Holding Border Patrol Accountable: Terry Bressi on Recording his 300+ Checkpoint Interactions

  • "This is not increasing our security, in fact, it's making us less secure. It's just feeding an empire building, it's feeding agency budgets, and job security for various law enforcement agencies," says the University of Arizona's Terry Bressi of in-country immigration checkpoints.
Bressi sat down with ReasonTV's Tracy Oppenheimer to discuss these checkpoints and their implications for civil liberties. Bressi estimates that he has been stopped by border patrol between 300-350 times. After his first encounter, he started carrying cameras and audio recording equipment, and has since been videotaping his checkpoint interactions. He says this holds officers accountable for their actions, and he hopes that by posting these videos online, citizens will become more aware of their rights.
"A federal agent who is standing in the middle of a public highway, wearing a public uniform, collecting a public paycheck while seizing the public absent reasonable suspicion has no expectation of privacy," says Bressi in regards to filming border patrol agents. "This is something that I like to remind folks of, that the government thinks that we don't have any right to privacy whatsoever, but that's a double-edged sword."
For more of Bressi's checkpoint videos, visit his TH-cam channel here: / checkpointusa

The border patrol wanted to check for drugs but supreme court said no....so now when you get pulled over at these checkpoints you have to answer a citizenship question (are you citizen of the USA?) while they run a drug dog around your car... they claim they are "body finding" BUT dogs are trained to find DEAD bodies not live ones. P.S, If you dont respond to citizen question they will eventually let you go (even if your latino!) so they obviously dont care about the answer at all.

As a carpenter driving to different jobsites in the past I've had to drive thru these checkpoints, and have been held back, and been late to the site so now I have to leave my house earlier than usual just in case.. They're definitely a nuisance.

Sigkim Hello Sigkim. Yes that does sound about right. Lately I have been working on Mt. Lemon re building (Framing) Cabins that burned down in that devastating fire about 7-8 years ago. Thankfully I haven't had to drive towards the 3 points area where I used to run into checkpoints, or other areas outside of Tucson where they have checkpoints.
There was this one time about 2 years ago when I drove to Kit Peak to go check out the Telescopes. I wasn't in a hurry, and no cars were behind me. So at the checkpoint I decided to have a little fun. As soon they started asking me questions I started speaking a little German to them instead of English, and the guy had this confused look on his face. He was probably thinking > What the hell do I do with this guy he doesn't speak English, and I don't speak German

Christopher Knox said: "Your picking a fight with a civil servant doing there job"
This is false. The agents this person is talking about were not doing their jobs, they were violating a persons rights.
Agents here can only detain for 'brief questioning" and "any further detention or search must be based on [the greater showing of] consent or probable cause."
Once a driver indicates that he will not answer questions or consent to extend the detention or a search, then the only real option available to the agents are to quickly check for evidence of crime, such as contraband in plain view, and let him go if no evidence of crime is found.

It is time for the ACLU to address this issue. What the "permanent temporary" interior Border Patrol (BP) checkpoints do is prove that the BP is ineffectual at/along the border. Either the BP is effective at the border, in which case the interior checkpoints are unnecessary and excessive; or the BP at the border is ineffective, in which case it either needs to be strengthened (by returning the interior BP agents to the border), or it needs to be eliminated (since BP management has been playing this weasel game for so long that the BP bargaining unit has been enervated and emasculated). If anyone with brains and determination is reading this, make this an issue; perhaps a presidential issue for 2020.

Just well enough to show up to work on a regular basis and execute orders with no empathy or independent rational judgement.

Aaron, an Inland Checkpoint is NOT the same as a "Terry Stop" and has nothing to do with an illegal "search". The job of these agents is to catch ILLEGAL aliens, or those who refuse to ID as US CITIZENS. It amazes me how you think that the US has no immigration law, or doesn't ENFORCE immigration laws. You certainly have the right to refuse to say you are a US citizen, at which time you will be LEGALLY detained for AS LONG as it takes to determine your citizenship and it is ALL legal.
