I agree Malema serves of the JSC where advocates who apply to be judges. He has no law qualifications. How does our country allow that.
This battle can never be settled in court. Even if afriforum wins in court, there is no way to stop people singing the song. They are actually giving malema free publicity.

The more I hear about how the courts are dealing with hate speech, the more I am disgusted by our judicial system. It's not just that the citizenry is already unequal before the law (the precedent is quite obvious), it is because of the way legislation is being crafted appears to be a deliberate effort to actively undermine the principle of equality before the law. This principle is absolutely foundational to a liberal democratic system and the fact that our courts are moving in the opposite direction makes be very angry. The definition of hate speech already discriminates arbitrarily by race. How long before that precedent expands into other related ideas, like the concept of a 'hate crime'? If the law concerning a verbal crime, like incitement to genocide, is different for whites than it is for blacks (Sparrow _et al_ ), how long before the actual crime of genocide suffers the same kind of "reinterpretation"?
Concerning the judges and legislators of these cases, those setting these precedents and making these laws, I'm quite curious how they manage to sleep at night. Surely they must know on some level that they are actively orchestrating the most anti-democratic shift this country has seen since grand apartheid. It honestly sounds like they have been "captured" and thus are in dire need of lifestyle audits and thorough investigations into their finances and business dealings. The behaviour of Judge Motata and his ability to circumvent justice comes to mind here.
The liberal democratic system is the problem... It has failed all South Africans and it's designed to do just that. There's no I'm sorrires or poor blacks here, it was called swart gevaar and Cape Along with all blacks today are outright liberals in party and Marxist ideology. That's why the 92 referendum was called for ALL SOUTH AFRICANS rejected it and yet here it is today!
