You pay settlement if you don’t want the hassle of going to court. The family of the person who died have the right to sue you as much as you have the right to defend yourself in court. You get arrested and you wait in jail not prison during the process. If you have a dash cam and can prove your innocence right away. You don’t have to go to court nor do you have to pay a settlement.

Dash Cam is inexpensive but not sure how it is going to bail you out of trouble if a suicidal driver decided to hold you responsible for his actions. As a Filipino living in the US, I am constantly monitoring the local tv news in the Phils and often they aired some serious traffic accidents caught on dash cams. I could not fathom why on earth the innocent drivers are usually charged with reckless imprudence resulting in personal injuries or death. Only in the Phils, the innocent drivers are usually held in prison pending further investigation. You might be wondering "what kind of justice system is that"? My guess is that the Phils inherited the Saudi Arabian mentality in the 80's, *if you were not here, the accident will not happen*
Hi Finn. I believe the police officer you asked is speaking from his/her own experience. Unfortunately, his or her opinion is not based on the law. The driver is not automatically at fault. Unfortunately, this is the erroneous belief of most of our traffic enforcers and police traffic investigators. The criminal charge for a driver who had been involved in a traffic collision that resulted to physical injury being sustained by or death of a pedestrian is the crime of reckless imprudence resulting to serious/less serious physical injury/ies or homicide. Please take note of the avoidance of the use of the word "accident". By the very definition of "accident" if used in such case completely absolves the person perceived to be at fault of any criminal liability. Law students are often told by their law professors in Torts class to avoid using the word "accident" to describe this sorts of cases. The determination of whether or not the driver committed reckless imprudence by his or her own acts or omissions completely rests in our judicial courts. However, on the question on whether or not the victim (in case of physical injury) or victim's family (in case of death) will pursue legal action/s, criminal or civil case rests on them, save of course of an out-of-court settlement with the driver or the owner of the motor vehicle. People often settle because of the costs of litigation and slow judicial process, which our Judiciary has been addressing with substantial reforms. Moveover, if the victim was completely at fault (negligent or suicidal), as long as the driver was driving with due care and diligence, complying with our traffic laws or ordinances, the latter will be adjudged innocent. There are clipped on racks. Usually they are clipped on at the rain gutters of the car roof. There too are removable roof racks that are belted thru the doors.

I was on that street to get to Borbon when I was 15 yrs. old. I was a Rena there. Someday, please go to my mothers hometown which I haven't seen in 50 years. That would be the world to me. The old folks are dying and the new generation is taking over. Borbon is never mentioned, I want to know and see what's out there. It's because of Borbon I have a fear of the Ocean. Dove off a cliff near my lola's house and landed on top of something that was bigger than me. I was so scared I swam out so fast that I stepped on a boganvillia thorn on my way out.
It's true Finn. It was happened to our truck driver. A drunk man crossed over EDSA with a green light and he was accidentally hit by the side mirror of our truck and he died. Even if it his fault we were charged of his death. Since it's his fault and proven that he is drunk, they compromised us to pay the burial only. But still we spent a hundred thousands for his burial. I think it’s the same here in the US. Pedestrian ALWAYS have the right of way .kinda sucks especially if the person was hit because he/she is jaywalking. It’s still the driver’s fault most likely will be the court’s ruling.

If you attach a roof rack and keep it on permanently you have changed the original condition of the car and will need to register with the LTO. If you are stopped and have not registered this you will be fined. Costs about P130 to do this.
You need to carefully research and shop around on the best car insurance here. And of course always drive safely since things can get crazy here on the road
Not sure why we even would bother getting car insurance (Full coverage that includes bodily injuries and death) if your always liable for the death regardless of fault, unless it's a new car that's financed and we have to. I'm guessing the insurance company would NOT pay any damages towards the persons death, if you were determined not to be at fault. So, a catch 22 scenario. I might just go cancel my insurance, LOL..... I understand what you were saying though, kind of messed up...But, we know where we are.
Here in US..you can't drive without insurance..for instance..you have a insurance but you cancel it...the insurance will report to the police and to the Dept. Motor Vehicle...then they will send you a letter that your car Tag no. has no insurance and they will give you 10 days to report your new insurance failure to comply you will be penalize everyday without insurance and you should not drive your car because your Tag is now reported in all police.

If you hit someone with your car in the Philippines, you're at fault. It is presumed that you are negligent unless you can prove in court that you're not at fault. This does not apply only in the Philippines, other countries as well. Have you watched videos in other countries where people ran in front of moving cars and pretend that they got hurt and throw themselves in the ground? That's how these people make money out of the driver's car insurances. That's how some people extort money from these unassuming drivers. These people know that the law says that if you hit someone, you're at fault no matter what. That's how they make money. That's why it's always useful to have a dash cam in your car (front and back). It helps. There are also some instances where in, if death occurred let's say you hit someone crossing the street and this person died, the family of that person may ask you to pay for the funeral and other expenses. That is if you amicably settle with that person's family instead of hiring your own lawyer and undergo litigation. This is just my 10 cents. It was my first time to drive in the Philippines last year and I am always worried that I might hit a motorbike or a tricycle that just appear anywhere. In general, the driver who hits the other car, is the one responsible for the accident. So if part of the other car had crossed your lane in front of you, just yield to him/her!
That's why driving law in the Phil is crazy...here in US...if a car hit your rear...even let say you stop suddenly because a car at your front brake and suddenly a car hit your rear...it's always the car hit your back at fault...one time a crossing road with a stop light ...an SUV is crossing it's because it's a green light but a speeding car who beat a red light hit the rear of the SUV and the car driver is dead on the spot...the SUV turn 3x because on the impact...but the driver of the SUV is not at fault and not hurt ...he went home and not charged of the accident bec. if not your fault you won't be charged ..that's the law here in the US...
I would say most of us don’t have life/accident insurance. If you have a full coverage, then that should cover everything including third party liabilities - damage to the other car/cars involved, loss of life and property damages which should give you a peace of mind if and when an unpredictable event happened. Check with your insurance agent and be sure you read the fine prints as well.
That is indeed a stupid law in the Philippines. Here is a man driving with all caution and out of nowhere comes a 4 year boy running, Bang! ... the poor little boy is dead, the driver is charged, has to pay for the damage, and may even end up incarcerated. When in REALITY, it should have been completely fault of the parent/s for negligence. Law makers should look into this and make changes, especially now that most vehicles and places have cameras/CCTVs already.
You need to watch or re-watch more GMA or Philippine news about fatal car accidents where the driver is right to know how road rules/laws are conducted.
My partner which is german, he always have extra for BI (bodily injury) and PD (property damage) up to 2M pesos. Of course with extra premium. His logic, as foreigner always have to pay more in case of accident. But so far so good, he always drive carefully specially after a bottle of beer. In germany he can't drive at all after a beer unless alcohol frie.
i've heard a story where a bus driver hit someone on the road, injured the person but the person was still alive, but the bus driver reversed and drove over that person again to make sure he/she is dead because the hospital cost would have been higher than the funeral costs... crazy when you think about it

If your a foreigner in the Philippines and you get into any issue with the police or a serious accident, the very first thing to do is hire a Filipino lawyer to represent you. You have no adea how the laws are slanted against foreigners and the legal situation is rather corrupt at many levels, Did you know a foreigner can "go to jail" for insulting a Filipino?! You are automatically at a disadvantage being a foreigner because they think you have money and they will try to take advantage of the situation. Also, having a dash cam is definitely required, especially if you own a newer car. Believe me, I know.

It doesn't matter how carefully you drive here in the Philippines. If the other person is driving recklessly and get killed in the process, YOU will be arrested. This is a stupid law, but only one of many stupid laws in the Philippines. If you are going to live here, it is vital that you understand the laws as well as you can. This is one of those laws that applies equally to Filipinos and foreigners. Not all do. On the other hand, the belief that the foreigner is always in the wrong is a myth. I have been in five accidents in eleven years, and I was only declared at fault in one of those. Here is a key, though. In the four cases where the other driver was at fault, I suggested that each of us take care of the damage to their own vehicles in three of them. In the fourth case, a lady tried to do an illegal u-turn in front of me and caused extensive damage to my car. Luckily, she had good enough insurance that it took care of most of my costs.

Think ten times as many vehicles on roads not built to support them and drivers who don't know the laws and don't care even if they do. I drove for 44 years in the US with only a couple of minor accidents, but here people just do stupid things all the time. A good analogy to the traffic situation is a comparison of mall usage between the US and the Philippines. In the US, you seldom have to alter your course to avoid another shopper in a mall, but there are so many people in Philippine malls that you have to keep your head on a swivel to avoid getting run over. The roads here are like that too. Three of my accidents in the Philippines happened when my vehicle was stopped, and motorbike drivers ran into it because they weren't looking where they were going. Even if motorbike drivers do know you are there, they will often act like they don't care and try to fill any gap on every side of your vehicle. And drivers of larger vehicles (trucks and buses) will often try to use their size to force other drivers out of their way. Half of the drivers here seem to have received their licenses as prizes from Cracker Jacks boxes. The entire system is corrupt, so that isn't too far from the truth. You can pay a little more for a license and never take any test ( written or practical). Finn is correct that you can be charged in case there is a death, What Finn didn't say is that if somebody dies, the other driver (regardless of fault) is charged with MURDER, so it is a serious situation. It can usually be mitigated by a payment to the family, but that is dependent on an agreement being reached.

I'll say though, that driving in Paris, France, 40 years ago was pretty challenging, everybody was bumping each other's cars all the time. I was on that street to get to Borbon when I was 15 yrs. old. I was a Rena there. Someday, please go to my mothers hometown which I haven't seen in 50 years. That would be the world to me. It's true Finn. It was happened to our truck driver. A drunk man crossed over EDSA with a green light and he was accidentally hit by the side mirror of our truck and he died. Even if it his fault we were charged of his death. Since it's his fault and proven that he is drunk, they compromised us to pay the burial only. But still we spent a hundred thousands for his burial. Sherlyn's right we have drive with extra care. Take care always and God you and Sherlyn.

If you attach a roof rack and keep it on permanently you have changed the original condition of the car and will need to register with the LTO. If you are stopped and have not registered this you will be fined. Costs about P130 to do this.

You need to carefully research and shop around on the best car insurance here. And of course always drive safely since things can get crazy here on the road
Not sure why we even would bother getting car insurance (Full coverage that includes bodily injuries and death) if your always liable for the death regardless of fault, unless it's a new car that's financed and we have to. I'm guessing the insurance company would NOT pay any damages towards the persons death, if you were determined not to be at fault. So, a catch 22 scenario. I might just go cancel my insurance, LOL..... I understand what you were saying though, kind of messed up...But, we know where we are.
Here in US..you can't drive without insurance..for instance..you have a insurance but you cancel it...the insurance will report to the police and to the Dept. Motor Vehicle...then they will send you a letter that your car Tag no. has no insurance and they will give you 10 days to report your new insurance failure to comply you will be penalize everyday without insurance and you should not drive your car because your Tag is now reported in all police.

If you hit someone with your car in the Philippines, you're at fault. It is presumed that you are negligent unless you can prove in court that you're not at fault. This does not apply only in the Philippines, other countries as well. Have you watched videos in other countries where people ran in front of moving cars and pretend that they got hurt and throw themselves in the ground? That's how these people make money out of the driver's car insurances. That's how some people extort money from these unassuming drivers. These people know that the law says that if you hit someone, you're at fault no matter what. That's how they make money. That's why it's always useful to have a dash cam in your car (front and back). It helps. There are also some instances where in, if death occurred let's say you hit someone crossing the street and this person died, the family of that person may ask you to pay for the funeral and other expenses. That is if you amicably settle with that person's family instead of hiring your own lawyer and undergo litigation. This is just my 10 cents. It was my first time to drive in the Philippines last year and I am always worried that I might hit a motorbike or a tricycle that just appear anywhere. On top of that, there's just too many jaywalkers. nakakaloka hehe

In general, the driver who hits the other car, is the one responsible for the accident. So if part of the other car had crossed your lane in front of you, just yield to him/her!
That's why driving law in the Phil is crazy...here in US...if a car hit your rear...even let say you stop suddenly because a car at your front brake and suddenly a car hit your rear...it's always the car hit your back at fault...one time a crossing road with a stop light ...an SUV is crossing it's because it's a green light but a speeding car who beat a red light hit the rear of the SUV and the car driver is dead on the spot...the SUV turn 3x because on the impact...but the driver of the SUV is not at fault and not hurt ...he went home and not charged of the accident bec. if not your fault you won't be charged ..that's the law here in the US...

I would say most of us don’t have life/accident insurance. If you have a full coverage, then that should cover everything including third party liabilities - damage to the other car/cars involved, loss of life and property damages which should give you a peace of mind if and when an unpredictable event happened. Check with your insurance agent and be sure you read the fine prints as well.

That is indeed a stupid law in the Philippines. Here is a man driving with all caution and out of nowhere comes a 4 year boy running, Bang! ... the poor little boy is dead, the driver is charged, has to pay for the damage, and may even end up incarcerated. When in REALITY, it should have been completely fault of the parent/s for negligence. Law makers should look into this and make changes, especially now that most vehicles and places have cameras/CCTVs already.
That’s not just a Philippine Law. And IMO this is sufficient, you can afford a car you can lawyer up.

My partner which is german, he always have extra for BI (bodily injury) and PD (property damage) up to 2M pesos. Of course with extra premium. His logic, as foreigner always have to pay more in case of accident. But so far so good, he always drive carefully specially after a bottle of beer. In germany he can't drive at all after a beer unless alcohol frie.

i've heard a story where a bus driver hit someone on the road, injured the person but the person was still alive, but the bus driver reversed and drove over that person again to make sure he/she is dead because the hospital cost would have been higher than the funeral costs... crazy when you think about it

If your a foreigner in the Philippines and you get into any issue with the police or a serious accident, the very first thing to do is hire a Filipino lawyer to represent you. You have no adea how the laws are slanted against foreigners and the legal situation is rather corrupt at many levels, Did you know a foreigner can "go to jail" for insulting a Filipino?!
You are automatically at a disadvantage being a foreigner because they think you have money and they will try to take advantage of the situation.
Also, having a dash cam is definitely required, especially if you own a newer car.

It doesn't matter how carefully you drive here in the Philippines. If the other person is driving recklessly and get killed in the process, YOU will be arrested. This is a stupid law, but only one of many stupid laws in the Philippines. If you are going to live here, it is vital that you understand the laws as well as you can. This is one of those laws that applies equally to Filipinos and foreigners. Not all do.
On the other hand, the belief that the foreigner is always in the wrong is a myth. I have been in five accidents in eleven years, and I was only declared at fault in one of those. Here is a key, though. In the four cases where the other driver was at fault, I suggested that each of us take care of the damage to their own vehicles in three of them. In the fourth case, a lady tried to do an illegal u-turn in front of me and caused extensive damage to my car. Luckily, she had good enough insurance that it took care of most of my costs.

@@Blandina11 To say that driving in the Philippines is totally different than driving in your home country is an understatement. Think ten times as many vehicles on roads not built to support them and drivers who don't know the laws and don't care even if they do. I drove for 44 years in the US with only a couple of minor accidents, but here people just do stupid things all the time. A good analogy to the traffic situation is a comparison of mall usage between the US and the Philippines. In the US, you seldom have to alter your course to avoid another shopper in a mall, but there are so many people in Philippine malls that you have to keep your head on a swivel to avoid getting run over. The roads here are like that too.
Three of my accidents in the Philippines happened when my vehicle was stopped, and motorbike drivers ran into it because they weren't looking where they were going. Even if motorbike drivers do know you are there, they will often act like they don't care and try to fill any gap on every side of your vehicle. And drivers of larger vehicles (trucks and buses) will often try to use their size to force other drivers out of their way. Half of the drivers here seem to have received their licenses as prizes from Cracker Jacks boxes. The entire system is corrupt, so that isn't too far from the truth. You can pay a little more for a license and never take any test ( written or practical).
Finn is correct that you can be charged in case there is a death, What Finn didn't say is that if somebody dies, the other driver (regardless of fault) is charged with MURDER, so it is a serious situation. It can usually be mitigated by a payment to the family, but that is dependent on an agreement being reached.

I'll say though, that driving in Paris, France, 40 years ago was pretty challenging, everybody was bumping each other's cars all the time. Most of the time they just cursed and yelled at each other, and continue driving. Pretty funny to watch actually 😂
