    If you're in real estate, you better be dealing with somebody who actually owns real estate and understands the nuances, otherwise, they're gonna read out of a book or they're gonna readout of a case and they're gonna try to tell you to do something that may not be practical at that time, 'cause it is fluid, it moves around.

    20 years ago you could close a commercial property in your individual name. You can't do that anymore after the big fiasco in 2008, they don't want to be exposed to your personal stuff, and so almost always if you're dealing with a commercial property you're gonna be closing an LLC.
    This is absolutely the case 'cause if you have the financing they will not even do financing any more for the individual. You'll be a guarantor, but they'll almost always make it be an entity. So this is really important because little distinctions like that can have a major impact on your planning.

    Great video! The protections of an LLC are very good as you describe. The privacy protection isn’t as strong as one might think. If someone is going to come after you for liability or other financial gain, it won’t take a PI long to figure out what you have control or access to.

      Yes, funny how an "attorney" pushes for an LLC for each property because he stands to profit immensely from forming them. And, a quick look in a county's public records will find the current ownership (maybe an LLC or Corp) and Bingo, likely the previous transfer shows the true owner for the residential real estate. In a liability lawsuit a court can pierce a corporate veil quite legally to boot. Oh yeah, lets talk about the self-employment taxes you'll be paying by switching your income from Schedule E to Schedule C...

    I have a few questions for you:
    Does there have to be a physical person as the trustee listed on the land
    trust if you name it "Main St Trust"?
    Does having a land trust remove the complication of the lender's concern
    regarding the 'residental' loan (conventional loan) for the LLC?
    NOTE: My lender is stating that I cannot have an LLC on the property
    Do you have to inform the insurance company of the LLC and/or Land Trust
    in order for them to protect the property sufficiently?
    Does New Mexico acknowledge land trusts? I heard that California does not....

    Great content! on a land trust, can the grantor assign his beneficial interest to an LLC, even if the manager and/or member of such LLC is not the grantor himself? Also, would the property's insurance company have any issues with this type of transfer, since the the grantor does not have a beneficial interest and is not part of the LLC? Thank you!

    Awesome presentation. A couple of questions:
    1- Is LLC still the best entity if property is all paid off ?
    2- LLC seems to help with a) Liability Protection and b) Avoids double taxation. But is it also helpful for estate planning for parents wishing to pass ownership of their property to their child(ren) ? I read something about "member's shares" in this regard.

    Why do you think the s-corp or c-corp would change being required to treat the properties as inventory?

I'm a resident in NY and I currently have an LLC that has cash there ready to invest in a real estate property, I am looking to purchase a property in Philadelphia, PA can I still open a holding LLC in WY, have it own the NY LLC and purchase the property in PA or should I open the holding LLC in WY, open an LLC in PA and purchase the property?

      You can't set up a LLC to manage family expenses. Those are not business expenses. You need to start a business, which can lose money for 7 years

    Thanks for the great video, I am wondering if a property used for an air bnb, generating income would be considered “active” according to the examples in your video even though I am holding it and therefore best in an S-Corp?

      I think that would still be a buy and hold rental property. Active is more pertaining to the amount of time you plan to keep the property.

    I am opening up Real Brokerage in California. If I am just starting out would you suggest a holding company in Wyoming and the Broker LLC in CA? Or is that not necessary for just starting out? If I do just the 1 LLC for now is there any benefit to forming the LLC in Wyoming vs California? Would the charging order protection work without the holding company in court? In about 2-3 yrs I plan to do a Wy holding LLC because I plan to invest in rentals/flips.

    If you have an C Corp and have a lot of cash in it, because you are trying to avoid the double taxation, how do you overcome the extra taxes that may have to pay for holding too much cash in the c-corp? On top of the flat 21%

    if you are holding the rental in a land trust which is owned by the llc, in what name do you collect the rental income?

    If your in Texas and the rental property is still under your name with the homestead exemption value would you still use a land trust and then put it into an llc?

    I know you are located in Las Vegas, but do have any information concerning the formation of land trust in Az? I have read that they are not recognized here!?! Want to use this strategy to move a home with a mortgage into an LLC, but not sure it's possible here.

    Purchased my personal residence 10 years ago. For some reason the transaction was published in local newspapers, along with my name and home address. Same info also appear online through the news websites. How can LT or LLC help with anonymity in this case?

It would be great to know the cost for setting a Land Trust & LLC up in Arizona, in addition to ongoing state fees, tax consequences etc.

    I wonder, if you already have a rental home in your name, and then put the home in a land trust, does that give you anonymity, or would a search still show you as the previous owner, and an attorney would still infer that you remain the current owner?
