressive discipline nor a company handbook. I've been a union member for 38 years and not every contact has a discipline policy.
