Hi! I would probably ask that question to NVC before taking a decision wether to resubmit or not. I am sure it's a situation that a few people encounter. I ride but not so much... way more bike appearances on my shirts than in real life. I just use it as a mean of transportation for certain things. But, aren't they pretty?

Hi, your status will change and your AOS will resume processing . As to specific timeline it's hard to say, you can check the current estimates in the USCIS website . As for the second part of your question, I don't fully understand. Retrogression happens when you have submitted AOS because you are current and then the dates in the bulletin move backwards

Yes, if you are DQ and your PD is current, it is normal that the call you for an interview. Sometimes they take a bit longer if the embassy or consulate itself has internal backlogs

Hi, I am not a lawyer, so I will try to answer generally without getting into your specific situation. As far as I know, you can never travel into the US with an expired visa. Regardless of having an approved petition. The only way one can travel back to the US is if you obtain a Travel Document (Advanced Parole, with I-131) before initiating your trip. Congrats on the approval! It's going to take a long time. First, you need to become current based on the visa bulletin. Second, the specific embassy has to have appointments available. As far as I know Islamabad's embassy is one of the slowest in the world, but I can't tell you an estimate because they don't publish that data

The interview location is automatically assigned to the country of birth unless you can prove that you're a permanent resident of another country, Spain in your case.

If your category is EB2 the date for filling is not the one you wrote, it is in 2023. If your PD is from January 2023 then it will be current in JANUARY, that is why it is the January Visa Bulletin, so obviously you should not mail it in December

I don't think an NIW is the right category for that unless you can argue it's of national importance. I would contact a lawyer to understand if there is a visa for your profile

For EB2 1ST NOV is the final action date. Does it mean the guy whose PD is 1st November so is he also counts as current???

@bagiissak How did one apply for work permit before applying I-140? I thought one only could have work permit after you have I-485 form approved? please help explain as I self petition my EB1 and I can't find this information anywhere
@@kobeng.1836 you can only apply for work permit when you file adjustment of status . From I-764 can be filed together with I-485. My online course explains all this, check it out in eb1greencard.info
@@OscarsGreenCard Ah I see, I planned to apply I-140 premium processing then wait for its result before apply I-485 and I-764, that's why I didn't understand why she could have work permit EAD before I-140 approved. In her case, she might just file concurrently for all of them but not premium processing I-140, thus she has work permit while waiting for it, correct?
