- The New Mexico judge in the "Rust" shooting trial has denied another motion by Alec Baldwin’s legal team to dismiss charges, this time based on the gun in question being damaged during forensic testing. This comes as jury selection for the trial is expected to start in less than two weeks.

It wasn't premeditated (first-degree) nor done with malice without premeditation (second-degree). It may fall under third-degree (recklessness or inattention). However, in a situation where the individual pulling the trigger is an actor on a film set and has no idea whether the gun they're firing is loaded (unless they take the time to check), the responsibility typically falls to the armorer. 'Rust' armorer Hannah Gutierrez-Reed was found guilty of involuntary manslaughter and sentenced. The ruling was just and accurate.
@@kxmode wrong. he still has a duty to handle the firearm safely regardless of whether he knows it has live rounds or not. Actors are instructed to treat all real guns as if they are loaded. Same safety rules apply whether on film set or not. That's why actors receive firearm safety training. He violated basic safety protocol and handled the weapon recklessly. That's why he's charged with involuntary manslaughter.
Baldwin needs to be put in the New Mexico State Penitentiary for life!!
I wish he wasn't using that argument. It seems implausible, thereby making it easier to doubt him. He didn't know there were live bullets in the gun. As such, the person responsible for the young lady's death has already been convicted.

Hannah Reed was convicted in March of involuntary manslaughter, after a jury found that her negligence caused the death of Halyna Hutchins. Judge Marry Sommer said Reed had not shown any remorse. Judge also said to Reed “ You alone turned a safe weapon into a lethal weapon. And is spending 18 months in prison she should get more prison time. The victim was transported to UNM, Albuquerque. By car it would have been 45 miles but helicopter faster.

The gun didn't "just go off", guns don't pull their own triggers.
Some guns have malfunctioning firing mechanisms, the sig 320 had a bad time because of it. That said, even a weapon malfunction through no fault of your own can land you in prison.

Based on his interviews and the gun model itself, Baldwin was holding the trigger when he cocked the hammer. Since the trigger was depressed, the hammer released immediately upon Baldwin letting go of it.
I have been an arms instructor for more than 40 years. If I had a dollar for every time I was told My finger was not on the trigger, or that the gun is unloaded, I would be very wealthy. As for the gun being broken, that is not correct, the hammer was broken, and repaired, big difference, You would not find, I think any single action shooters that would not find him guilty.

It looks like he had a reasonable expectation that the gun was safe...It also looks like the right person IS in jail..
Baldwin is responsible for all of this. His production company hired the armorer and he pulled the trigger. There are protocols for a reason and he ignored them.
A woman dies because of his negligence. He should go to jail.

He was the last one to hold the gun and aim. He should have double checked if it was live ammo as the last person in the row. If the armorer got arrested then every who handled the gun on the way to filming should get arrested as well.
The armorer did not hand the weapon to Baldwin because Baldwin had banned her from the church during the rehearsal. Baldwin accepted the firearm from an Assistant Director who pled guilty to mishandling a dangerous device and is currently on probation.
So far, Alec Baldwin is the only one involved with this incident who has not suffered consequences from the legal system.

It is UNBELIEVABLE that they would take a mallet to a gun and risk a criminal case.
Kind of interesting they would make such a basic mistake.
I'm pretty sure it's a standard test whenever there's a claimed discharge without the trigger being pulled. The idea is to hit and jar the hammer to see if it will unseat and fire once cocked (or half-cocked). It's more unbelievable that Baldwin's attorney thinks that should get the case dismissed. Even if the gun magically fired itself, Baldwin still pointed an incredibly dangerous weapon directly at another human being. The absolute basics of gun safety means he should have been treated that gun as if it were loaded, which indeed it was in this case.

I think what happened is he doesn’t know revolvers. Guns in general. I think the hammer was pulled back and the trigger didn’t need much to go just touching hard enough set it off.

FYI. Those facts that make it plausible that Balwin did it are the following.
Balwin banned the Armorer from the set that day.
Balwin had been in multiple heated arguments with the victim for weeks.
Balwin didn't render aid or even acknowledge the incident when it occurred.
Balwin was the last person to handle the firearm.
All of these make it plausible Balwin could have put in the live round, himself. Good luck trying to get a conviction that it was intentional, though. No witness is going to come out and say they saw him do that.

It was for use in the movie..Movies often use these reproduction firearms as they look and function exactly like the Original in this case it looks just like a Colt from that time period.. They are also usually cheaper than replicas and will look and sound more realistic firing blanks ..

I believe as the producer, he is responsible for civil liability but not criminal. This was a safety issue. Boeings CEO is crashing planes all over the world and he got a raise.

Actors are not responsible for checking guns before each use. Instead, the responsibility is given to qualified professionals, such as prop masters or weapons handlers, who are trained in safety and oversee the use and handling of firearms. Actors are not expected to be experts on guns or experienced in their use. Everyone do your research and have common sense before hating someone
