The filmmakers didn’t have the permission to include it in the soundtrack because:
Music tracks from movies often remain unreleased on the official soundtrack because filmmakers may not have secured the necessary rights to include them, due to licensing complexities, cost constraints, or specific usage agreements with the artist, meaning they can only use the music within the film itself and not on a separate album release; essentially, it's a matter of acquiring additional permissions to put the music on a soundtrack album beyond just using it in the movie.

So yk how in Sonic 1, we have eggman, the only villain, then we had eggman AND knuckles in Sonic 2, now in Sonic 3, we have 3 villain, Shadow, Gerald and technically Eggman.
