She was 4+ people in a car without proper paperwork, so the cops don't know who she actually was. At the very least she has to be thoroughly background checked and cleared. All the charges were dropped once they realized the full story. However illegally abusing 3+ substances also ruins people's lives.
You were not paying attention. They stopped the car because the plates showed that the vehicle was towed and marked as abandoned. Then while waiting for her father, the owner, to show up, they asked "Can I search your car", which they have no reason to except that they had nothing else to do while waiting for her dad to show up. She said "OK, fine" even though she had the fake IDs on her. They weren't hunting for kids with fake ids, they rightly stopped the car because its plates were flagged. The way it could have played out, and should have, is that her dad shows up, shows his ID and car registration and then the cops say "OK, we'll confirm in our system that the car is not abandoned" and then everyone goes home. The cops didn't force her to get fake IDs, but once they saw them they were duty bound to act on it.
Prime example of why don’t break the law because they were already suspicious of her because the car was listed as abandoned even if she would not have consented to the search they would have got a warrant it was a suspicious vehicle
The Judge may give her leniency because of her age, mannerisms, and remorsefulness. The law shouldn't just punish people for minors mistakes but it's also for correction and the betterment of the individual

Former LEO here. Here's a simple solution to this for the little lady: Never voluntarily allow anyone to search your property - person, vehicle, house, etc. If the officer says they have a right to search you or your property, don't fight it (even if you don't think they're in the right), but continually state that you do not consent to any searches. Exercise your right to both remain silent AND have an attorney present. YOU NEED TO TELL THE OFFICER(S) THAT'S WHAT YOU'RE DOING. Just staying quiet can appear to be "uncooperative" (like it or not, it is what it is) and "interfering with an investigation." So, tell the officer(s) that's what you're doing every single time they ask you a question - "I'm exercising my right to remain silent, and not answer any questions without my lawyer." DO NOT answer some questions, and not others. The moment you start answering questions, some courts will say you've forfeited your right to silence. FOR THE OFFICERS: Simple solution: Take the pen and ID cards. Shred the ID cards and trash everything. Log it into your system under her Name and DOB, and SSN too if you have it. Tell her if she gets caught with either again, she will certainly be charged because she's already had her warning. EDIT: WHY DO THIS TO SOMEONE? YOU EVEN SAID YOURSELF YOU KNEW SHE WASN'T A BAD KID. This young lady was not a dangerous person, nor a criminal. She doesn't even have the stomach for trouble. You have just potentially ruined her life by charging her with a felony - it is a question she will have to answer on every single job application for the rest of her life if she's convicted of it. Why would you want to do that to someone you know isn't someone society needs to be protected from? This kind of garbage is what gives LEOs a bad reputation. This is why people are gradually falling away from supporting Law Enforcement as a whole. This is how bad LEO's make decent people into career criminals, or otherwise products of the system. Yeah man, I absolutely distrust and mostly dislike Police, Not all but most and this is despite there being a pretty strong connection with combat vets and Police. Lot of my buddies became Police after getting out, and I can't help but to think think lower of them now.
I can attest to this. I was falsely accused of punching somebody, wrongfully arrested, and despite the magistrate seeing I was telling the truth (because my side of it was consistent and the other person kept changing their story), and dismissed the case, I still have it on record for the rest of my life. And trust me, potential employers completely overlook the dismissed part and concentrate on the charge. The legal system is absolutely f*cked!

By cooperating and being honest she got the charges dropped. If she was difficult and problematic she'd be in jail. With multiple fake IDs it could have been a serious fraud case and someone could be pretending to be an alcoholic college student. At the very least, they should have investigated and cleared her.

The offenses were pretty minor stuff, but it's not hard to imagine a girl with a weed pen and multiple fake IDs not taking a warning seriously and hurting herself and others while OUI six months down the line. Depending on legislature in different states, hiding things and moving items around in plain sight is either reasonable suspicion allowing a vehicle search - or in some states it is probable cause on its own. Either way you can say no if they ask you, but if a prudent officer believes you were hiding things in plain sight, your car is going to either get searched - or sniffed by a k9 for more probable cause and searched anyway. I feel the simple answer is - don't commit crimes...

None of this had to happen if she simply refused to consent to the search. The cops cannot legally search your car without a warrant or probable cause. By trying to be polite, this girl got herself in further trouble. There is nothing rude or unfriendly about asserting your rights. The cops are not there to be your friends.

The evidence would have been inadmissible if she didn’t consent because her lawyer could challenge the validity of the search.

As a deputy, I don't understand the alert for an abandoned vehicle. Once a vehicle is towed it can only be released to the owner. If it was released to someone else that's on the tow company. That's a civil matter, not a crime. This whole situation makes no sense.

Worthy suspects. I assume you mean killers and drug dealers. These are traffic cops. They make traffic stops. That's their job. They catch people speeding, DUI, wreckless, and several other traffic infractions. Finding the felony fake IDs fell into their lap. See, there are multiple departments in the police force. Like traffic! This is what they do. They don't hunt down murderers; that's the job of homicide division. The homicide division employs a variety of officers and detectives to go after your so-called worthy suspects. There is also a narcotics division. These guys go after the drug dealers. Never ever ever ever consent to a search when law enforcement has not established probable cause...there is never any upside. If they want to go on a fishing expedition, make them earn it.
Never consent, period. If they have probable cause then they don't have to get consent. If the probable cause is found invalid in court then the search will be thrown out. But, if you gave consent then there's pretty much no way to have it tossed.

It should never have come to the point where she was even charged with anything. Total waste of taxpayer's money. It should have been a citation or warning from the get go. Instead it had to be brought before a judge and dismissed, wasting the court's time and this "perps" time. This is simply a means to increase arrest stats for the precinct in order to keep funding. It wouldn't surprise me in the least if these officers are advised to take advantage of people that are clearly cooperative to boost arrest numbers.

Being mature about it is why she got all charges dropped after completing 75 hours community service with a charity group. After watching plenty of these videos, we've all become accustomed to watching immature people fighting and obstructing, adding a half dozen more charges. You were not paying attention. They stopped the car because the plates showed that the vehicle was towed and marked as abandoned. Then while waiting for her father, the owner, to show up, they asked "Can I search your car", which they have no reason to except that they had nothing else to do while waiting for her dad to show up. She said "OK, fine" even though she had the fake IDs on her.
They weren't hunting for kids with fake ids, they rightly stopped the car because its plates were flagged. The way it could have played out, and should have, is that her dad shows up, shows his ID and car registration and then the cops say "OK, we'll confirm in our system that the car is not abandoned" and then everyone goes home.
The cops didn't force her to get fake IDs, but once they saw them they were duty bound to act on it.

Former LEO here. Here's a simple solution to this for the little lady: Never voluntarily allow anyone to search your property - person, vehicle, house, etc. If the officer says they have a right to search you or your property, don't fight it (even if you don't think they're in the right), but continually state that you do not consent to any searches.
Exercise your right to both remain silent AND have an attorney present. YOU NEED TO TELL THE OFFICER(S) THAT'S WHAT YOU'RE DOING. Just staying quiet can appear to be "uncooperative" (like it or not, it is what it is) and "interfering with an investigation." So, tell the officer(s) that's what you're doing every single time they ask you a question - "I'm exercising my right to remain silent, and not answer any questions without my lawyer."
DO NOT answer some questions, and not others. The moment you start answering questions, some courts will say you've forfeited your right to silence.
FOR THE OFFICERS:
Simple solution: Take the pen and ID cards. Shred the ID cards and trash everything. Log it into your system under her Name and DOB, and SSN too if you have it. Tell her if she gets caught with either again, she will certainly be charged because she's already had her warning.
EDIT: WHY DO THIS TO SOMEONE? YOU EVEN SAID YOURSELF YOU KNEW SHE WASN'T A BAD KID.
This young lady was not a dangerous person, nor a criminal. She doesn't even have the stomach for trouble. You have just potentially ruined her life by charging her with a felony - it is a question she will have to answer on every single job application for the rest of her life if she's convicted of it. Why would you want to do that to someone you know isn't someone society needs to be protected from?
This kind of garbage is what gives LEOs a bad reputation.

Yeah man, I absolutely distrust and mostly dislike Police, Not all but most and this is despite there being a pretty strong connection with combat vets and Police. Lot of my buddies became Police after getting out, and I can't help but to think think lower of them now.
I can attest to this. I was falsely accused of punching somebody, wrongfully arrested, and despite the magistrate seeing I was telling the truth (because my side of it was consistent and the other person kept changing their story), and dismissed the case, I still have it on record for the rest of my life. And trust me, potential employers completely overlook the dismissed part and concentrate on the charge. The legal system is absolutely f*cked!

By cooperating and being honest she got the charges dropped. If she was difficult and problematic she'd be in jail. With multiple fake IDs it could have been a serious fraud case and someone could be pretending to be an alcoholic college student. At the very least, they should have investigated and cleared her.

Don't get me wrong I don't feel a personal threat from this girl. But the law is the law and no one is above it. If you allow one you have to allow all. Also she was treated very nicely she did not get convicted of the felonies. She had to do 75 hours of community service with a Non Profit of her choice. So all in all she was treated kindly and fairly and it prolly was a learning experience for her.

Her "crimes" here were pretty harmless. Many people in college have fake ID's, she was turning 21 in 5 months, and recreational marijuana use is legal in 25 states and counting. She shouldn't have gone to jail. Her charges were dropped and she did some community service, so obviously the legal system agreed.

For anyone who wants to know. The charges were reduced to 75 hours of community service when it was found out the officer ran her license plate for no reason. In the state of Florida, police officers cannot randomly run a persons tag without a reason of suspicion or probably cause. This cop was obviously hunting and pecking.

Depending on legislature in different states, hiding things and moving items around in plain sight is either reasonable suspicion allowing a vehicle search - or in some states it is probable cause on its own. Either way you can say no if they ask you, but if a prudent officer believes you were hiding things in plain sight, your car is going to either get searched - or sniffed by a k9 for more probable cause and searched anyway. I feel the simple answer is - don't commit crimes...
She absolutely should have said no to the search. But no one understands or believes the cops are not your friends till you're in the back of that cop car, handcuffs digging into your skin, going through processing and sitting in the holding cell waiting for your call.
It's only then people actually bother to learn their rights.

The evidence would have been inadmissible if she didn’t consent because her lawyer could challenge the validity of the search.

As a deputy, I don't understand the alert for an abandoned vehicle. Once a vehicle is towed it can only be released to the owner. If it was released to someone else that's on the tow company. That's a civil matter, not a crime. This whole situation makes no sense.

Worthy suspects. I assume you mean killers and drug dealers. These are traffic cops. They make traffic stops. That's their job. They catch people speeding, DUI, wreckless, and several other traffic infractions. Finding the felony fake IDs fell into their lap.
See, there are multiple departments in the police force. Like traffic! This is what they do. They don't hunt down murderers; that's the job of homicide division. The homicide division employs a variety of officers and detectives to go after your so-called worthy suspects. There is also a narcotics division. These guys go after the drug dealers. There are a lot more if you want to go to Google and help educate yourself on law enforcement and crime.

Never consent, period. If they have probable cause then they don't have to get consent. If the probable cause is found invalid in court then the search will be thrown out. But, if you gave consent then there's pretty much no way to have it tossed.

It should never have come to the point where she was even charged with anything. Total waste of taxpayer's money. It should have been a citation or warning from the get go. Instead it had to be brought before a judge and dismissed, wasting the court's time and this "perps" time. This is simply a means to increase arrest stats for the precinct in order to keep funding. It wouldn't surprise me in the least if these officers are advised to take advantage of people that are clearly cooperative to boost arrest numbers.

They could've placed her under arrest for suspicion of grand theft auto, and searched the car afterwards, and how do you think that would've played out in court?

@@iCortex1ur right about them having probable cause to search but however if I cop uses the k9 excuse you could possibly get away with it. For instance if I get pulled over speeding but it takes them over an hour to get a k9 out and find something then the whole case could get dropped because they detained u for an unreasonable amount of time to find it. With no probable cause on why they made u wait that long
