    You did a wonderful job of explaining the difference. I WAS going to use a "quitclaim deed", but now I see that a General Warranty Deed is needed here.     Hi, your video is very helpful. Do you have a video or advice on buying a home with a warranty deed with a small lien stop amount on it... Can the buyer still purchase that home and pay the lien off themselves or make payments on that lien?

    What about title insurance when transferring real property to an LLC? I’ve read that title insurance doesn’t transfer with quitclaim but does with Warranty.
    Any Due on Sale clause issues (especially with rising interest rates)?
    Property insurance would need to change, correct? Just add the LLC as co-insured or have the LLC get a new policy?

    Say a relative transferred a quit claim deed that had a clear title the had a defiency judgement on another property they owned could the come after the new relative that was the new owner on the quit claim property say the quit claim deed was for $10.00 but the market value was 100,000 how would the new relative /owner treat that in the IRS eyes as to the cost factor for a possible later sale as to capital gains etc ?

    Your recommendation (4:56) of quit claim for transfer to an LLC is counter to Legalees recommendation to use a warranty deed. You might want to clarify this disparity.

    I'm trying to buy a piece of land no house. I went through a tittle company to check if there was any leans or unpaid taxes and everything came back clear and looking good. Can I do a quit claim deed? If the property is only 3 thousand? The tittle company ant to charge 1 thousand for the tax certification. (Is tax Certification the same as a special warrant deed?)

      Thank you I needed that word quitclaim deed . My mother caretaker put my Dad name off and put her name on the quitclaim deed I took it all from us . I am a true sorvivor of both my parents . Caretaker been in my parent home 15 year free rent .! Has two business going and won't give me my share please help me . I am very slow hearing impaired read lip it's been so hard! Lost my family no where to go all these years caretaker didn't want to give nothing. . Say it's her house get out. My son just doing 15 year in the Army my father was in the Korean war in 52 Father have all way tell me and one brother left the house was a foundation of the family. But caretaker was all about her and her kids. Thank you for your time

    can u answer a question? I purchased a townhome with an external garage 6 months ago. but I found out later I never got the deed to the external garage. but neither did the 2 owners before me. what appears to have happened, is the developer never transferred the title over to the first owner of the townhome (and so the second and third owners never got the deed either). however, 13 years later (about 4 months ago) the developer sold all the external garages to a storage rental company (LLC). the LLC bought all the external garages from the developer. so I was told by the LLC, get out....this is my garage. and when I check the county parcel records, sure enough the LLC did own the garage I thought was mine. now I get a call 2 weeks ago from a developer representative saying they will give me 10K to sign a QUIT CLAIM DEED on the garage. but the garage is probably worth twice that. QUESTION. does this external garage most likely have a CLOUD ON THE TITLE? also, is there anyway for the LLC to remove the cloud from this title without me signing the quick claim deed? I am bargaining with the developer to get the garage back (of course they would need to buy it back from the LLC and give it to me). so I would like to know how powerful of a position I am in when bargaining with them. my real estate agent tells me with the cloud on the title I am part owner of the garage even though the LLC has the title to it because they can't really do anything with it (like sell it or even rent it out).

      Listen up guys. Removing or adding name from/on deeds is not as easy as it seems . There’s always a lot of process that one have to go through. And sometimes it takes months , years .. not to mention the money you spend and stress back and forth. A whole lot of time wasted/invested. Few months ago I was going through some divorce process with my ex . I almost lost my house which I bought with my money years back . It was really some tough times.       "Trusts" is a pretty broad topic, but I will certainly make a note of that and see if I can put something together. But to answer your question in general terms, yes, a trust can own an LLC. It is a common thing in estate planning and perfectly appropriate in many situations.

      Title insurance companies usually won't work with somebody who has a quitclaim deed. They mostly accept people who have general warranty deed most of the time.

    I dig it. But what I don't understand is why my neighbor in our condo complex has a special warranty deed, and I have a general warranty deed. We both bought brand new. Hmmm. I mean, I've looked all over the internet and nobody can explain WHY someone would get a crappy special warranty deed in the first place instead of a badass general warranty deed. I mean, why not just get the better one with more protection? What's the incentive to get the lame one?

    Question what if someone quitclaim deed the home into a domestic trust, without your knowledge, how can you undo that, I have a ucc1 with secretary of state and a security agreement with a $500,000,000 billion lien on the property and the county, I have the allodial land patent and title , but befor I file this do I need to discharge the mortgage first.

    My wife and I are trying to remove her from our current property deed so she can qualify for a hero loan to purchase a new property. I her husband will be keeping that property as a rental. What for is best to just remove her from the deed? Also there is still a mortgage on the property.

    Which deed should I use if my mom passed away and named me as executor but I am the only heir and she left the property to me? ,how can I take her off and add my name. Can I sign as witness on a deed that I'm the executor and the heir?

      Depends on the state where the property's located. It may be something like a Personal Representative Deed. You cannot witness your own signature on a deed. You should definitely consult with a trusts/estates lawyer in your area. I'm so sorry for your loss!

      The easiest way is if he'll sign another deed deeding the property to you. You can't really just "remove" a person from a deed, and it can be very complicated to force it if your ex won't do it voluntarily.

    I stopped watching after she "clarifies" what defines Real property, as she is mistaken. Real property can include land, PLUS any buildings and fixtures that may be permanently attached to it. There doesn't necessarily have to be residential structures attached to it as she implies here. Real property can be land alone. All Real property means is land and what is attached to the land; the rest is deemed personal property.
