      Totally agree....great information Dewayne. You need to take all of your claim' information, meds and DBQ with you. I also bring an outline sheet of the in service events associated with this exam showing date, time, where seen and what was the medical issue. I also have 3-4 research/studies related to your condition. My wife goes with me and takes notes. She prompts me if the doctor fails to ask a particular question from the DBQ.

    My c&p examiner initiated the conversation which opened the door for me to ask questions. My examiner had actually overlooked info in my medical records and I had a journal with dates and additional information to provide. The examiner also told me where to look and obtain additional information for a claim that I hadn’t submitted but came up in conversation to support my claim. My exam was 45 minutes.       I just want to applaud you for even having your journal. Doctors are human and can miss things as well. How did you even come up with it? That's self-advocacy at its finest.

      @@openranksnc1911 Thank you and you’re absolutely right. I went thru my entire military medical records (on a CD). I wrote down EVERYTHING that I went to the doctor for (sick call etc.,) with dates of when I was seen. I use it as a quick reference…especially c&p exams. Hope that helps.

    My C & P examiner did not have some of my medical records. Good thing I brought a copy and provided her with them. Also, the VA only allows you to reschedule 1 C & P exam so if you reschedule and have to reschedule again your claim goes back to the VA (from third party like Optum Serve).

      Brother they are doing something called,” developing to deny“ which is another way of over developing your claims by providing additional exams by their doctor in order to give more positive value to them and less property value to your personal doctor that conducted your DBQ. Brother, you need to tell them, to write your case or claim with the evidence that has already been submitted which is your DBQ and you would not be attending a CMP exam. You should watch one of Dwayne‘s video where he talks about this extensively in fact, he has done like five videos on the same subject. Do not fall for it, they are just looking for you to have two contradicting medical opinion so that they can side with her doctors!

    Dewayne, thanks for educating us. I have a question. Can you use a VSO out side of your Region (State)? I have another question have you head about the VA class action suit about the unfair treatment of minority claims and how the VA has to reevaluate all minority claims?

      I've seen that done but you want to ask the organization you decide to go with as I'm not aware of each organizations criteria or SOP's. I've heard of the lawsuit but I haven't conducted any research on it.

    Dewayne, I have been watching your videos for years now. I am a huge fan of the example that you are setting. I agree with you that if the medical evidence is sufficient then there should be no reason to conduct an ACE exam. I believe that the medical records have a voice. The question is, did the veteran present the documents in a manner to allow the medical records to SPEAK!

      Thanks for all the support, it is greatly appreciated. That is a good question. Many vets believe what they submitted is enough but that is not true in most cases. When the vet knows what their are claiming, how they are claiming, what evidence is required per the VA regulation, then the veteran will know it is sufficient. Not, I have been receiving treatment at my local VA and that should be enough. Thanks again for all the support and sharing your feedback.     What does this mean in favorable findings after a HLR?
    "The evidence shows a qualifying event during your service. Service personnel records show you are awarded the parachute badge, injuries consistent with parachute deployments and traumatic landings are conceded."

    Can I also write down on VA form 21 4138 what transpired on my last C&P exam which was inadequate and because that was one of the reason why I'm filing a supplemental again or should I write it in a separate paper?

    The examiner don't have the veteran best interest in mind if they are getting paid from the Veterans Administration. The next question should be addressed how much does the Veterans Administration pay for each (C&P exam )compensation and pension exam

    What is the veteran has a GOOD C&P exam? Does the Rater sometimes go against the examiners findings?

      They could, for example, lets say the veteran has a C & P exam for a condition and the examiner provides a positive opinion to grant the benefit. If that condition does not fall under the 5 was of service connection, it could be denied.

      An FDC claim only means that you have nothing else to submit and the VA can move forward with your claim. Depending on what you submitted and if the person reviewing the claim will determine if you have an exam. Some VA employees I think don't care what evidence you have and requesting exams when they can use some of that evidence to rate the claim.     Hi Dewayne, thanks for providing this useful information. I have an upcoming C&P exam next month for my back, knees and feet. I will definitely bring a copy of the DBQ to make sure the examiner is asking all the correct question. My question to you is, should I bring updated records of my conditions, if I was seen at a VA hospital? Or should I upload them in the claim section? Thank you for your time.

    I completed my last C&P for sleep Apnea, already had thr sleep study facilitated at the VA and it came back i have mild RLS. I have about 6 other contentions pending and this was the final one. How long due you think it will take for this to move to a decision?

    The VA gets upset if you retain your own doctor that knows you better than their five minute say hi and bye third-party contractor that doesn’t know you from Adam. They are paying a lot of money for these third-party contractors to deny you and not even give you a full examination. So the VA is paying for you to get denied with a contractor and you’re using your doctor, which may or may not charge you money as well, to give you a grade of chance of passing, so the question is, what comes first the chicken or the egg? If they pay these contracts are to fail you and you’re supporting evidence with a private doctor that writes your medical questionnaire is sufficient, and the doctor must get paid, then what does that mean that you are buying an opinion? They’re also buying an opinion from the deniers the third-party deniers of your claiim!
