If he's dying in a year or less. There's little point in divorcing him. By the time the case works its way through the system, he'll likely have passed away. Divorce at that point is a waste of time and money. All she needs to do is wait him out. If he dies still legally married to him, she'll get everything anyway.
Unless he committed major crimes even a prosecutor will be leery on prosecuting a terminally ill defendant. In all likelihood, by the time case works through the system, he'll likely pass away, a waste of state/government resources. Better to simply wait him out.
First of all, the husband demanded the divorce, when he thought his wife was dying. Second, divorces in Japan, and possibly Korea, are much easier to obtain than here in the USA.
In these stories they always think a divorce can happen in a matter of days & is somehow legally done the very instant the papers are turned in.
