    Actually had this happen to a friend of mine. He came home after working the graveyard shift and found the contractor with half his roof off already. When he made the contractor aware that he was at the wrong address the contractor said I hope you don't mind getting a free new roof. The contractor finished the roof replacement and rescheduled with the owner of the correct house. Thing is, because the contractor owned up to the mistake and immediately corrected the error at his own expense, my friend always recommends him to anyone he knows who is looking for a new roof.

    A friend of mine, a contractor, sent his crew to re- shingle a roof. When he went to check at the end of the day, he realized they had the wrong house. As he stood there wondering and worrying about a law suit the owners drive up. They had just purchased their fist house and knew it needed new shingles. They were not sure really how to find a contractor. Long story short, a deal was struck with the owners, they paid for supplies and my friend ate the cost of the workers. Problem solved by two people being realistic about finding a solution.

    As a retired contractor in Calif. THIS contractor who 1) Did not verify the address and 2) did not talk to Anyone at the house HE took apart , is 100 percent responsible for Any and All damage due to His obvious negligence. No Questions Asked !

      Our legal system, weighted heavily toward the wealthy, will allow the family’s home to be destroyed while it lurches thru arcane and bad faith attempts to dodge that responsibility. Punitive damages of crippling amount should be in play in cases like these.

      I don't think there was anybody at the house when they started. Back in the day ( BC before cell phones) we were sent to the wrong house. We found that the house number was correct as well as the street. It was the city that was wrong. The salesman just inputted the city name where the store was located not the city where the house was at. It is possible to make such a mistake. In our case we our work was indoor.

    Im in the trades in MN and know a contractor that sent a crew to the wrong house for a re-side. The homeowners came home to all the siding ripped off the house and in a dumpster. The contractor, after apologizing, showed them some siding samples and basically said, “pick out what you like” and proceeded to reside the house on his own dime. Incidentally, once word got out about how he handled the mistake, he got quite a bit of additional work. Handling a situation like that quickly and properly is pretty good advertising.

    I’m a roofer myself and did this same mistake. I ended up finishing the roof I made a mistake on and the neighbors house who I originally supposed to be replacing the roof for that day as well. That mistake cost me over $15,000. I made the mistake and had to eat it. After all said and done I reached out to the homeowner whose house I made the mistake to see if he can help out with at least the cost of the materials, the homeowner says to me “your lucky I don’t sue you for trespassing, now get off my porch.”Since then I not only double check I triple check all documents before even laying a tarp on the ground to make sure I don’t ever make that mistake for the rest of my life because that almost put my business out of commission.

      @@petervansan1054 as a contractor I have insurance but I think of it as only for something I could not afford to fix on my own. Once you make a claim for something like that you will find it hard or unaffordable to get a new insurance policy.

    The internet is a wonderful thing. I had a window contractor that installed windows, which were made incorrectly and leaked, didn’t install all the windows, and committed credit card fraud by charging me for the full amount of the work, then ghosted me for a year. I left an unfavorable review on their FB page with video showing water pouring through the newly installed windows. The next day I got a call from the owner of the company who apologized profusely and promised to do whatever it took to finish the job correctly. Eventually they did, but they weren’t willing to lift a finger until I went public with my story.

      bought a car and the dealership removed my license plate frame. i bothered them for a few months and then maybe a year later i found a picture of my old frame and was able to order new ones, asked them to pay for the frame they stoled and the shipping. they ignored me till i started posting on there facebook page

      ISP for my parents rural DSL and phone. Everytime it would rain just right the phone ringer would chirp and phone and internet would go down. I'd call tech support. I knew what the problem was, just not where. They would send someoneone out, jiggle the wires and call it good. It got sickening everytime until I eventually posted to their Facebook. I described the issue and what their "fix" had been. Shortly later someone came out, rewired the problem area in the road ditch down a mile or so and waterproofed it properly. Haven't had an issue since. It was to the point, I looked in the post at the end of the driveway and was going to fix it myself, but there wasn't any issue there.

    If the roofing company was so sure the insurance would pay out then the solution was simple. They could have immediately rectified the issue. In every imaginable scenario this would cost them the least amount of money. Hell it probably would have been cheaper in the long run than a successful insurance claim.

      there is also the principle that all involved parties need to try to reduce damages.
      (In the interest of reducing damages, regardless of who ultimately pays)
      Believing in good faith that the contractors insurance will cover it - which sometimes means that they award the contract for fixing the roof instead of handing out cash - means that the contractor is continuing to dig a deeper hole.

      Is the contractor a full-service roofer, or a specialist sub-contractor who only does tear-offs?
      If the latter, they lack the resources to replace the roof themselves, and need to arrange with a contractor that installs roofs.

      @@M167A1 Maybe you can answer this question. Are roofers like Ubber drivers or independent truck drivers. The roofer pays for referrals from a roofing seller who doesn't have roofers just salesmen and estimators. I used to work for a subcontractor for Sears. They would sell the furnace and A/C and we would install it. At that time Sears had it's own service force.

    We had a gas company guy come and want to start removing our gas meter. I asked him why and he said he had an order that no one was living in the home so the meter was not needed and to remove it. I asked him if he checked the line and the usage of the gas; it had been turned on for months at that point. He was confused and left. Never did get over the fact that if I had not been home I might have come home to no gas...its crazy.

      My dad's cable internet stopped working and a tech came out. He discovered another tech had disconnected the service because he claimed the house looked abandoned. Not only was there no possible way the home could be even remotely mistaken for abandoned, but the tech had no work order to disconnect anything. Just took it upon himself to disconnect someone's service.

    Question, if someone is removing your roof without your permission. Can't this be considered a felony property damage crime, not a civil matter? If I started ripping my neighbors roof off, I would be in jail or do construction workers have qualified immunity?

      @@fluffskunk my question has nothing to economic status, but asking why criminal offenses are treated as civil matters. If I came home to someone my roof my first call would be to the police. The police report, even if no one gets arrested is valuable to have if you think you may have to sue someone. Never trust that their insurance will handle the replacement.

    About 35-40yrs ago when I was still roofing on the California coast this happened to the company I was working for....
    Another crew loaded and started a job on the wrong house.
    They were IMMEDIATELY FIRED!!!!!
    Then I had come in calm the home owners, finish the roof, mow the grass, and clean the flower beds around the house. We made that place look like a million bucks!!!!!!
    Not owing a cent to the company.
    But, they were really happy with the job they paid for the material.....
    Yes it can happen. When one house needs a new roof, so does the rest of the neighborhood if they were built around the same time......

    Idaho requires contractors to purchase liability insurance with a minimum limit of $300,000. 100% the contractor should repair the damage they caused then deal with insurance themselves. Their response suggests a bad faith contractor and a lawyer is required asap. Especially if they may cut and run to avoid a 6 figure judgement.

    I own a roofing company and can't believe some of the stuff I hear . Living in Oregon we roof in some bad weather . Even in the summer we don't trust tarps to stay on the roof . We put the underlayment on before the end of the day . And the one time we leaked a roof we where evacuated because of wild fire and an ember burned a hole in the roof then rain overnight . It ruined a portion of ceiling in the house (ceiling also turned out to have obspestise) even though insurance would of covered it because it was due to fire ,I felt the family shouldn't have to deal with it so I had it fixed in two days time out of my pocket. Now I've done multiple Roofs for them

    When I was a young kid my Dad wanted a new roof on our 15 year old house because he didn't like the color. There was nothing wrong with the roof. He used a local roofer and it was done perfectly and the roofer left a couple of business cards. Neighbors saw the new roof and thought they might be do to replace their roof and asked a what company did the work. Almost every house in our housing tract got a new roof from the same company. After 20 years My Dad had them put another roof on because it only had a 20 year warranty. Again this roofer was busy in our neighborhood. Next month this same company will replace the roof on my house in the same area. I am now dealing with the Grand son of the original company owner. My Mother dealt with his Father for a roofing job. I told the Grandson about how I came to use his company and he said our family is very thankful for your business from the first time my Dad used them because our original house is at the entrance to the tract and everyone in the neighborhood used them and because of that they have always worked within 15 minutes of the area. We have been dealing with this great company since 1967 and they have sent out Christmas cards every year since. I went to their office to sign the contract for my roof as I wasn't home when he came by for the estimate. On the wall in the office is an old black and white picture of our house in 1967 with a note that says our first job as Betterway Roofing.

    Steve I admit I don't live in Michigan, but I just had a conversation with my insurer. He's a neighbor. What he said is that the contractor, in essence, either stole the roof or vandalized the house, as they removed the roof without the owner's knowledge or permission. The homeowner's insurance should immediately have the home re-roofed in order to mitigate the damages and then file against the roofer's insurance to recover their expense. The roofer is trying to avoid the claim by telling the home owner to go directly through their own insurance. The home owner has no responsibility and shouldn't be involved in the transaction. Admittedly it may be different in different states.

    I had one terrible roofer experience. Was selling my house and hired guys to replace the roof with new shingles because the old ones were balding. Roofers tore off the shingles and then broke for lunch. While they were gone it started to rain. I went into the kitchen and noticed water on the floor. First thought was a pipe burst. Then drops touched my head. Looked up at the ceiling light bowl was full of water. Turns out there's a vent directly above the light fixture. Its cap was removed by the roofers thereby allowing rain to flow in. Roofers return and I show them the problem. They send someone in the rafters via a crawl space to inspect for any other leaks and damage. While walking around in there, the roofer missed the floor beams and his foot broke through the ceiling. They promised to fix it.
    They finished the job and then took off. They not only left the hole in the ceiling but also, when they were throwing the shingles from the roof, left a section of wall covered in black scuff marks. I called the owner and he promised to send people to fix it. Weeks go by. No response. Fed up, I went onto their public Facebook page and left a lengthy post for everyone to see. I think I posted photos as well, for everyone to see and read. They were back at my place within a few hours and fixed the problems.

      For me it was the guy I hired subbed it out to some out of state crew. They ran out of the ice and water barrier stuff so my garage and entryway didn't have it. Come winter my entryway started to drip from melting snow, in spring my garage was leaking again from melting snow.
      Went after the contractor I hired about it and he just said it wasn't his problem since he didn't do the work.
      Thankfully the judge disagreed.

    This happened in my town years ago, the owner comes home at lunch and the roofers have all the his shingles tore off. He says uh you got the wrong house, the roofers say ............... what color shingles would you like. lol

    The contractor I have worked for, for half my lifetime would see that repair was instantly made, and argue over who's going to pay how much later. This is probably why he has never advertised and does not have business name on trucks and even a 4 million dollar home was built with a shake of the hand, not a contract. We are now all retiring. So hard to find such honor in this age.

    I use to install windows and doors for one of the big box stores and we never started a job unless the person that owned the property was there and we always asked who they where and never just offered the “customers” name for this reason, having said that, the crew is at fault and they need to fix it.

      I know how to roof a house. I have done several. At my current age (only 46, lol), I will happily pay someone else to do it. I do the majority of my own home improvements. I don't have to rely on contractors, but there are times where it's worth every penny, and a roof, for me, is one of those situations.

    there was a church here in down that had some storm damage on the roof, roofers tore off part of the roof and covered it with tarps. the tarps fell apart over the next winter, a year later they tore down the church and started from scratch. they tured a 2 day job into a 6 month job by leaving it unfinished for over a year.

    Interesting topic Steve. I remember a story that you did earlier this month (I believe) about a woman who told the insurance company that she was willing to settle for a smaller amount and they said no. Them saying no on the front end, cost them 5 Million on the back in.
    Just do the right thing and eat a small cost and I'm willing to bet that you would have a custom for life.

    Obviously, the contractor doesn't want to pay for this mistake. He thinks the insurance will pay. "That's what I pay insurance for." Since the insurance won't pay, too bad. By the time this makes its way through the courts, the house will be destroyed.

      @@Chris_at_Home we had a subcontractor who was sent out by the main roofing contractor. The subcontractor did some insurance work under the scope of contract and was to be paid by the main contractor out of the insurance monies. The main contractor pulled a fast one on us (one of the owners was a lawyer) when the fascia damage was more than insurance had allotted for and advised the subcontractor to "...deal directly with the customer."
      Since we had a relationship with the subcontractor and liked their work, we did not investigate them. Turns out they were crooks of to the nth degree who were bonded, insured and had declared bankruptcy, unbeknownst to us, by the time we were able to give them a deposit. It took us a while to figure out we were being lied to about delayed shipments of doors on order, etc. By the time we began searching social media, there were sooo many complaints and lawsuits to the tune of thousands and thousands of dollars. Bond is only for $10,000, which doesn't even begin to cover a fraction of the monies that were stolen from multiple customers. Thing is, many of us reported to the bond company over a period of months, but it wasn't until a client actually walked into the bonding company office, looked the employee in the eye, and spelled out exactly what these con artists were doing, that the bond suddenly became available.
      It goes on and on....from the small town lawyer we contacted about the situation....what a joke....since he had worked with the lawyer main roofing company owner previously - "conflict of interest" but we had to figure that out as well when he kept making excuses for over a month as to why he never got around to writing the demand letter to the subcontractor that we gave our deposit to.
      Such a racket. So many "professionals" in on it. And licensing board has been about as worthless as a screen door on a battleship. Subcontractor owes IRS thousands and thousands, but he is supposedly broke, Chapter 7. Hiding monies, he is....

    this happened to my father -in- law when i worked for him, we had multiple crews and lots of jobs going. we tore the neighbors roof off. the owner came home and said whats going on. It came down to a simple typo on the weeks job board. We simply asked him what color shingles he wanted,picked one and got a free roof. In the end the guy was happy, got a new 30 year roof

    There's a catch. If a roofer rips off the wrong roof, there's a very good chance the homeowner does not want that same roofer to come back and fix it. 1) The roof has already shown his level of competence 2) The incentives of the homeowner and roofer are not aligned. The roofer at this point wants to spend as little time and money possible. The homeowner, on the other hand, wants a new fully warranteed roof.
    I know all too well about roofers not preparing for rain and then finding every excuse in the book for why the water damage is not their fault.
    Tip: Online you'll find roofers whose page is stock photo roofs and roofers who show their own work. I'm not telling anyone which roofer to go with, but it is something to look for.

      I think it's likely that if the contractor had immediately admitted his mistake and put on a new roof, the homeowner would have been happy with that. Most people are tolerant of honest mistakes; it's the failure to correct your mistakes that pisses them off.

      There are some services that a website is unnecessary and having one that is poorly designed would cause potential customers to stay away.
      If I search for a roof replacement I expect to see businesses listed with reviews and ratings. Then once I find a potential business to use it only takes a couple minutes to verify the contractor license and see that they have insurance. I'm ready to call and begin a transaction.
      There are many small businesses that have unnecessary websites that would actually benefit from removing them completely. In the example a roofing company I really don't think there is a design that would get my business. I despise anything template based because it looks like it was made in 1995 and forgotten about. I'm just going to assume you are out of business. I'm not going to believe any reviews you have on your website so don't bother. You could give information about roofing options, but that will either be ignored or send me down a rabbit hole.... away from your business.

    Why I'm glad my roommate works from home. Had something similar (albeit on a smaller scale) happen where the neighbors were getting their fence replaced and the contractor they hired was trying to tear down ours along with it. Luckily it was resolved soon enough but dang, can't leave your stuff alone these days.

    We owned a service business, diesel repair and towing for years. The one understanding we always had with the insurance company was that our immediate action if we made a mistake was to prevent any further damage or injury to the customer.
    It was suggested that we do this without taking ownership if possible just in case there was some mitigating circumstances but the discussion needed to go along the lines of telling them that we can sort the situation out later but for right now we need to do this or this in order to begin the process of dealing with this.
    So if we damage the car while we were towing it our insurance broker had always told us to just take them and rent them a comparable car on our nickel and then sort out what was wrong with theirs.
    We really didn't do this very often because we hired good people but we did occasionally have an issue. I recall one time where after the fact it was very clearly obvious that we had not damaged the car it, had some existing issues. We still went ahead and covered the four days of rental car as a Goodwill gesture. At the end of the day that customer hired us to fix everything that was wrong with the car so we made that back and more. Good customer service is really basic. Think about how you would like to see the problem handled if it was reversed and then do that.

    Something similar happened to my grandparents vacation home. A contractor sand blasted their house at 3718 X street when they should have been at 3178. It wasn’t caught until most of it was completed. The contractor ended up re-stuccoing the entire house for free.

    IN northern Florida we hired a roofer, larger company. They use migrant workers who do not speak English. Our house was shaped like and L, and the leg of the L was just built 1 year ago. The job was for the 20 year old other part. The workers showed up super early, and started ripping off the NEW roof they were supposed to blend in. This was a stand up company, and they finished ripping off the whole "new" roof, and replaced it at their expense. They told me they charged the labor back to the subcontract crew (non-english speaking crew). Regardless, they did a great job overall, and we were super happy. Moral of the story, we had multiple bids, and took into consideration who has a brick and mortar presence. Large company, but not the local Jacksonville roofing company who has a radio show on Saturday morning. The correct bidding process saved us. We did not have rain in our forecast, and I would have been crazy had we. Side note, in Florida, there is now a new underlayment required. This stuff sticks to the plywood and is impermeable. So once the underlayment was installed, there is virtually no chance of a roof leak even during a storm. I was VERY Happy. Heck, their name was Total Roofing Inc. North Florida. Super Happy with the whole experience (other than the morning of the 1st day).

    I worked as a designer doing building permit drawings. I did a set of drawings for a beach house that was to replace a tear down. OK, I do what I always do first and look at the address on Google Earth to see what local conditions might affect the codes. The address placed it as the middle of a small cluster of three houses.
    When I was about finished the builder sent me the site plan from their surveyor and it turned out that it was actually next door, the lot on the end. Warned the builder to make sure his demolition crew didn't use Google Earth when they knocked down the existing house.

    Former solar tech, we used to sub out roof installations before solar insall... this legit happened...sub contractor went to wrong home and due to it being a cookie cutter neighborhood all the houses were extremely similar....and they ended up doing right by the homeowner and eating the cost of the new roof.

    Could one get the state Insurance Commissioner involved in this too? Consumer protection is one of their top functions.
    Damaged caused by an open roof should not be the same as damage because you opened my roof without permission.

      Bringing in the state insurance people only works if the policy should cover the mistake, but doesn't. If their insurance only covers their paid work product, the insurance company may try to say that going to the wrong house isn't the paid work product and the contractor should have gotten general liability, or something.

The insurance company is trying to confuse the issue by pointing to a clause which says they don't cover rain damage while the roof is off. Since that is not what happened, the clause is totally irrevant.

    I would sue the contractor out of his retirement plan. I would want damages for the roof, all other water soaked things, essentially an all brand new house and all brand new contents, plus emotional and psychological stress for every member of my family, even my pets, then consequential loss (how many family activities were messed up?!), plus heavy punitive damages since they just were just abandoned by the offending contractor who took no steps at mitigation of damages. Add prejudgment interest. Then there are the old family photos etc. that got soaked that can never be replaced. I would crucify them in court.

    I roofed for 25+ years and we toured the wrong roof off once! Luckily the job we was doing it for was her sister's house's was on the same property so she paid us because she needs a roof real bad !! That's the mistake you only make once !!

    We had back to back storms one year. The first storm damaged the roof causing leaks. We called the insurance and they delayed sending someone out until after storm 2. Second storm also had leaks. Insurance tried to not pay for repairs despite that we had it documented and they delayed sending out an adjuster. As soon as that policy expired, we switched to a different insurance company. One that actually paid claims.

    Yea i work on computers, and i got mixed up between two similar looking systems. One needed a new motherboard, one just needed windows reinstalled. I didnt read my invoice and trusted my memory and pulled the good board, and toss it into a pile of broken parts. When I realized what I'd done, I tried to put back the old board but in my tossing it it damaged it, so I did the right thing and went on ebay and bought the excat same board my customer already had, because that's the right way to do it. I made them whole, and didn't sub in cheaper parts because thats the right way to do it.

    Used to be in a customer facing job and in the 25 years that I did that job I had a few "Senior moments". I found that the best policy was to apologise, put the situation right and just ask the customer to just pay what they thought the job was worth. Not once was I short changed, I think that honesty goes a long way with many customers.

    "install a new roof" - there are valid reasons to refuse that and ask the company to pay the bill from a competitor.
    Lets say there is something wrong with the new roof and you have to deal with their insurance and they refuse to pay up. Why would that happen? How could that happen? No idea - the company already screwed up and the insurance just refused a claim.

    Sounds like a law school exam question. Sue the contractor and let him deal with the insurance company. Meanwhile, do what you need to to keep the water out and avoid further damage. (Duty to "mitigate damages," etc.) Meanwhile, see if you have any contacts in organized crime. ("Be a real shame if your legs got broke...")

    The same thing happened in the New Orleans area after hurricane Ida, except the crew realized the mistake and left and no one knew who did it. After it was on the news another contractor volunteered to put a roof on and wait to see if they caught the other contractor to get paid.

    I did an estimate once for a low income house manager. He was laughing while we where watching a random company roof the wrong house he wanted done across the street. Once he saw them at the wrong address he shrugged and called me instead. I ended up doing 8 roofs for him after and the other company obviously didn't get paid for doing the wrong house.

      In this case the property owner could be on the hook. If he observed them at the wrong house and didn't stop them there is the mitigation of damages doctrine, also known as the doctrine of avoidable consequences. He had the duty to limit the damages and did nothing. The property owner would likely have to pay for any work/materials used after he observed them at the wrong house and failed to act.

    Seems like the homeowner needs to file a claim with her own insurance company to get the roof repaired before any more damage is done to the house, and let the insurance companies work out the liability issue. But she still has a duty to mitigate damages, so she really needs to get on this, or the responsibility for the water damage done to the house is going to be put on her.

    Getting insurance companies to pay for negligence is hard. Not mitigating the issue will make it even harder to get them to pay out. And no one will EVER insure the business again. A lot of roofers have zero knowledge of how insurance actually works. Best bet is to put in a claim with your own insurance and let them sort it out.

I have excellent coverage, know very well how to deal with them. And tbh, I don’t really like that condescension in your comment. As a matter of fact, I have two coverage, and the last claim I had was for $100 tow bill, supposed to be “bring bill, get reimbursed”. It took almost 6 months to get that money, and they “moved the goalpost” a couple of times as for requirements. Meet all the requirements, “here’s another”, meet that one, “here’s another”……
      And fyi, insurance companies are there to make money, not make YOU money.

    You can find dozens of stories where the wrong house was razed (not "raised") in post-Katrina New Orleans. The homeowners would return only to find an empty lot. This continued well after the storm recovery years, perhaps as recently as 2016!

    So Steve, a question. If a company pulls this and tries to ghost you on responsibility, what do you do? I presume you don't just leave your house without a roof. Do you hire a new company to actually do the fixes and jobs, and bring those in as actual damages to the court/insurance?

      Yeah if you immediately get a new roof put on it does two things:
      1.) It stops your house from being completely ruined. Even one day of rain on a roofless house will quickly take the damages from tens of thousands up to total loss.
      2.) It shows the court that you did everything in your power to reduce the total amount of damage, which is a criterion for something but I can't quite remember what. In essence it just makes the court more likely to award full damages but again I can't remember exactly why.

      That presumes you have the financial resources to front a new roof. Between 2 years of COVID and the current almost hyperinflation a lot of people are financially destroyed.

    You mentioned a roof issue where it was with a contracter and didn't secur it for stormy conditions. I worked at a bowling center. The owners where having the roof replaced. The contractor left the roof completely romoved over night. Wel, it rained non-stop for 3 days. There was flash floods everywhere, includong inside the bowlong center. Over the lane. That still 'HAD' real wood lanes. They all worpped and where unrepairable. Took a month or so to get it all repaird.

    The very same thing happened here in Arizona to my son except he had hired an unlicensed contractor that had done work for a bunch of people we know with no problems. Very highly recommended. But with his house it was a disaster. The guy did the very same thing by ripping off the roof knowing there was a possibility of rain. No tarps. Be back in the AM to finish it. About midnight the rain came. Water pouring in everywhere. The entire ceiling in the master bedroom fell on to the bed. My son called the guy who came right over with tarps but it was already to late. Then we found out the guy had no employees. Just people he finds online to do day labor. A quick job turned in to 2 weeks. We also discovered he had jobs all over the place in the same situation. The smell in the house from the rainwater was horrendous. In the end the roof finally got done and even looked good. My son paid the remainder of what was owned before I got there. I would not have done it. The roofer guy tried to charge my son more. I told the guy to get lost. He began to make threats to shoot us or have someone come over to beat us up. By this time I had had it with this moron. We had his truck boxed in plus he still had tools strewn about. I walked up and got in his face. He backed down real quick and said he was calling the police. I said great call them. I will to plus I will call the city inspectors and the Registrar of contractor's as well as the IRS. All of a sudden his tone changed. He did not get a dime more or his tools but aside from kicking his ass and taking back the money my son got stuck repairing the water damage. We did find out the state has a fund to cover unscrupulous licensed contractors that will help with matters like this but since he was unlicensed there was no monetary help but there was still a silver lining to this. After doing some detective work we had his address and license plate numbers plus he used his real name. The state to all that info and went to his door and put a stop to his un licensed ventures which are illegal by all standards but seldom caught unless something like this happens. He was handed a cease and desist order from the county superior court plus the state and Federal IRS was informed and the city was considering filing fraud charges. Have no idea what the final outcome was but his being exposed and reported to the authorities kicked his ass and he knew they had him and trouble lies ahead. My guess is he is still paying the IRS. I am certain every time he thinks about us he wishes he had not messed around and got caught..

    The company is liable for any damage the house suffers because of the missing roof. I'm not a lawyer and even I know that. You can't just rip someone's roof off, as a business, and leave it like that unprotected. The more you wait the bigger the cost is going to be to you. Sounds like he's going to let it get so bad the whole house needs to be replaced, or most of it. That'll kill a business quick.

    Was the entire 'roof structure' removed (rafters, sheathing etc.)? You didn't specify, however, you sated the cost was $70,000.00 dollars, surely this could not be for just shingle removable and replacement! Please clarify to what extent the roof was removed Steve!!

    What about the homeowners insurance policy from the house in question. Home was severely damaged and the should have filed a claim. Homeowners have a duty to prevent further damage regardless of fault. New roof maybe $25,000. Collateral damage could be $100,000 or more. Good luck with the mold remediation. Have see insane estimates on mold. Only certain people can legally remove mold.

    It always blows my mind how insurance is so readily used to deflect responsibility vs incidental damages as it is "meant" to be. A younger me would never have conceived that insurance could used that way as you would assume no company would agree to pay out for excessive fault or negligence of the policy holder.

      This is actually encouraged by insurance companies. The more charges that flow through them the more they can skim, they just sell bigger more expensive policies, then put up more fake statistics showing that you need a billion dollars in coverage, and flex on state insurance commissioners to require businesses to carry stupid policies. "What, you don't have low deductible grocery insurance? Boy, I'm glad we caught that before you ran out of tomato sauce! Step into my office and we'll get you protected."
      The sort of monkey motion that reduces general economic health of the community.

    I understand mistakes happen but how the heck does this happen?! Just had my roof redone last month. The owner was at my house for the estimate, then he came back another night for contract signing, took drone pics of the house. And then 3 weeks later came out with his crew to complete the job. Based on all of our dealings, he knew the house he was to work on that day. He also notified me before they even moved a truck onto my driveway that they were good to proceed. Helps when the owner is on site.
    If a mistake is made, clearly its the owner not being clear to the crew and they need to make them whole. Feel so sorry for these homeowners you're describing having to go thru this nightmare. Cannot even imagine!

    Why didn't they file the claim with their own insurance? That's who has a vetted interest in making sure the home is repaired. They are the ones who should be going after the contractor and his insurance company. Replace the roof now then make them pay. I know I've been in more then one car accident where the other parties insurance was putting up a fight. My insurance repaired my car, took my deposition and then fought successfully to get repaid by the other insurance. That's how it should be.

    one of the houses in my neighborhood (abandoned at the time) got two sides of the roof replaced when the realized they were at the wrong house halfway through the teardown. glad they did not leave it.

    My brother had this happen with a landscaper that tore out half his yard before he realized they were at the wrong address. Guy claimed he would fix it and acted nice but then spent months doing nothing. Finally did something when he was threatened with a lawsuit.
    This is why you should call the police immediately if something like this happens. You can't afford to risk them not fixing the problem for you. If they start fixing it immediately the police should work with them but if not they absolutely deserve to be charged criminally and arrested for this kind of property destruction.

      In a similar situation, I called my city buildings department. Inspector issued an emergency construction permit (at the roofer's expense), city inspected, documented and the roofer fined. The fine was for not obtaining a permit for our address before starting work. The one for across the street was still valid.

    One of the sub contractors that worked for the contractor I frequently pull work from had on more than one occasion torn down the wrong fence at wrong the home next door to their contracted job.. Needless to say they no longer install fence in the Tampa area

      Let the insurance deal with the insurance.
      Insurances even go after insurances that they them self issued to an other client.
      The risk will always be pushed "as far as it can go".

      Happened to my neighbors and his insurance company paid for a new roof under vandalism claim and the insurance company probably went after the roofing company as we had pictures of the workers/trucks (they only did a partial install but enough to ruin the original roof, as they were installing metal roofing).

    When I was a plumber apprentice with a medium sized plumbing company in San Jose, Calif., 4 decades ago, one of the plumbers, with a laborer, was sent out to rough in a small strip mall.
    It was located on a corner of an intersection with all 4 corners vacant, just bare earth. He roughed in the buildings on the wrong corner of the intersection. It took him more than
    one day to accomplish.

    These people are under no obligation to allow a contractor who is PROVEN to make mistakes to re-roof their home. The contractor who took the roof off is responsible for the cost of a new roof and any damage that was caused.

    This happened with a siding crew in my town. They went to North # St instead of South # St. They just put on new siding, apologized, and went on their way. The homeowner wasn't mad because, hey free siding. The contractor's reputation wasn't tarnished because he fixed his mistake right away with no fuss.

    The roofing company is 100% at fault as THEY are ones that went to the wrong house and removed it. ANY AND ALL damages to the home since is ON THEM as they didn't fix it.
    Its harder to put it on yea but still they can roof a house pretty quick. depending on house maybe 50x30 house easy a crew of 4-5 guys can get that done in less then a day. They got gas/air nail guns they can zip threw nailing a new roof on.

    File a vandalism claim with your insurance and let them go after the roofer. I am an insurance roofer. This happens more than you would think.

      Criminal charges can't be filed by an individual. They are filed by the district attorney.

Criminal charges are about the state punishing someone for breaking the law ( and I'm not sure one was broken here that a DA even could prosecute for ). Civil suits are how you get someone to pay for damages they have caused you.

    What's not clear is if this is a complete service roofing contractor, or a sub-contractor that only does the tear-off work to remove old roofs.
    A tear-off contractor does not have the ability to place a new roof, and may well not have the deep pockets or adequate insurance.
    The only thing that is certain as far as resolution goes is that the homeowner is going to have to sue several parties in their efforts to be made whole.

      A sharp lawyer might get some money out of their insurer.

And the owner of the company says: 3435 elm? The address we sent you to was 3534 elm. They had a better setup and delivery, but you get the idea. Imus used to play it on occasion.

    That nearly happend to me a few months ago. We just had the roof replaced last summer due to a severe hailstorm. One morning a few months ago I hear footsteps on the roof and I stopped these guys seconds before they were about to rip all the shingles off. They called their boss and then realised they had the wrong address (duh!!!) Thank goodness I was working from home that day.

    As a contractor, I would say these situations are why it is key to do an estimate in person and have a contract that both parties have signed (with the correct address on it ffs). Insurance is a must, but they will be no help if the contractor does foolish things and is too busy or lazy to oversee the job that they were hired for. Insurance will not cover the insured contractor's negligence and failure to do their "homework". The roofer needs to make this right. But he most likely won't and homeowner needs a lawyer to get results. Is a huge burden on the innocent people, whose roof got demoed, that are basically a victim of this situation.

    You raised a common problem where the affected person(s) are tricked into thinking its the insurance company's responsibility to rectify all damages. That is always not the case. The person responsible for the damage is 100% and always responsible and accountable for damages. Yes they may have insurance to offset all or some of the cost however a lack of insurance or underinsurance does not get them out of the liability.

    When i was a kid in Arizona, a pool company showed up at the house down the street and started digging the new pool.
    It was about 1/3 finished when they realized they were on east Idaho rd not west Idaho rd.
    It whent to court and they had to finish it at no cost to the homeowner.

      Well, yes. Its happened in Florida after a hurricane. Roof gets ripped off, someone rolls up to an house with no one around. They toss on a shit roof and apply a lien and demand payment or they'll take the house, eventually sue for $$$$$$ for a the roof they installed thats only worth $$.

    There was a story here in Houston where a tree service cut down a tree and when it fell…it went across the street and crushed the neighbors home. You’d think it’s cut and dry who’s responsible…but the tree service says it should be on their customers home owners while the customers obviously says it’s on the tree service. This crap went in for months…finally the tree service was liable and they filed it on their insurance. Then changed their company name!
