There is clear negligence on the part of Hacienda - they owed a duty to this young lady for which they breached with no argument against proximate and actual cause as it would be clearly foreseeable that a woman in a vegetative state could be subject to abuse without appropriate oversight and protection. Just apply the Learned Hand Formula B

      @ excellent. Grew up around lawyers. Too bad too few of you fight for the rights of the disabled. This kind of thing is as common as lies in Washington DC.
      Here, in NC, they only help the disabled who are unable to complain.
      For obvious reasons.
      I've called in five Federal audits, reported my county for serious criminal corruption and been blacklisted, had my car tampered with and been denied services for my efforts.
      I'm okay with it. Two women I reported to FBI have been indicted, pled guilty and the fireworks are just getting started.
      I don't sue.. I call the feds..
      Revenge at their hands is far better than money.

      Sometimes the baby’s turned a certain way and no one can see. I learned it on an episode of I didn’t know I was pregnant.

      Sherry Wyllie well a person in a vegetative state may not have menstrual cycles. We do not have all the patients health records and it is illegal for them to release such things. Now other factors such as stomach growth or changes in hormones levels/ other typical patient checkups like heart rate, blood pressure, and respiratory rate could have made it clear something was going on. But it is clear this woman was raped. And it is also clear that there was a huge failure on the part of the care center. Again we don’t have all the facts.

      Sherry Wyllie not everyone stops menstruating during pregnancy, look it up. But it may also be due to staff turnover, there are probably a lot of carers going in and out because of different shift patterns, it's an easy thing to miss when you're caring for 20 other patients and working on a rota

      What is just as important is that she has a permanent cathether in place. After an assault , of which there was probably more than one, a non-medical professional as well as professional would have to know how to make sure it is again in place. So it probably wasn't the UPS guy or cleaning crew. A new law law just passed here in AZ, families can put cameras in their loved ones rooms but they have to take financial responsibility. Most people couldn't afford it because for long term patients, they are on Medicaid. AHCCS as it is called here in AZ. Everyone is so upset here. I great faith in God but why is he still allowing her to suffer like this.

    Something else I find extremely disturbing is the fact that she wasn’t in a coma, just a “vegetative state.“ Now I’m not sure how conscious mentally she was of everything going on around her but this implies that she was at least awake while being raped. Also, since she was in this condition, that means she was probably in labor for several days because she couldn’t help push the baby out like a woman who had full mobility. Since she had no way to communicate, she was probably in excruciating pain suffering for days until right before she gave birth when they realized.

      The article mentioned that the staff was made aware because the girl was moaning. That tells you that she did feel labor pains. So sad!!!

      The press stated that 14yrs ago someone attempted to drown the woman and she went straight into a coma.
      She had no ID on her, so noone knew who she was and could neither get in contact with family members. So technically she's been alone, with neglecful staff the entire time .

      But there also seems to be so many gaps in the story esp since the hospital/police don't seem to be releasing a lot of info or any updates to the story.
      Last time I heard the hospital said, they 'might do DNA testing', what's this might!?
      I initially heard this story around Xmas time and seen zero updates to the story.

      @@PutinsMommyNeverHuggedHim It does not alleviate him from being named in a Joint and Several Liability lawsuit, just because he quit. The idea of J&S Liability lawsuits is to go after the deepest pocket. In this case that would be Hacienda and its parent company. The CEO may be removed, but it could be argued that he should also be held responsible for at least a portion of any judgement awarded and that would fall under comparative negligence. I think most states have done away with contributory negligence. .My personal opinion is that if there is a civil judgement, he should be held accountable along with his employer and parent company and allocated liability based on percentage. That is after they satisfy that he may not be the subject of a criminal filing in the case of this young lady.

      TBH them people families really don't want the responsibility nursing always have a bad rep that why the government pay family members to take care of them and sometimes still get neglected I know a young women that lives on my block her son had a fatel illnesses she took care of until he died he couldn't speak , eat on his own and wore diapers my point is if I had achild with a disability he or she wouldn't leave my side unless the hospital is their home and even then I'm there I know how hard life can be and it's even more scary if you can't defend yourself I think god honor me to have children and I will do my best to love and protect my gifts

      @W.A.M.P "I had no idea I was pregnant until I went into labor" is a myth made up to conceal pregnancy from relatives, get attention or get into a reality/talk shows etc. Pregnant belly doesn't look the same as just a fat belly, later in the pregnancy there is movement which is impossible not to notice, there are feet/hands poking you from the inside which you both feel and see. And of course, you dont have your period for 9 months, which it is impossible for any normal woman not to notice/ignore. For these and countless other reasons, your cousins wife's story is BS. Also, any nursing staff or doctor who presumably sometimes examines these patients and who cannot tell that a woman is pregnant, has no place working in a medical/nursing facility. But of course some of these people knew the girl was pregnant, this was just a conspiracy of silence and concealing the scandal for as long as possible.

      Perfumed Bed my sister in law is morbidly obese, she was pregnant a few years ago, no one will tell, her belly stayed the same size right until delivery. My niece was 5lbs at birth, she is healthy.

      Agreed. My wife used to work as a CNA in nursing homes/psychiatric hospitals and she literally spoke of knowing only one lady who visited her mother every day. My wife's exact words: "She was an Angel. " More often than not poor unfortunate patients/residents were dumped off and the facility only had contact with the family after they died. Edit: Actually their was a couple more people that visited their loved ones every day. However, they were the exception. ✌

      Ikr.. at that point it should have been condemned. Unfortunately I don’t think some of its patients had that choice to pick another place. I’ve been to some nursing homes. It’s like a living death. No way to treat human being like that at all. It’s truly shameful :(

    Nursing homes are for profit and in my experience there are usually only two CNAs for up to 30+ patients. It's impossible to keep an eye on everyone all the time. I will never let one of my family members go to a nursing home because of the horror that I have already witnessed.

      Exactly. Her FAMILY decided to keep her vegetative and put her in that place. Did they not check on her or do any care for her? How did her family not notice if anything was happening? I am a child sexual abuse survivor and I am always prepared for the what if's because I know it can happen. The silver lining, in a sick and twisted way, is that the family gets a piece of their daughter back in the form of a child. The scary part is they don't know yet who raped her and what else or who else is in that child she bore. If she wasn't raped she could've died without her genes ever living on. So sad. If that was my family member then I would've brought them home. If I couldn't bring them home then I would've regulated that staff, background checked everyone, daily visits and reports, daily cleaning, I would do my own physical examination to see if any changes or any unusal going on. I also would've set up my own damn camera or even a voice recording device.

      @@scarletradiopodcast I get that because I only gained 5 lbs for my 2nd child ,people who didn't know me had no idea I was pregnant ! but Ive worked in long term care facilities for over 20 years now and involved families notice every little change in loved ones health !Even if she didn't start to show till month 6or 7 that still gave the family 2 to 3 months to notice !

    In my experience most people who work in nursing homes aren't all that bright. I've been in the medical field for 13 years and half the caregivers ive seen are straight up trashy people. The other half are loving and caring but eventually get burned out.

      They are Native Americans and the government was paying for her health care. Perhaps the family could not afford to pay anything on their own. It’s not their fault this facility was negligent. It’s also very difficult to get into a good facility that is paid for through Medicaid/Medicare. I feel bad for any family that has one of their loved ones in that disgusting place.

      DNA of every male that has set foot in the building including patients over the last 9 months is impossible to obtain. It's also unconstitutional. If I visited a loved one inside that building 9 months ago it's absurd to think that I should be forced to go somewhere and give my blood and or sylvia.     They may not have noticed because she may not have shown as much since she's not physically active the womb will be pressed further in the back instead of descending and it may have looked more like bloating which will happen often when intake is only fluids or macrobiotic puree. I can understand THAT part, what I don't understand is the fact it wasn't noticed she had stopped menstruation considering that is something supposed to be charted in her file, or why blood work was not ran for the better part of a year. The hormone would have been noticed in ANY lab work, you don't have to test specifically for it like mononeucleosis. Routine blood work not being done on someone with constant iv or GI tube or even a catheter is against regulation, early detection of infection or reaction being the reason for this. Everything is supposed to be tracked, fluid intake, how much urine produced and yes, every menstrual cycle is supposed to be tracked. I would be looking at the physician ... I'm sure she is seen by one routinely. Where's the blood work? Where's the cna charts. Shut this place down.

    I know of a woman who came out of a vegetative state after several years, with all her faculties, so I'm not saying it's time to pull the plug.     Unless the patient is overweight I can't possibly see how everyone missed the pregnancy. Still, you can tell when a woman is pregnant regardless of her weight. Sounds like the family rarely visited and the staff is just saying they didn't know.

    I work with adults with various degrees of mental and physical disabilities that require 24/7 care and or supervision ...and even some who are completely non verbal ( literally won't make a sound ..not even a wimper ) ..I have been honored and blessed to assist them with there day to day activities and living the best life they can ... The ladies who are in a state like this lady ..they may be unable to communicate but that means you will pay close attention to the body language ....you have to be able to determine what there body language is telling you ... And i can promise you someone who looks after and cares for a person like this will notice a change in this persons body language and even changes in the body ( even the slightest sign the belly is growing or any other changes )...I get if they where short staffed ( we are badly) but that still shouldn't matter they should have noticed ...someone had to have noticed ... It's pure laziness or not caring .. someone who can take advantage of someone in her condition is pure evil ...these individuals look to you for guidance and reassurance and there families put so much trust in those who care for there loved one and the individuals put so much trust in you ..there life is in your hands... Who ever can break that level of trust is beyond sick... My heart breaks for her and for her baby it wasn't his fault .. this world has some sick people

      They are not all licensed so it can be anyone in that facility. They are not monitored close anywhere in the us certainly not assisted living...a little different but still. ADMINISTRATORS OWNERS MAKE MILLIONS and this is what happens. More than criminal. Now get someone to pay attention. Disabled, elderly, youth, i mean we have so many problems in our country to solve. These places need very tightened resident care standards.

She isn’t someone who would be in denial about it. She is so happy! She found out when she was 9 months and gave birth a week or two later!

      The ENTIRE center staff needs to be fired and new staff hired. This situation proves NO ONE is doing their job of caring for the patient. There are so many doctors, nurses, physical therapists, social workers, ect. involved in nursing care, some one should have caught this. Fire them all. SHUT IT DOWN. Period!

      The residents only get 1 physical a year just like everyone else unless they are sick. All people who have insurance are only allowed to have 1 physical a year. I only get 1 physical a year. This is normal for everyone.

    I worked nursing homes 25 years ago for a few years before going private duty because the abuse of the residents was sickening and the covering up even more sickening...if any employee would try to report it they were terminated...I know this because I was terminated in TWO facilities for trying to report abuse...one being rape of an elderly woman who had a stroke and couldn’t verbalize her assault...it was HEARTBREAKING!!! Aides are paid peanuts so it is many drug addicts and criminals taking care of our elderly because there are no background checks...they don’t care whose taking care of your family members as long as there’s enough staff on a shift that is required by law...SMH.

    It was the night maintenance guy or a male nurse who worked at night. Thats the only people that would have the time opportunity to do it. At night there aren't visitors, just a couple nurses who aren't going to be able to check in and everybody is asleep.

    Why would you put a family member in a nursing home that has a "one" star rating? Years ago, my sister had a brain aneurysm and she was discharged from the hospital and sent to a nursing home in our city called Heartland Health Care. The minute you entered the building you could smell feces, vomit, etc. Most of the workers sat around the desk at each station, acting as if they were just holding down the chair they were sitting in and of course didn't want to do anything for OR with the patients. My sister & I never left our older sisters side, there was one of us their every day, changing her diapers, bathing her, and the damn staff sat around watching us and not doing a thing.
    Sorry, but if you have your loved on in a facility that has a "one" star rating, and you haven't complained(???) SHAME on you. I am a retired RN, so I know how patients should be taken care of....this is disgusting. This woman is raped in a nursing home and couldn't do anything and NO one noticed she was pregnant? Right....there's some lying going on around that facility now isn't there.
    BTW, We complained to the local officials and kept complaining all the senators, representatives, etc. in our state. We did get the nursing home to STOP treating patients in our area and I realize that this nursing facility just probably went on to do these horrible acts to someone else.
    You have the power as relatives to make a difference for your loved ones when placed in these disgusting nursing facilities. Why not forgo going out to dinner once in a while and write or call the powers that be in your state and area about this? Nothing can be done until someone STEPS up.!

      Sounds like you have the experience, the credentials, the passion! Maybe God has called you to be a voice for others who are lost or don't have the nursing and medical you have to be an advocate! I'm caring for my parents at home now and have considered getting my CNA just to be another set of eyes and ears in a home who had basic morals. I've been lost in my career for a while now and just quit my job tethered to a desk in a hospital call center to take care of them. I never understood the real need there until just lately.     i have so many questions? Firstly, how can you not tell a patient is pregnant? You would see her belly growing, urine would be more frequent....WTF Secondly, are there any actual Nurses or Doctors there? Thirdly, why dont you do background checks! Fourthly, whose going to take the child, and care for it? Fifthly, I would do DNA tests on every man who worked there, this was likely and inside job.

    My mother worked as a state employee overseeing nursing homes and she said women in these facilities are often treated for stds when there was no way they could consent all time. It's crazy common if you have loved ones in care check on them often, make sure your attend Dr appointments, and keep an eye on then like you would a small child.

      Her family is from the Apache reservation-one hundred miles away. It has been reported on Phoenix local TV mother visited twice a month. She had some kind of bowel tumor or bowel obstruction surgery several months ago . They said because of that she carried the baby on her side. They have never said on TV how much the baby weighed. We would all like to know. She only weighed 115 lbs.

    Any basic caregiver would have notice that she did not have periods any longer. They don't keep track of that??? It's basic care and documentation.
    If you wash a womens belly you can feel the baby clearly, especially the last three months. Oftn the baby starts moving touched. That institution needs to be closed because the management is totally incompetent and negligent.
    There would be no privacy violated with cameras in the hallways.
    I am for equal rights but in cases like that women should do the care.

      Who says it was a man? She could have been abused by a female staff member and inseminated through artificial means. Your jumping to conclusions is why this manufactured outrage has led to abusive and discriminatory policies against men in healthcare.     How did they not notice she was pregnant? And how do they know it wasn't a visitor to another patient who did it?

      This resident was raped. Every male that has been in the building in the past year should have their DNA tested. But state people male and female come in to investigate and walk all over the facility. Different companies come in to make repairs in the facility. Male visitors over the past year. This is horrific. I hope that they find everyone who had been in the facility for the last year. Physical therapists. People come in to draw blood. My goodness. There are endless people who come into these facilities. My goodness I will continue to pray.

      @@CheriSTJohn-mh8wz Too much money to track down thousands of people like that. The guilty guy will put up a legal fight about his DNA, so that's thousands more dollars. If the perpetrator isn't a current worker, it might come down to an ancestry website providing a family match years later. That's trending now.

    The negligence in this facility lends to the possibility that the father may not be a staff member but an outside visitor.

    It's not someone walking down the street. It's some one working there.
    I would have every male that worked there or have worked there tested.

      You'd be surprised. We call them leeches at work. Random strangers, sometimes homeless, will come in dig in the trash for discarded wrist bands and scrubs or gowns. Befriend patients to get info or look for info when patients accidentally lose their paper work.
