కాశ్మీర్ లో మరకజాతికి చెందిన మగవాళ్ళు ఆడవాళ్ళు పిల్లలు పెద్దలు ముసలి ముతక అందరు కలసి పండిట్ లపైన దాడులు, అత్యాచారం, హత్యలు చేసి శవాలను జీలం నదిలో పడేసినప్పుడు వాళ్ల మానవత్వం ఎక్కడికి పోయింది. ఈ మధ్య తెలంగాణలో నిర్మల్ ప్రాంతంలో నీచపు ఆలోచనతో పండగకి పిండివంటలు చేసుకుంటే వాటిలో సుస్సు పోసి వాళ్ల ఇళ్లను ధ్వంసం చేశారు అప్పుడు వాళ్లకు గుర్తులేదా మానవత్వం... వాళ్ల జాతి ఒక నీచపు జాతి ఆ జాతి వల్ల బాధపడ్డ వాళ్ళకే తెలుస్తుంది ఆ pain(ఎందుకంటే మరకజాతి అరాచకాలకు ఎదురుతిరిగారు కద). తాపీగా ఇంట్లో వుండి షో చూస్తూ, చేస్తూ ఎంజాయ్ చేసేవాళ్లకి తెలీదు. ఆ 12 మంది ఖైదీల కుటుంబాలు నాషణమైనవి కాబోలు వారు అంతలా రివేంజ్ తీర్చుకున్నారు..
అసలు వాళ్ళను విడుదల చెయ్యాలి అని ఈ ఆలోచన ఎందుకు వచ్చింది,హైకోర్టు కూడా గొప్ప సలహా ఇచ్చింది ఆ టైం లో ఎలాంటి చట్టం ఉంటే ఆలా చెయ్యండి అని వాహ్హ్హ్ సూపర్ ఇక రాజ్యాంగ సవరణ ఎందుకు న్యాయం పై నమ్మకం పోవటానికి తప్ప దేనికి పనికి రాదు వాళ్ల సలహా and బీజేపీ లోహిందూ ముసుగులో పశువులు ఉన్నాయ్ ఇలాంటి చెత్త పనులు మానుకుని రాష్ట్రం అభివృద్ధి చూసుకుంటే మంచిది, దక్షిణ రాష్ట్రాలు పన్నులు కడుతన్నాయి దానికి తగినట్టు గా కేంద్రం మళ్ళీ తిరిగి ఖర్చు చేయరు మోడీ ఇలాంటి గుజరాత్ మోడల్ కోసం దక్షిణ రాష్ట్రాల కడుపు కొడుతున్నాడు ఈ బీజేపీ గుజరాత్ సన్నాసులు వీళ్ళు తాపిగా తిని రేపిస్ట్ లను నిందితులను సమాజం మీదకు వదులుతున్నారు ఎం బ్రతుకులు రా మీవి.
రాష్ట్రపతి క్షమాభిక్ష అధికారాలు:
క్షమాభిక్ష అధికారాలు రాష్ట్రపతి కి వుండే న్యాయ అధికారాల పరిధి లోకి వస్తాయి వీటి గురించి తెలిపే ఆర్టికల్_72.
క్షమాభిక్ష అధికారాలు _5 రకాలు:
1)శిక్ష రద్దు
2)శిక్షను మార్చుట
3) శిక్ష కాలాన్ని తగ్గించుట
4)respite అనగా ప్రత్యేక కారణాల దృష్ట్యా శిక్ష రద్దు కానీ,శిక్షను మార్చుట కానీ, తగ్గించుట కానీ,శిక్ష అమలు వాయిదా వేయుట కానీ చేయవచ్చు
5)శిక్ష అమలు వాయిదా
*దేశంలో నీ అన్ని రకాల కోర్టులు వేసిన శిక్షలను క్షమాభిక్ష పెట్టే అధికారం రాష్ట్రపతి కి వుంటుంది.
*రాష్ట్రపతి పెట్టే వురి శిక్ష క్షమాభిక్ష కూడా న్యాయ సమీక్షకు గురి అవుతుంది.
* రాష్ట్రపతి క్షమాభిక్ష అధికారం కేబినేట్ నిర్ణయానికి లోబడి వుంటుంది.
* క్షమాభిక్ష వినియోగించే సమయం లో ప్రజాభిప్రాయాన్ని,బాధిత కుటుంబ మనోభావాలను పరిగణనలోకి తీసుకోవాలి.
*శత్రు గ్రహం చౌహాన్ vs UOI(2014): మరణ శిక్ష, క్షమాభిక్ష విషయంలో ప్రభుత్వం మితిమీరిన జాప్యం చేసినప్పుడు మరణ శిక్షను యావజ్జీవ కారగార శిక్ష గా మార్చే అధికారం సుప్రీం కోర్టుకు ఉంటుంది.
*రాష్ట్రపతి, గవర్నర్ ల మధ్య క్షమ భిక్ష అధికారాల పోలికలు:
1. కేంద్ర కార్య నిర్వహానాధికారం& శాసన పరిధి లోని శిక్ష ల విషయం లో రాష్ట్రపతి కి శిక్ష మాఫీ, తగ్గించుట,సవరించుట లేదా సస్పెండ్ చేయుట వంటి అధికారాలు వుంటాయి.గవర్నర్ కి ఇవే అధికారాలు రాష్ట్ర కార్య నిర్వహణ పరిధిలో వి వుంటాయి.
2. మరణ శిక్ష ను రాష్ట్రపతి క్షమాభిక్ష, తాత్కాలిక నిలుపుదల,వాయిదా,మాఫీ,సస్పెండ్ చేయవచ్చు.గవర్నర్ కి మరణ శిక్ష కు క్షమాభిక్ష ఇవ్వలేరు కానీ మరణ శిక్ష ను క్షమాభిక్ష అధికారం ఐపిసి 1973 సెక్షన్ 54,CPC 432,433 ప్రకారం కొన్ని ప్రత్యేక పరిస్థితులలో మరణ శిక్ష ను తాత్కాలికంగా నిలుపుదల,తగ్గించే అధికారం కలిగి వుంటారు.
3) సైనిక న్యాయస్థానం విధించే శిక్ష కు క్షమాభిక్ష అధికారాలు రాష్ట్రపతి కి వుంటుంది కానీ గవర్నర్ కి ఈ అధికారం ఉండదు.
#విద్యా హక్కు చట్టం-2009,2010 ఏప్రిల్ 1 నుండి దేశమంతా అమలు లోనికి వచ్చింది జమ్ము కాశ్మీర్ మినహాయించి.

Wrong explanation @ 13:40 min... Governor cannot pardon death penalty even under state laws...but governor can suspend, remit, commute a death sentence.... To grant in case of dearth penalty only lies with president..
