    Ever since Nijisanji self reported that they skinwalked the Selen Tatsuki account, every other Niji-EN talent is now on a double spotlight. Every tweet they do, especially in a form of an announcement, is going to be on heavy scrutiny, and speculation (sorry Millie but telling your fans to NOT SPECULATE isn't going to stop the majority lol). And no, it won't be only analyzed by some schizos in a clover site. Even the casual fans are on alert, and that is a trust trainwreck on its own.

    I not sure if this is me being pessimistic, but when it came to the repost of the black screen video i think many of the livers did it of there own freewill. I say this because Scarle and Kyo were active at that time and they did not retweet the blackscreen video and Scarle was able to stream quickly after the whole thing at her usual time

    • @jimmytsunami5275
      @jimmytsunami5275 2 หลายเดือนก่อน

      Possibly because they knew that retweeting the video would be a BS idea
      Elira, Vox, and Ike aren’t PR professionals, they just broke their NDAs in that black stream yet they do not get fired for it

      I wonder if this could come down to manager, especially with both of those being in Iluna. Scarle is something of an exception because she's pretty frequently spoken positively about her manager. Perhaps theirs' is better. Perhaps Scarle just doesn't catch the dodgier stuff because she mostly keeps to herself. Not sure.

      @@FrarmerFrank I didn't say it was all of them that posted it of their free will. I do believe there were some accounts management took control over and post the video. I just have a difficult time believing that the managers took over all 40+ accounts and the Talents had ZERO involvement. I think there are some talents who posted it of their own free will, for reasons that vary, yet posted it all the same.

    There are two types of skinwalkers in Vtuber community: you’re an imposter using the model and associated IP after the original pilot was dropped, or you’re Elizabeth Rose Bloodflame who could be an actual mythological Skinwalker.

    sadly legality for skinwalking can work for those companies. And it's not just Japan, American laws allow those corpos to skinwalk as well.
    Why It's a bad idea? Morality issues and audience backlash. Sure they can do that but it's pretty much a PR nightmare. Also we know that the court of public opinion is more important now because it got amplified more thanks to social media and internet.

      If Niji was more subtle about it they might be able to get away with it, but they really haven't been "playing the character." Some tweets very clearly sound different from how the person normally talks. Between this, shadow suspensions, and other issues the trust problem is coming back to bite them. They've lost the ability to control the narrative outside of their devotees, and in those cases they really don't need to say much; they won't question anything.

    6:40 - just to explain "beer o'clock": in Man of Medan your choices have consequences sooner or later. At one point Mint had to choose whether or not to let the blonde girl drink beer after coming up from diving, which her bf advised against bc of decompression issues that could be deadly if mixed with alcohol; Mint chooses to let her drink the beer ("beer o'clock!" dialogue line) and at the end of the game, in the very last cutscene, the girl has decompression issues and dies LMAO

    Nijisanji is a cesspool of the worst aspects of Japanese black company mentality, however, they have a right to do whatever they want with their IP so long as it isn't expressly stated in a signed contract somewhere that they can't.
    Selen Tatsuki is a fictional character that they own all the rights to.
    Imagine if it's Mickey Mouse. They can let whoever they want voice the character. They can portray the character however they like. They can have as many people as they like make tweets from Mickey's twitter, because Mickey is not a person.
    If they hired someone to voice act Mickey, then fired that person, that person can't sue Disney for impersonation. Even if he was the FIRST voice of Mickey (which ironically was Walt Disney himself).
    Selen Tatsuki is not a person. She is a fictional character and a piece of property that is completely owned by a japanese corporation.
    Now the woman who portrayed Selen while working for Nijisanji has a lot of possible avenues for lawsuits for various things that they did to her, but this particular topic is not one of them.

    • @kos2919
      @kos2919 2 หลายเดือนก่อน

      Yes, you're actually very correct. But it's more on the public opinion side. All these skinwalkings proven to be quite a nightmare on their PR side. A lot of people are wagies, and they can see themselves on Selen's position, being treated unfairly by a corpo just because they're doing something deemed "Out of line" by the corpo. Of course a lot of them ended up siding with Selen.

      Good points you brought up but it's just that vtubing is in some ways different than just hiring a VA for a character because you are hiring a VA to do much more than just voice act some lines they were given, you are hiring them to interact with the community as the character and as themselves
      Vtubing is such a weird thing because they are basically told "you are hired to play this character but be yourself as much as possible when possible"
      you are supposed to do a lot more than just voice a character you need to learn to do performer stuff
      Like for Mickey we all know that VA is temporary and they are gonna change it when the time comes and all their lines and interactions with the community were meticulously crafted from the ground up to act, speak, and present themselves a certain way
      With vtubing for the most part they just get a set of rules of what to say and what not to say but the rest is up to them, the rest is just them interacting with the community as themselves with little to no input from the company
      That's why it's different, Selen might not be real but most of her lines and interactions were a product of the person behind selen, there was no team of writers telling her what to say every time she opened her mouth for the most part
      Companies can do whatever they want with the Vtuber character but when they pretend everything is alright when the person who is behind selen literally tried to take her own life, from a legal standpoint it might not be impersonating but morally it is so vile
      Edit: usually companies mention that a character's VA gets changed but with selen they posted something pretending to be her while her contract was still active and she was in a bad state
      They can try to skinwalk vtubers with someone else but the fans will not take it because fans are mostly interested in the person behind the character not the character itself
      Mickey can keep on existing as long as they have writers and storytellers to keep making content, with vtubers the character dies when the person behind the character can no longer do the voice for any reason, companies can try to revive vtubers with a new VA but it will not be the same because the character's va wasn't set up to be replaceable like Mickey's
      You can fire the VA for Mickey and it really won't matter, but you can't fire the VA of a vtuber and pretend it's the same thing

      Logically yes but etically no, there is just one problem that make njsj cant resale selen goods, the problem is they make their problem with selen public knowledge (they dont end the problem peacefully) and the fans not feel good about all this situation, i really wondering why they dont care about their value in front of customer when that is one of the important factor for a long life company

    • @TheDrexxus
      @TheDrexxus 2 หลายเดือนก่อน +1

      The first reply focused on public opinion, which I did not address. Everyone knows Niji is awful, that isn't the point. I was just saying that legally they have the right to do whatever they want with their characters.
      Third reply also mentioned ethics. Again, i'm not arguing ethics here. Niji is a black company with heinous practices, nobody knowledgeable about what they have done is going to argue, in good faith, that they are not a horrific company that lacks morality.
      Second reply though... It doesn't matter. They own the character. Doesn't matter if they are performing or coming up with their own lines. Using Disney as an example, look at the actresses portraying Disney Princesses in the Disney Theme parks. They make up literally everything they say. Every guest interaction. It's all improvised and it's all performed live. But it doesn't matter, it still does not give them one ounce of ownership over that character and, in fact, Disney has rotating groups of girls who portray these characters. You can have the same character portrayed by 3 different women on 3 different days. The amount of time doing it doesn't matter. The amount of improvisation doesn't matter. You can't just say vtubing is "different" because it really isn't.
      Also another thing to consider. You may be aware (especially as a fan of Selen/Doki) that the cereal mascot Tony the Tiger became a vtuber very, very briefly. You think the guy that portrayed him is now entitled to some partial ownership of that character for his brief stint vtubing with the character? Does the act of vtubing somehow entitle one to more ownership than voice acting, live performing, or other activities in the entertainment industry where one portrays a character that belongs to a corporation?
      Again guys, I hate Niji and want that company to burn. But they OWN Selen. It may be disgusting, repugnant, questionable, heinous, or whatever word you want to ascribe to them for doing so, but they have the LEGAL RIGHT to use Selen for any purpose they want so long as it doesn't violate some part of the contract signed with the talent who formerly portrayed Selen. They also have the LEGAL RIGHT to make posts on social media as that character and on that character's behalf.
      However, I will concede on ONE aspect of the skinwalking that does actually dip into murky waters that i'm not entirely sure about, and that is the fact that at least one of those posts made on the Selen twitter was actually made impersonating the PERSON behind the character rather than the character itself. Selen, the character, was not injured or in the hospital, but they had the Selen character's twitter pretending to be the person portraying Selen and talking about real life, out of character information, and pretending to be HER rather than the character.
      So in a way, it would be like if the voice actor for Mickey Mouse got hit by a car, then Disney got some guy to post on Mickey's twitter saying that he got hit by a car. It would be... Strange to say the least, because it didn't involve the character itself.
      I'm not here to debate morality, just law. And as for that, I feel like that is or should be illegal, but i'm not sure. The reason it is so murky is the person behind Selen just goes by the character's name entirely and portrays that character during all interactions. I don't know if you can legally argue that they are "impersonating" the person because no one knows who the person is and are only known or acknowledged as the character themselves AND said everything about their personal life AS the character. Which opens up some real weird possibilities, like those personal stories she told about her own real life possibly becoming property of Nijisanji.
      And yes, as crazy as that sounds, it COULD happen. It's not much different from how many tech companies, as part of the contract you sign when you join them, says that if you ever invent anything, create anything, or whatever, that the corporation OWNS your idea even though they had nothing to do with it. They literally have a right to steal your thoughts and ideas that have nothing to do with your job.
      This whole world sucks to be honest. So tired of greed, dishonesty, and just awful people. I just wanted to kick my feet up and listen to a purple dragon with a long neck laugh about stupid things. Now I have to listen to a tomato thats also a bird thats also a human thats also a bounty hunter thats also a thief... I don't even know what she is. Still like her laugh though.

    Real problem Sayu suing Nijisanji is Business Entrustments are settled by Litigation in an agreed court and the damages are limited in the Business Entrustment as agreed
    Cause Sayu was only there for 2 months she would only get 2 of 6 months of her IP and merch sales
    Looks like Selen, on the other hand, got a proper Tokyo based Business Entrustment Litigation Lawyer that scared Nijisanji into settling(Termination letter meantions they'll pay her by March 31,2024 while denying doing anything wrong and Selen has damaged their reputation which such claims) so she got her 6 months settlement but they terminated and defrocked her in spite not realizing the backlash it would cause

    I wonder if the "liver" specification can be used to justify impersonation lawsuits. It's a separate word from character and more closer to streamer which imply the person behind the character.

  • @TheAdmiral14
    @TheAdmiral14 2 หลายเดือนก่อน +4

    Again, circumstantial, but skinwalking or at least being uninformed were probably involved in the black screen stream in my opinion. Ren retweeted it however he had previously made some tweets that showed sympathy for Selen. A later deleted tweet said he was upset and remarked "very unfair." There was also something about a colored heart (purple?) that was later deleted and replaced with a green one. Memory's poor on that one. Either way, some of them willingly would but they almost all did and it seems very unlikely to me that pretty much no one would've refused to.

      Fans get attached to the VA cause IP character isnt real and most people know that much
      Its really bad when fans can't disassociate the 2 like fans sending death threats to Larry Hagman over what JR of Christopher Reeve knocking down someone trying to steal his bike and on seeing Reeves the their shouted "I'm sorry, Superman"

Not giving their talents salaries and support only to dump billions of Yen on the trash, favoring particular talents and promoting groupthink over anything, ACCELERATE!!!, terminating their golden goose for the most asinine reasons, their PR training being practically non-existent (because even if they did receive training, it doesn't reflect their recent actions), and tweet campaigns that will definitely happen again (i.e. I love artists. As a Singaporean, I can assure you that ACG (Anime / Cosplay / Gaming) events tend to be flocked well enough to make a good impression. There is supply to match the demand. Vtubers may be new to the space if we talk about recent years, but we already have proof of impressive turnout on previous posts about such events.
    This is why Virtual Rhapsody's turnout is so damning - publicly shamed to shambles.
