My husband, EU citizen with pre settled status applied for my parents to join us in the UK. One has a South African pp and the other a German pp. We applied under the EUSS Family Permit Settlement Scheme on 28/6/2021. I believe dependency is then assumed. They were granted an Entry Clearance vignette valid until 1/5/2022. My question is, when they arrive in the UK they have to apply for pre settled status and a BRP card. Does this application have to be done whilst the Entry Clearance vignette is still valid? Example: they arrive in UK 2 weeks before the vignette expires and have not been able to obtain an appointment for biometrics. What happens in a situation like that? They are coming from a red list country and we are hoping that this will be reviewed. This is the reason for them delaying their trip.

Hello Adriano, this is a tricky situation and is dependent on the Border Force Officer you face at the time of entry. You can try to explain that you do not have the BRP and will apply for it once you are in the UK. You can get with us and we may be able to provide a supporting letter that states this. Just make sure that you have applied for the EU settlement scheme if you are an EEA/EU national before 30th of june.

Hello, if you need everyday ohyscial care or are elderly and you are dependent on your uncle for care then you may be eligible for an adult dependent relative. Because your uncle is a British citizen it is unlikley he will be able to sponsor you under the EUSS route. It is best to book a consultation for immigration advice that is specific to your matter.
