- A DeKalb County man says squatters broke into his home in February and are still there. Backlogs with courts and the marshal’s office have left him legally unable to enter his own home.

Cops never asked for the lease or a deed? There’s got to be some legal remedy for this man. This is just outrageous.
the squatters just get a fake document online that looks fairly legit, cops aren't legal scholars. The only way to prove it's a fake document is in court, which takes months to convene, tens of thousands of tax payer dollars. The squatter pays nothing for this, or the mortgage, I don't think there's even an arrest made in the end because the crime is so new and novel that nothing exists on the book to charge them for, they just kick them out. So they just move on to find another house, like a parasite finds a host.

If you think this is a new thing, this has happened for years and decades in the USA. About a few years ago some states came up with new laws to attack squatters. The real problem is some squatters destroy the place before they leave.

It’s not up to these judges to make the law, genius. Your beef is with the STATE LEGISLATURE who fail to act on this. And with police who are often too lazy to enforce laws that DO exist. Stop dumping everything in the court’s lap. Judges only apply the law in existence when a case is before them. This seems to be happening way too often.... There's got to be a better system of removing the criminals without penalizing homeowners. What a nightmare!

I thought breaking entering was a crime. It seems like they have to steal something or be outside the house to be detained. How could they get away with breaking into someone's home and living there? There's a grand theft auto this real life!
I saw a report that 2 people have passed away from OD in that property... and they’re still there? What a joke of a system to allow this nonsense.
1 dont call cops
2 go to courthouse make tresspassing complaint
3 take some big guys over to "explain" it to the squatters
4 have copies of ownership papers to show police when they show up asking about the "trash" in the gutter

I know someone who signed a lease, paid a deposit, first, and last month’s rent and on move-in day the neighbors called the cops on her for squatting. It turned out she fell for a rental scam. The lease was bogus.
Its crazy they can't just look at his agreement with the previous tenant to see he is the owner of the house.

this was bungled by an extremely negligent landlord. go though the legal system, not the police. make sure everyone in the home is on the lease. most people aren't prepared to be a landlord they just think you buy a house and make money renting it.

It's not about the law. Cops had a chance to do the "right thing" but chose not to. Name and shame these a-holes.
We need to petition our states to abolish squatters rights. Get enough people to sign & they have to consider it & give an answer. Don’t get the answer you want? Vote accordingly.

He was never jailed. Listen again if you think I'm lying. He was put in handcuffs and "arrested" (detained). Once the home owner showed the officers he his documents they had no further reason to keep him in cuffs. They let him go and he was not charged with a crime. If he was really arrested the news would've reported the charge and the home owner fighting to get the charges dropped and suing the police/sheriff department. I agree it's bull crap that the owner went through this. Unfortunately in the State of GA squatting is a CIVIL matter and not a CRIMINAL one.
They're home invaders. This should be an easy fix: the cops confirm who the owner is, kick the squatters out the same day. Even have someone there to make sure they don't trash the place out of spite.

you aren't wrong. the issue here is evictions go through civil court, you need to have everyone on a lease, you don't just sit on the other side of town and collect rent, extremely negligent on his part.
Why doesn't this happen at apartment complexes??? The eviction process is quick and swift at my apartment complex. I see people coming and going all the time!
the landlord is extremely negligent, he should have had everyone on the lease, when people aren't on a lease its a lot harder to get them out, with the lease just have a paralegal draw up eviction papers and file them. people that just see easy money shouldn't be landlords, it takes people skills and an understanding of how to work through the legal system.

Rental agreements set up with multiple groups.
They all go to the house.
All the renters showing up have rental agreements.
According to the cops,it is always a civil issue.

The cops should make sure all the extra renters get inside.
