The railroads, being greedy capitalists (of course), didn't want the law, presumably because it cost them money... ie the free market, due to their profit motive, were aga st the discriminatory law. Free markets don't "initiate policy" they just work.

How folks are aware this case was heard after passing Chief Justice John Marshall.
Eric Garner's case in N.Y. is not that much different than this Plessy case.
