In this edition of Tarikh, Nikhil talks about Justice Mehr Chand Mahajan, the third chief justice of Supreme Court. He was also an accomplished
lawyer, a respected judge, and an influential politician. As a judge he had many leading judgements to his credit. He was the nominee of Indian National Congress on the Radcliffe Commission and played an important role in getting Gurdaspur and Firozapur districts into India’s fold. In October 1947 he became the prime Minister of the state of Jammu and Kashmir on insistence of Maharaja Hari Singh and played a key role in the accession of the state to India. How Gurdaspur was include in India’s side of map? What was the role of Justice Mahajan? And How Kashmir factored into it?

Justice Mehar chand Mahajan resident Mission Road , Pathankot had vast tracts of land parcels in Pathankot belt. To safeguard their land parcels going to Pakistan. The decision was taken that this area be included in India. The family runs a very good company known as Glacier products .

The issue of Gurdaspur and Ferozpur were also closly linked to utlisation of rivers and water that will go to India and Pakistan. Without these two areas Madhopur barrage, Hussainiwala Harike pattan and Ganga Singh canal would not have been possible. However, loss of Lahore was a very big blunder as Lahore was center of the Hindu and Sikh population, business, educations, and culture. In fact Lahore was heart of Punjab and even now must be taken back. Shakargarh was a bone of contention in 1965 and 1971 wars and will one day again be part of India.
Our family came to India from Shakergarh in 1947.

Nikhilji, I am a fan of your voice. In the book "Freedom at Midnight" the authors point out that Redcliffe wanted to use rivers as boundaries and that led to Ferozpur becoming a part of India.

India's military operations in Kashmir valley in 1947-1948 owe their logistical facilitation to then derelict road between Jammu and Srinagar which came to India after the Accession of the Riyasat of Jammu and Kashmir.This narrow road had wooden bridges etc and was used only twice a year during the biannual shifting of Riyasat's capital between Jammu and Srinagar .The Maharajas of J and K wished avoiding the main highway passing through the territory of the British .for the sake of privacy and hence had got built a simple though dangerously passing across the formidable Pir Panjal mountains . This road was used nearly only twice a year nearly exclusively for carrying Darbar shifting specific traffic. Just before the convoys moved on this road it was repaired in a makeshift manner . Before 1947 the main highway connecting Jammu and Srinagar ran through Sialkot and Muzzafarabad - the Jhelum Road -then under British India's direct control.After Partition of India this went to Pakistan .. In fact during the time delay in Maharaja Hari Singh's decision on Accession of J and K ,Pakistan's military and political leaders would arrogantly boast that Kashmir was in Pakistan's pocket as for even ' one can of kerosene ' the Valley depended on the Sialkot Highway which Pakistan had under her control..Maharaja's special purpose Darbar shifting road which was first used for Indian Army's logistical support to the Valley and connectivity to Ladakh - through the Zoji La Pass .In its constantly upgraded form this erstwhile simple / rudimentary road is , now ,India's main and world standard Highway to Kashmir.

Justice Mahajan should have played his role to keep the Gurdwara Kartarpur Sahib in India's territory. Perhaps, Sikhs were never on priority list of Congress. Although it was good idea to keep river as natural boundary between Pakistan and India but rivers shouldn't be considered as permanent boundary as with the passage of time, rivers tend to deviate from it's course of flow. For instance., Gurdwara Sahib was situated exactly on the bank of river Ravi because last rites Guru Nanak Sahib were performed on it's bank.But now river Ravi has deviated it's course almost 2 KM towards India. And now Ravi flows two km away from Gurdwara Sahib. Sikhs were deprived of one of their holiest shrines forever.
Justice Teja Singh who was a Sikh was also a member of the commission. He should have fought for Kartarpur Sahib.
