    • @barryschwarz
      @barryschwarz ปีที่แล้ว +6

      @@johannkarsten Some of the justices in this matter said in the confirmation hearings, which are under oath, that Roe was settled precedent, definitely giving the false impression that they weren't going to revisit it. This was given the lie when they overturned it on their own initiative, rather than as part of a suit brought before the court. The fact that 2 of these judges had only recently been appointed further corroborates that they misled the Senate Judiciary Committee' confirmation hearings.
      You might think that because they didn't outright say they wouldn't overturn it, that this gives them some wiggle room, but they were under oath, and a Supreme Court Justice is held to a higher standard. They were deceptive in their answers, and that is definitely short of the level of probity required of a SCJ.

      They were all coached, vetted & grilled pre-confirmation Hearings and figured out precisely how they would dance & tiptoe around hot-button issues w/o hanging themselves. They 'played' the Democrats & celebrate it!
      Being deceptive wouldn't be viewed as impeachable.
      Lying would be but still you'd need many votes fr both halves of Congress to remove anyone.
      That said, the radical right plants installed onto the SCOTUS have every intention of railroading their radical agendas. Overturning Roe was them just getting started.
      They do not care the public views the Court with vehement disdain, as long as they ram thru their agenda.

      @barryschwarz ปีที่แล้ว +3

      @@synchronicity1470 "Being deceptive wouldn't be viewed as impeachable." It might be. Dems have already been having that conversation. Also they could be impeached for that and other things, like Thomas' conflict of interest, for bringing the SC into disrepute, which is corroborated by polls. SC currently is at its lowest favoured.
      But I think a better idea is to establish a code of ethics, which the SC does not have, unlike every other court in the land.

      No they weren’t. They wrote into the constitution that justices "shall hold their Offices during good Behaviour." That right there tells you they didn’t believe they would always act ethically. Unsurprisingly they also allowed for a process to remove justices who didn’t act in a manner befitting their position. Samuel Chase was a SCJ impeached and removed from office in 1805 less than 2 decades after the constitution was ratified. Proving that not only were they skeptical that justices could play nice under some kind of honor system. They were willing to enforce proper behavior. Id say the founders were actually far more distrustful of justices than government officials today.

      Same people who compromised, literally, the humanity of an entire race, so yeah, it was extremely naive.

    The courts work for the people, all the way to the top, not the other way around. If that changes, we take the steps provided by our constitution, to remind them of that or create, through the balances provided, new guidelines to remind justice’s that integrity IS still key to that highest position.

  • @lairddougal3833

    Why can’t the SCOTUS be made up of a rotating membership selected from sitting Federal Appeals Court judges? Appointments could be for a year with selections made by a Judicial Commission. That, in turn, would operate under the oversight of the Senate Judiciary Committee.
    One thing is sure the SCOTUS as it is currently comprised has forfeited public confidence. Roberts’s failure to deal with Thomas is scandalous.

    I realized there was a missing piece to the Checks and Balances system we have in our 3-part government in school.
    Because of the lifetime appointment for a Supreme Court justice and no recourse to veto their decisions if they are deemed to be unconstitutional, the US Supreme Court has too much power in Americans' lives.
    We need an Amendment to make changes to the SP!

    Sinema: I'm leaving to become an Independent so I don't get hit with a primary since my approval rating is so low. Congress takes the risk of losing a seat and splitting votes into a 3 way which will give the seat to a republican during the next election. I'm in it for myself although I do say this is what Arizonians want. (I don't really know what they want since I don't talk to my constituents) I'm enjoying my wealth too much and my travels abroad.
