    Section 1 of the Land Use Act serves the function of "eminent domain" in the UK where even freehold property can be revoked for "public purposes".
    Certificate title is "prima facie" evidence of ownership. My point is virgin lands are safe to acquire in Nigeria.

    There’s no such thing as virgin land in Nigeria. All land belongs to the government/ state government due to changes in the law around 1978. The government recognises that ethnic nationalities/ tribes unofficially lay claim to what they perceive as their historic ancestral Land and so will make it easy for these tribes to Officially (Legally) own their land. To own their land legally these tribes have to go register the land in government house and receive a Certificate of Occupancy. This register is called the gazette. The Gazette records the land belonging to the tribe and the land the government kept for itself. Tribal land registered by tribes (gazetted) and for which they receive Certificate of Occupancy is safer to buy than unregistered tribal land. The reason why tribally gazetted land is safer to buy is due to the fact that when tribes go to register their land the government sometimes don’t let them register all the land, the government sometime keeps some of the tribes land for itself. The part of the land government reserves for itself is called LUGA or Land Under Government Acquisition. The part owned by the tribe is said to have been Excised to them by the government and they receive Certificate of Occupancy. If you ignorantly buy from the Tribe a pieces of the land that government reserves for itself (LUGA) you run a high risk of loosing the land when or if the government decides to use the land at some point in future.
    You can still buy land reserved by the government for itself if you make official enquires and the government lets you know that it has no plans for the land and that you may buy some of it (Excised or cut to you). If the government lets you buy this land you’ll be given an Excision, it will be registered (gazetted) and you’ll receive a Certificate of Occupancy title. If you buy land from the tribe that the tribe registered with government (gazetted) and for which they received a Certificate of Occupancy the tribe can also issue you their own Certificate of Occupancy title since they legally own the land.
    Note that the process of Tribe, Community, Companies, individuals getting land officially endorsed to them by government through government Excision, Gazetting and receiving certificate of occupancy is long and tedious. It requires Tribes, Community, Companies, and Individuals and so on hiring layers or sponsors etc who will then lobby the government on their behalf. Even when government is ready to listen and do what is asked of it, Tribe, Community, Company, Individual etc will need to have all the necessary officials present at the Land registry and Surveyor Generals office. The government will then need to send its representatives to the land to establish relevant beacons and demarcations that separate the land government want to keep for itself from land that Tribe, Community, Companies, individuals etc are Claiming (tribe/Community) of wanting to purchase (Companies individuals etc). This period can be classified as Excision in Process and could take a very long time ,

      Akpo, first of all I want to start by thanking Bayo for doing his due diligence on the land and secondly like you mentioned government can decide whatever they want on the land you bought after 99 years or even earlier in some cases (eminent domain).       Hello Mr Akpo. Thanks for chiming in.
      Here is what i have learned. Legally and theoretically speaking, all lands in Nigeria are held in trust by the government for the benefit of all Nigerians. In practice however, it is misleading to think that there are no virgin lands in Nigeria especially in extreme rural and underdeveloped communities.
      First, the illiteracy rate in the country is at all time high. Thus, the people are less concerned or ignorant of registering their lands as required by law. But this doesn't mean they do not own the land. Even where it is registered, the owners are still with the legal right to sell the land not the government. Hence, if we keep ourselves bound or limited by this, then lots of transactions with amazing opportunities may be denied (
      Although, there is a risk associated with this, the risk is mitigated by ensuring due diligence to the extent that the true sellers of the land are the owners and that the land is not under government acquisition.
      The step for us is to register the land with the government and acquire the C of O . We already went through the survey process with the licensed surveyor

      Akpo, I would also say that Bayo would not have gone into this with his eyes closed. Given the nature of Nigerian land, it's a process and definitely lots of homework and research involved.
      Bayo pretty onto it from what I've learnt and observed through his videos. He doesn't strike me as the sort to mislead people astray, if you watch his videos it speaks for itself. I am wrapped that he's doing the home work for me for when I move to Nigeria. And when our boarders open here in Australia I know exactly what I'm walking into. I also think Bayo is very respectful and a proud of his Nigerian heritage as shown again throughout his videos. So that's all I want to say as a foreigner. And no disrespect to you Akpo, I love your wealth of knowledge and experience in this field. Thank you too, and I've married a Nigerian he's from south east, Igbo land.

    A big issue in Nigeria is that people try to sell off land receive payments for lands that they have no legal rights to.

      Buying land in Nigeria is rather more straightforward and transparent than buying land elsewhere in Africa. After 99 years the land is still largely yours. Your offspring or relations merely need to renew documents, if at all. You’re relations are favoured and not charged.

    Ever since I found out about the Land Use Act 1978, I've been wary about buying property in Nigeria. Any land purchased is never really yours and can be grabbed by the government at any time. The maximum tenure you are allowed to occupy that land is 99 years after which you (or your children) will have to re-purchase it from the govt at a new "unspecified" rate.

      it cannot be grabbed by the government at anytime without compensation. but yes the 99 years clause is there. i think you might just simply need to renew.

      In Canada, you pay tax yearly on your house. If it’s just a land, you pay tax also. I’d say Naija system is way better
