    there's a really simple test for all of this: the court [and the EFF] need to ask themselves the following: if Afriforum [for eg] all of a sudden started singing "Kill the Muntu, Kill the Domestic Worker" at their gatherings and rallies....[1] how would they [the EFF] feel about that and [2] how would the court judge it?

    There can only be one successful and sensible outcome to this case. That would be a total ban on Malema for using hate speech. Any other outcome would be unsatisfactory and make a complete mockery of equality before the law.

    When Boer is used in any language, except similar languages as in Dutch, but Afrikaans, it refers to White Afrikaner. Just in Afrikaans in South-Africa, it means both and the difference lies in the capitalisation of the word, Boer=White Afrikaner as opposed to boer=farmer
    Either way it refers to a particular group. And since everyone in South-Africa understands the clear difference and the context used in the song, how is it that ignorance is justified?
    If I should steal something I can't say I didn't know as I have never read the law or have never been told not too?
    Not even during Apartheid was the K word used in media, public, work places or allowed at school (you would get a hiding if a teacher heard you and that was made very clear). And yet at the end and today, you could according to the case here, apparently use it when you refer only to an unbeliever, the ACTUAL MEANING from Pakistan of the word that came here via the British, it should be fine, just as long as it's not used in context to refer to non-Whites specifically?

      This must be a European South African. What does the natives need to be forgiven for tolerating strangers coming onto their own land and then slaving them in their own country. The only thing that needs to be given is reparations to the natives of South Africa. They need to be given back everything that was stolen from them then there could be some forgiveness.

      Unfortunately it isn't that simple. Thinking of today is not the backwards thinking of the past. It takes time to build, it takes time to change, It takes time to forgive and if you pay attention that process have been in the works since 1994. Even though the settlers then brought the world's knowledge, medicine and so many advances to better the lifes of all that live here. They helped organise the people. So many tribes was scattered and killing one another. A country was formed and it gave everyone a means to build upon all included. It is unfortunate that the previous goverment brought apartheid and as tough as it may have seemed apart from the propaganda of the ANC making it sound much worse than it was. Ask the elderly of the black communities. Yes, it was wrong, yes it hurts but at least the communities thrived and all had opportunity. Time will heal these wounds. @@carlalandrau6033

    Compared to his non-sensical approach in attempting to protect the display of the old South African flag, Mark Oppenheimer is making an extremely strong and rational case in this instance. If logic and equality has meaning in South African courts, then there can only be one verdict - that Malema should be convicted of hate speech, period!

      If you really want justice in this Country and have the funds and the will to fight on then you are forced to go to the SCA and ultimately to the Constitutional Court and even here so many rulings go against what you term a reasonable Court.

      I have absolutely no doubt that had you been a presiding judge we just might have a reasonable Court. Here's hoping...

    This is meant as ideological and political talking points - advocacy. What btw has any of this to do with free market economics? Nada of course, this is about crowd funding and identity politics. (Have you seen FMF crowds?) This is what all these classic liberal and libertarian organisations are these days. Nevermind the legal argument (pretty poor), the objective here is to argue and claim there are double standards, Afrikaners are 2nd class citizens and that the laws are racist (regardless of the ruling and legal merits). China's Xi Jing told Cyril Ramaphosa that BEE should go in SA because their is so much red tape as in filling out forms for importing goods into SA even the Chinese are complaining because sometimes it can take up to nine months for clearance to SA and of course the Chinese will have to pay courier services as the Post Office in SA is now in liquidation. I think the Chinese people have a valid point.

      You may want to be a little circumspect with tossing around the "you's" (deserve, fomented, etc.), I have not fomented anything in SA, nor am I likely to suffer any personal consequences of changes, save for withdrawing the minute investment I have there. And that can be done at the click of a mouse.
