    This video is overv15 years old. The person marrying couples would now check the immigration status prior to the wedding being authorised so the couple would not have gotten as far as planning a reception. The only way now is to return to your country of origin without being deported and file to return to the UK legally.

    I know someone who has been here for over 20 years from another island. I told the person to ask the church to file, the response "no one must know my business." What a foolish person. Lord!

    You cannot regularise your stay in country, that rule has been in place for years. The registrar will have let the immigration office know of the wedding date and time as they are required to by law. It is illegal to try to marry in the uk if your here illegally. Bottom line is he should have returned to Jamaica got married there and applied for spouse visa citing article 8. Telling the guy to run off would make his application turned down as you just can’t keep breaking the rules of the country you are in

      He didn't need to leave and go back to Jamaica in order to apply under article 8, all he needed to do was to contact a Solicitor !!!! There are millions of illegal immigrants who get their status regularised under article 8, but the application needs to be handled by a Solictor or Barrister !!! He should not have tried to get married, he already had his British baby mother and children to support his article 8, application

Hence him probably being deported, the home office have deported many people with children in the uk , and they have their hard line of saying his family could move to Jamaica or live in a third party country .

The man has kids and a partner and could have submitted an application under article 8, right to a family and private life !!! Article 8 is based on the Human Rights Act also for people in the country illegally, who often times make this application.If the Home Office doesn't grant him his stay, he can always appeal to the Immigration and Asylum Tribunal for a determination by an immigration judge and further appeals can be made to the Court of Appeal !!!!

      You’re 100% right, I worked for the Home Office. You can make whatever application you want to get around the UK immigration rules. Unfortunately, there is no ‘timescale’ on when an applicant will receive a decision. It’s not unusual to be sitting down for years waiting for an approval. While their application is pending, they still don’t have a right to seek employment in the UK. He should’ve left, got married and made the application from Jamaica.

    If he runs., the wife will be charged for harboring an illegal immigrant., he has to return home , can't file on the basis of his children., because he was there illegally and got them in his illegal status., so don't misunderstand the system.,
    And those grounds are not guaranteed for him to get legal status., those are reasons to take in consideration on the applicant request

    immigration laws have changed in many countries. There are countries today where your children are not deemed to be legal, even though they were born there, if at the time of birth a parent, usually the mother is there illegally, even in the Caribbean, like the Bahamas and icing Dominican. if the mother is illegal, and the child is born there, the child does not become a citizen automatically.

      Being born in Britain does not make u a citizen unlike US but if one parent or a grandparent is a British citizen that makes u a citizen but there has to be some form of investigation into if the parent was a citizen b4 the child was born

    This make me laught. Both of them was foolish of what they were doing. Any way the woman can go to Jamaica and married him. Then go back to the uk, get an immigration lawyer, speak the truth and let them file his papers on the grounds of wife and children. Hope everything work out for them both.

      Unfortunately he will be refused. Having British born children and a British citizen partner won't make give him grounds to remain/retrun the UK. You are talking about appealing on the grounds to the right to family life. They will tell him that the family can move to Jamaica or can visit and keep in contact with them via phone, email, letters, face time social media etc. I know this because it happened to someone I know and they appealed based on having a British born partner and their children born in the UK. That loophole closed years ago and they got deported same way. Doesn't help that he was in the country illegally for 8 years as well. Nuh feel sorry fi him. D same way dem deh pon Facebook, Snapchat, Instagram ect, they need to go onto the Home Office website which will tell them everything they need to know, what laws have been changed so they can check their immigration status is correct, and stop listen to dem fren dem. The Home Office isn't interested in the "I thought that" or "I didn't know" they expect you to know because they dont care! If he's going to try and appeal the deportation, he needs very, very, deep pockets because it's not cheap and also no promise that they will overturn their decision either. The ban to re enter the UK is usually 10 years and after that it has to be an exceptional reason for them to grant an entry visa.

    I've worked with the home office for numerous years, this is what happened to most Jamaicans, they don't read their letters properly. If he did run off they would have charged the woman for withholding illegal immigrants. You can't file on your child for your status you have to go back home and reapply.

      If you are getting married in the church of England you still have to go to the registry office to get a marriage licence to give to the church before they can perform the marriage and to get that you still have to have an interview and also seek permission from the home office. I'm talking from experience. I went through it. I know what I'm talking about.

      @kereelondon2630 married licence doesn't come through register office I went to special lawyers and you have to swear in and pay for it and they post it to you in couple weeks I know because I did it the pastor at the church will inform you how to go about it register office have nothing to do with it

    The reason why Jamaicans need a visa to come to England is because of a lot of people running off. We don't know if the wife was a citizen by birth or neutralisation. Y'all need to know the law now because all what you are saying is not how it is now.

    Greetings, not quite accurate, but I get the message. Many immigrants, emigrate with a false sense of security, perpetuated by individuals who are not Home Office specialists or Immigration Lawyers. Embassy's based in other countries have diplomatic relations, especially immigration. So why do so many immigrants feel they can circumvent the system in contrast to others who legally follow procedure. An explanation could be the 'rum bar' idle talk which pacifies the illegal person to rationalize their situation as being right & just. As a result of being arrested, think of the legal ramifications and the unforeseen financial penalties which will now be levied. Example: the emotional and business telephone calls back and forth alone are going to cost a tidy sum and we haven't paid immigration fees or the lawyers yet! England has been conducting immigration policy since the 2nd Century and they are EXPERTS in human management! Sadly, this kind of experience helps to foster bad feelings from UK citizens towards illegals and in some cases depletes the energy and good will of sympathetic supporters towards deserving unjust immigration policy.
