      Then the spouse is probably not going to get the green card.

    Hi Darian, does it also mean that divorcing before the green card will get the immigrant deported? I assume they will be required to leave the US. Also, I've read some of the comments, what do you mean by divorcing and still being legally married when the interview is scheduled? It is normal for a divorce to prolong before it is finalized?

      It is normal for a divorce to take longer than 6 months in some states. If you divorce before receiving the conditional green card then the green card application will be denied. A denied green card will usually not result in deportation, although that is not always the case.

    What about my situation, got married, then AFTER the fact learned she was married to someone else so became a trio, I did not want to get involved, she cancelled all paper work and now I am in limbo, did not want to know anything for 30 years so... what is my standing now? I got working permit for 2 years and social security number that was it, so??? No chance or some chance? (she may have been a victim also since she got abandoned by first guy for years so ????, she assumed she was single since she did not know his whereabouts), but came back when we were already married so ??? it is called LIFE so ???

    When does sponsership goes into affect? Will the us citizen be financially responsible for the Immigrant after divorcing on a conditional greencard?

      The affidavit of support goes into effect once the conditional green card is issued. The US citizen will be financially responsible after divorcing, until either (1) the greencard holder becomes a US citizen, or (2) the green card holder has worked for 40 qualifying quarters (or 10 consecutive years of employment),

    I was married 5 years and in the begging stage of a divorce I don’t know what to do I found my US spouse cheating on me I confronted him about it and he kicked me out our home my name was in the lease I don’t know what to do smh 🤦‍♂️

      You should speak with a divorce lawyer. If you have your full 10-year green card then you don't have to worry about immigration problems. If you have a conditional green card then you should schedule a consultation with me or another immigration lawyer.

    I've been divorced for 13 years, That should be ok, right. Married for 9 years. And we have three children. Does USCIS will give me a hard time? Thank you.

      You can still be deported for crimes as a permanent resident, so yes it is possible.

    I need to talk about I am an American citizen. I been married 5 years he has arrest records from domestic violence issue can I go to immigration and take away his green card . He no deserve the green card he has a court record from 2020 he was arrested at again 6 months . How can I go to immigration and take away his green card my divorce will me finalized

      No, you can't take away his green card, BUT he might have trouble keeping it. There is nothing that you can do unless the marriage was fraudulent, in which case you might also be in trouble (if you had knowledge and assisted in the fraud).

      @@guadalupeavalos457 I'm sorry to hear that. Contacting an immigration agency won't do anything unless you try to say that the marriage was fake for a green card. The way to deal with domestic violence is by calling the police (and getting a restraining order/order of protection). If he is convicted of a domestic violence offense then he will likely be placed into deportation proceedings.

      @@DarianLaw he has. Honestly. He been avoiding services . I want nothing to do with him . I will marry again ? Can I get him a new green card . I only filed for divorce because I decided to divorce because of domestic violence.

      No, applying for a tax identification number will not affect the process.

    i married 3 years ago and i still waiting my first interviev but we process on divorce and its gonna take a year in my state can i still have a change to get greencard

      Yes, there is still a chance if you are still legally married at the time that the interview is scheduled. There is almsot no chance if your spouse does not attend the interview with you.
