Yes, Florian did do his regular BadGear review of the instrument, but the first 1:05 of his video was the funny mashup as an intro. The rest was his normal review/demo. I think that the video by ScottsSynthStuff is still very relevent, because TE has proven that they're ready to attack creatives. Any company marketing to creatives (ie. musicians) has to have a sense of humor, so the musicians know they're safe dealing with that company. If I fear that a company will call a strike on me the second I step over some line, and if their license to use the material is abnormally restrictive, as ScottsSynthStuff pointed suggests, then who will trust that company with their creativity?
Scott Synthy guy's first opening statement was that TE is "weaponizing" their content. That is some intense hyperbolic trolling IMO. I mean seriously? That's like using shock trolling for attention and it worked. You all fell for it.

He was the one that started a thread on Florian's video, citing that the take down was for using samples in the machine, not sampling original TE content. Even Florian stated why the take down was issued and it had nothing to do with his music, samples, or anything else this guy could conjure up all because he wants to besmirch TE. The malice behind his comments is real, the thread was deleted, but I have a ton of replies in my email notifications that paint a vivid picture of that person's ulterior motives. He asked for clarification from Florian, Florian did not respond so he kept with his negative narrative, which was to bury TE. I called him out numerous times and asked for evidence, but he would not give any and kept accusing me of being a lawlyer for TE. I mean yeah LAWLYER (he stated lawyer but lawl is good too). The issue could have all been avoided if some people simply did some fact checking, TE has done nothing in a response video, but there are a few videos floating around of some sort of conspiracy against Florian. I mean cancel culture is real, and it doesn't get any realer than this. Florian is a super cool guy, he just got caught up in some red tape and he has had no harm to his channel, TE however has had some unsavory things said about them due to the misinformation, if they wanted to, they have rights to sue said posters for harming their brand.

Yes! You can use the samples in the instruments on a royalty free basis. It’s literally just because they used their advertisement in their TH-cam video has nothing to do with using individual samples that come with their products.

4:30 The user agreement is kinda restrictive and open ended when using language like "unless it is substantially transformed into an original creation." "Sunbstatially" is highly subjective. What happens when I use a minute of their kick sample with just some reverb and spoken word as an intro, but I'm bashing TE? They have lawyers on retainer. I don't. Just the process of pretending to sue is wasting my time and loses me money. For them it is part of their budget. I do think that this language is just another example of the evolution of businesses trying to not let anyone truly own anything. TE could have fun terms of service that say "don't redistribute our sounds as your own, have fun making music." We don't want to think it is that simple but it is.
It sure is more vague and restrictive than it should be, I'm not trying to defend them. I'm also not a legal expert and I don't use or intend to use any of their products. But my point was if you already own one of them it's probably fine to use them in music or videos. It's also probably more about the loops because they are more recognisable than a single hit.

TE has not striked anyone using their samples in a song. Ever. Hopefully they don't? But they haven't. I uploaded a direct side-by-side playthrough of their original and the removed video, muted. You can see why they removed it.
It's not really false. First off, copyright legislation differs between countries. Even the word 'copyright' itself has no legal meaning in the European Union (both Teenage Engineering and Bad Gear are inside the EU) except probably Ireland, because no other country writes its legislation in English. Second, you're bound to TH-cam's terms of service. If they deem it's a copyright strike, your options are limited. Are you going to sue Google? They have a bigger legal budget than you do. Third, Florian did copy the entirety of the audio track, and quite a bit of the promotion video. It was meant as a parody, but whether it falls under fair use as a parody would be up to the courts to decide, which brings us back to point 2: you cannot out-sue Google as an individual. It was a heavy-handed and, frankly, stupid move by Teenage Engineering, but calling it 'false' would require some substantiation. Not that it'll make any difference. TE fanboys will keep buying their products, even if they sold bottled farts. And TE criticasters will continue to think of them as a humourless firm that sells grossly overpriced Lego to hipsters.

What is false are the claims that @scottk3292 has been spreading maliciously, with intent to harm TE. He is the source of all this misinformation which started on Florian's video, he has 200+ upvotes which he stated "the people will decide". His thread was since removed by either him or Florian, but the damage was done and the spread of misinformation had already fueled other haters with their agenda to cancel TE. I have all the email responses from said thread, and this person who willing did this, also made Scott's Synths channel look foolish when Scott never fact checked the real reason of the CR strike. People will believe anything, as long as it aligns with their negative narrative.
The copyright strike by TE will almost certainly damage their sales. It further re-enforces the perspective many have of the brand that it sells less for more. Good money that could be spent on more worthy gear than TE’s
Yep. I didn't have a lot of time for the company before all this and I am even less likely to buy their products now. They went after Bad Gear out of malice. No other reason. This wasn't a YTer who was 'passing off' TE's hard work as his own, it was a brief (and funny) parody. TE did not HAVE to initiate a copyright strike. They chose to do so, deliberately, and to try to intimidate a content creator who was (quite gently) taking the piss out of their product. Even though - ironically - gear that appears on Bad Gear gets quite a lot of exposure, and Florian always manages to create bangers with whatever he features so I don't think being on Bad Gear actually harms sales volumes at all. To cap it all, there seems to be a small army of trolls active on YT who seem to have gone mental over all of this. Being a TE fan is one thing... being a TE troll is something else.
I remember Florian went to some event a couple of years back and sort of sent up everyone exhibiting, I remember the TE person didn't take the joke well whereas everyone else took it in their stride. It might have been something on Sonic State?
Teenage Engineering is mainly focused on generating controversy, not just when it comes to price, but also with its overall appearance. This copyright strike is perfectly in line with their strategy. People are talking about it and that's exactly what they want.
If I understand things correctly, TE claimed copyright infringement for a parody, which should be protected under fair use. Additionally, this brought attention to their terms of service for their samplers, and unlike other sampler makers, they give far less freedom in how their samples are used in creating music (which is a dealbreaker for me, especially since it's supposed to be a standalone instrument, and wouldn't for sure meet their standards if used as a standalone instrument).

i get them sometimes .One type means no money but i do not make money from my site so i do not care the other is more serious with the whole thing being blocked.The worst is having the work removed which i of course have copies elsewhere but also getting a strike against you which can result in you being unable to post for a while .Three of these mean goodbye to that site .I have more than one and i have lost or abandoned others so i still post.This current run is the best so far but i am still not in a position to make money but it also means i post what i want and just wait to see what happens.As i gain more subs and views i get more trouble over current but also older posts but until i am banned outright i will continue to post and let the the strikers do their worst.

@@DankePlace Which countries do you mean? Austria and Sweden, respectively home country of Florian and Teenage Engineering, are both subject to European law. European law contains a parody exemption. (eur-lex.europa.eu/legal-content/EN/TXT/?uri=ecli%3AECLI%3AEU%3AC%3A2014%3A2132). In case of TH-cam (based in California) you can file a DMCA-claim. The parody-exception in the USA is governed under fair use, which is in general more forgiving and less strict than European copyright law. So, as long as they don’t go to court in Austria or Sweden, Florian and TE are subject to American law and thus fair use is applicable.

Those who object to this are blatantly in bad faith and raise more than a suspicion that there are preordained haters! Ask yourself how it is possible that they found his private cell phone number! I personally would never use gear or samples from a company that I can't trust to have a sense of humor. If they decided that I didn't alter the sample enough, and if they end up being overly lawsuit-happy, then I'd find myself in hot water. I share the sentiment of others in the comments that after seeing a trusted content creator get burned like this, I would never trust TE enough to use their stuff in my creations. And public opinion rules the stock markets and sales figures.
Just curious. I am not synth person, but am familiar with the T.E. KO ii from youtube videos. If T.E. stuff is overpriced, what is comparable to the T.E. KO ii at $299? That seems relatively inexpensive vs the kit that all these more professional channels are pushing.
@@scottgibson6022 their pocket operators and whatnot aren't priced terribly. I mean, they aren't exactly cheap for what you get, but they are at least somewhat within reason. they are around the same price as your average guitar pedal or something. what people mostly complain about is the 6 channel tiny mixer with some digital FX that is priced at $1200. and their flagship synth which is basically just some plugins in a cheap plastic keyboard chassis (with awful keys btw) that goes for $2000.
So do we even know for sure it was TE that initiated the copyright strike? Florian also used footage from Monty Python. Couldn't that also be subject to such strikes? Wouldn't either entity be within their rights to protect their IP from unauthorized duplication? I'm seeing a lot of knee-jerk reactions on this but I'm yet to see anyone go to Teenage Engineering and be like, "Hey, can you explain this? Was this you? What happened?" Seems like a lot of people have this irrational hatred of this brand and their using this to fuel that hatred further without getting down to actual facts. Sad to see this mob mentality in the synth world.
It was 100% from TE, Florian posted that there is a post on his patreon which shows the DMCA. It's in German but Florian does explain why and how it was done.

Yes, Florian did do his regular BadGear review of the instrument, but the first 1:05 of his video was the funny mashup as an intro. The rest was his normal review/demo.
I think that the video by ScottsSynthStuff is still very relevent, because TE has proven that they're ready to attack creatives. Any company marketing to creatives (ie. musicians) has to have a sense of humor, so the musicians know they're safe dealing with that company. If I fear that a company will call a strike on me the second I step over some line, and if their license to use the material is abnormally restrictive, as ScottsSynthStuff pointed suggests, then who will trust that company with their creativity?
Scott Synthy guy's first opening statement was that TE is "weaponizing" their content. That is some intense hyperbolic trolling IMO. I mean seriously? That's like using shock trolling for attention and it worked. You all fell for it.

Even Florian stated why the take down was issued and it had nothing to do with his music, samples, or anything else this guy could conjure up all because he wants to besmirch TE.
The malice behind his comments is real, the thread was deleted, but I have a ton of replies in my email notifications that paint a vivid picture of that person's ulterior motives.
He asked for clarification from Florian, Florian did not respond so he kept with his negative narrative, which was to bury TE.
I called him out numerous times and asked for evidence, but he would not give any and kept accusing me of being a lawlyer for TE.
I mean yeah LAWLYER (he stated lawyer but lawl is good too).
The issue could have all been avoided if some people simply did some fact checking, TE has done nothing in a response video, but there are a few videos floating around of some sort of conspiracy against Florian. I mean cancel culture is real, and it doesn't get any realer than this.
Florian is a super cool guy, he just got caught up in some red tape and he has had no harm to his channel, TE however has had some unsavory things said about them due to the misinformation, if they wanted to, they have rights to sue said posters for harming their brand.

Yes! You can use the samples in the instruments on a royalty free basis. It’s literally just because they used their advertisement in their TH-cam video has nothing to do with using individual samples that come with their products.

4:30 The user agreement is kinda restrictive and open ended when using language like "unless it is substantially transformed into an original creation." "Sunbstatially" is highly subjective. What happens when I use a minute of their kick sample with just some reverb and spoken word as an intro, but I'm bashing TE? They have lawyers on retainer. I don't. Just the process of pretending to sue is wasting my time and loses me money. For them it is part of their budget.
I do think that this language is just another example of the evolution of businesses trying to not let anyone truly own anything. TE could have fun terms of service that say "don't redistribute our sounds as your own, have fun making music." We don't want to think it is that simple but it is.
It sure is more vague and restrictive than it should be, I'm not trying to defend them. I'm also not a legal expert and I don't use or intend to use any of their products. But my point was if you already own one of them it's probably fine to use them in music or videos. It's also probably more about the loops because they are more recognisable than a single hit.

It's not really false.
First off, copyright legislation differs between countries. Even the word 'copyright' itself has no legal meaning in the European Union (both Teenage Engineering and Bad Gear are inside the EU) except probably Ireland, because no other country writes its legislation in English.
Second, you're bound to TH-cam's terms of service. If they deem it's a copyright strike, your options are limited. Are you going to sue Google? They have a bigger legal budget than you do.
Third, Florian did copy the entirety of the audio track, and quite a bit of the promotion video. It was meant as a parody, but whether it falls under fair use as a parody would be up to the courts to decide, which brings us back to point 2: you cannot out-sue Google as an individual.
It was a heavy-handed and, frankly, stupid move by Teenage Engineering, but calling it 'false' would require some substantiation.
Not that it'll make any difference. TE fanboys will keep buying their products, even if they sold bottled farts. And TE criticasters will continue to think of them as a humourless firm that sells grossly overpriced Lego to hipsters.

He is the source of all this misinformation which started on Florian's video, he has 200+ upvotes which he stated "the people will decide".

I have all the email responses from said thread, and this person who willing did this, also made Scott's Synths channel look foolish when Scott never fact checked the real reason of the CR strike.

Yep. I didn't have a lot of time for the company before all this and I am even less likely to buy their products now. They went after Bad Gear out of malice. No other reason. This wasn't a YTer who was 'passing off' TE's hard work as his own, it was a brief (and funny) parody. TE did not HAVE to initiate a copyright strike. They chose to do so, deliberately, and to try to intimidate a content creator who was (quite gently) taking the piss out of their product. Even though - ironically - gear that appears on Bad Gear gets quite a lot of exposure, and Florian always manages to create bangers with whatever he features so I don't think being on Bad Gear actually harms sales volumes at all. To cap it all, there seems to be a small army of trolls active on YT who seem to have gone mental over all of this. Being a TE fan is one thing... being a TE troll is something else.

Teenage Engineering is mainly focused on generating controversy, not just when it comes to price, but also with its overall appearance. This copyright strike is perfectly in line with their strategy. People are talking about it and that's exactly what they want.
This is a huge PR gaff by TE. I'll never buy their products again after, realising they are OK selling a badly designed warping instrument.
If I understand things correctly, TE claimed copyright infringement for a parody, which should be protected under fair use. Additionally, this brought attention to their terms of service for their samplers, and unlike other sampler makers, they give far less freedom in how their samples are used in creating music (which is a dealbreaker for me, especially since it's supposed to be a standalone instrument, and wouldn't for sure meet their standards if used as a standalone instrument).
And I had been saving up for one, since I participate in Ren Faires, and thought it would be fun.

i get them sometimes .One type means no money but i do not make money from my site so i do not care the other is more serious with the whole thing being blocked.The worst is having the work removed which i of course have copies elsewhere but also getting a strike against you which can result in you being unable to post for a while .Three of these mean goodbye to that site .I have more than one and i have lost or abandoned others so i still post.This current run is the best so far but i am still not in a position to make money but it also means i post what i want and just wait to see what happens.As i gain more subs and views i get more trouble over current but also older posts but until i am banned outright i will continue to post and let the the strikers do their worst.

In case of TH-cam (based in California) you can file a DMCA-claim. The parody-exception in the USA is governed under fair use, which is in general more forgiving and less strict than European copyright law.

In the past few days Scott's Synth Stuff, a well-known “activist” of the global Synth Community, in a video of his own stood up for AudioPilz/Bad Gear, which was hit with a copyright strike by Teenage Engineering.
He also examined Teenage Engineering's ambiguous equipment license and made a video about it. However, he was hit with an avalanche of insults and threats, not only via TH-cam but also privately to his phone number.
For this reason, he decided to close his channel.

I personally would never use gear or samples from a company that I can't trust to have a sense of humor. If they decided that I didn't alter the sample enough, and if they end up being overly lawsuit-happy, then I'd find myself in hot water.
I share the sentiment of others in the comments that after seeing a trusted content creator get burned like this, I would never trust TE enough to use their stuff in my creations. And public opinion rules the stock markets and sales figures.

Just curious. I am not synth person, but am familiar with the T.E. KO ii from youtube videos. If T.E. stuff is overpriced, what is comparable to the T.E. KO ii at $299? That seems relatively inexpensive vs the kit that all these more professional channels are pushing.

@@scottgibson6022 their pocket operators and whatnot aren't priced terribly. I mean, they aren't exactly cheap for what you get, but they are at least somewhat within reason. they are around the same price as your average guitar pedal or something.
what people mostly complain about is the 6 channel tiny mixer with some digital FX that is priced at $1200. and their flagship synth which is basically just some plugins in a cheap plastic keyboard chassis (with awful keys btw) that goes for $2000.
