It's probably a misdemeanor only because Utah likely doesn't have a summary offense class. It's probably like an M4 or something. If they really wanted to hammer it home, they could have hit him with false imprisonment, which would be significantly worse for him. Technically, they could have hit him with battery. Assault is when you give someone reason to believe that you're going to attack them, battery is when you put hands on them; that's why assault & battery come as a package usually, and it's an upgrade from simple assault. Then you can have aggravating factors like the use of a weapon or continuing to attack someone on the ground where you might just end up with an attempted murder charge. Heh...I've spent a fair bit of time in court, usually with a PD, which means that largely you go in and they go "okay, so what's your defense(?)" and then they zhush it up for you. So far, so good; as you may be able to tell by the fact that I'm free.
I cycle a lot to save gas, but I'm like a casual video gamer. Going slow and calmy enjoying the adventure. And I swear there's so many try-hards out there who are fully decked out in their bike outfits, and I've watched a LOT of them blow straight through stop signs. I'll be going 15 mph on a residential street, and they'll come zooming past me going 25+ straight through stop signs. I've also seen them straight up merge and cut lanes without ever looking behind them. Like jesus man. I bike to save money and get exercise. I don't got a death wise. Goddamn crazy ass people out there on the roads these days. And I'm also the cyclist that if I see another oncoming rider, I'll pull to the side and just chill and let them pass. Or if I'm on a sidewalk and passing a pedestrian, I get off and walk past. It's not a race, lol.
In Oregon, it's now legal for bikes to run red lights/stop signs. I couldn't tell you how many times I've stopped at a stop sign, my turn to go, start to enter the intersection. Cyclist blows by inches from the grill of my truck
Typical California entitlement. Old guy is a CA transplant from what I heard. He's the type that leaves CA then moves and votes the same way that helped destroy CA.
It is a 100% a normal thing for someone to occasionally ride a bike. I love the scenario in his head "nah you don't ride a bike"; like it is some sort of privilege
Yes, Mr. Peacock is a real piece of work. He lied on his call to police and held the 22 yr old man against his will. Yet, he only got a slap on the wrist. The 22 yr old only got a ticket on Gary's word. I hope he sues that crap out of Gary.
@@christopherbrochu7492 Pretty sure you got confused what video this comment was under. As there's no death whatsoever. Or former cop, or current inmate.
I had a guy ride his bike towards me in my lane. Attempts to not hit him failed. I'm pretty sure it was deliberate. He was ok but did try to sue me, but luckily in Mississippi, people on bikes are required to follow the same laws as cars, so he was automatically responsible for the accident because he was in the wrong lane. Bikes make me nervous.
Seeing the bodycam was just *chefs kiss* to see this male karen cry about getting a ticket and having to go to court. The DA dismissed the ticket against the kid after seeing the dash cam video.
Yeah it was pretty clear on the dash cam there was at least 7 feet between the bike and the car. So sad the cop gave that guy a break and didn't go for False Imprisonment (Unlawful Confinement).
@@maurer3d The officer on scene just had one guy's word against another. Citing them both was the smartest move to end the situation as quickly as possible and let the courts sort it out
It goes to show that it's a perfectly good idea to cooperate with police and get a ticket, because it *will* get dismissed if it's for something that wasn't true. Unless the local court's crappy, but that's on a case by case basis.
Even this cop is a better man than me. If I told a civilian to 'stand over there' more than twice and he's still arguing with me, Imma cuff him and take him to jail.
@purplefood1 No, unfortunately, they have always been around, but people who had no clue about them are now learning about those type of towns in America. Sad but true. I'm a 54 year-old white woman from Philadelphia who has known about them for years because I like to read. I'm not being antagonist to you in any way, but it's sad to me that people just don't know about anything outside their own sphere. You take care 🙂
Him saying. "Next time I won't call the police." should have been made a much bigger deal. This is the US. There's a very setious implication behind those words here. Especially since he obviously learned nothing from this.
Assault, battery... criminal trespass or even potential breaking and entering by opening the door... 3 times. Dude should be in jail. The cop failed every way you look at it here. He failed that kid super super hard.
I don't see how it wasn't. Kinda feel this is a small town and old dude got off easy on all of this. Literally kidnapping, false imprisonment, assault, intimidation, and heck for good measure it be sexual assault to for rubbing his body up against the kid multiple times. If this of been the other way around the kid be sitting in prison for 30 years for elderly abuse and assault of the elderly and a stern lecture from the judge that this old man made a mistake hy not giving you enough room and then you go crazy and assualt him, make him fearful and now so and so cant enjoy life.... Funny how our country is set up where the elderly get free passes on everything because of that "old are saints" mindset
@P.C.27 assault is stretch he never really threatened him and he technically didn't trespass as he never entered the car opening the door is not trespassing. I can see the breaking and entering as well as battery tho, but the rest nah
You guys don't realize what the cop did by giving that kids a ticket. Now there will be record that the guy was lying, the kid has damages to pursue in court, and the kid can sue the guy and get paid. He did the kid a favor.
And plus, the officer even said he SAW the dashcam footage and the video the "kid" (the young gentleman) took with that Loser holding him at his door, saying he' threatening while being an absolute glob of dick cheese. So he knows the kid is not in the wrong, he really REALLY did him a favor. Protect and Serve
This exactly, without proof of damages (having to go to court to clear this up)m he would have no basis for a civil suit, sadly sounds like the kid is not going to pursue it.
What "damages"? There was no financial loss, no injury of any kind, just some wasted time and inconvenience. At most it sounds like maybe the kid had to take a couple of hours out of his schedule to go talk to the DA and get things dismissed, and that's it. *There's nothing to sue for here to begin with.* On top of that, there was never any court case (because it was dropped) so there's nothing "on record" as a result of this anyway.

gary didn't receive harsh enough punishment. He should have been arrested for assault and battery and false imprisonment and falsifying a police report. Nothing the cop said did anything to convince gary he was completely in the wrong. He only backpeddled when he realized he was getting his own ticket. He left that whole interaction thinking he was victimized by Pierce and the cop.

@@Jaden-eh6rh detainment is imprisonment while claiming to have the authority to do so, which is what Gary did. This is relative law for one of the many jobs I've had where knowing law terms and implications of them to your actions is critical. Citizens Arrest is a thing. But that actually requires a crime to have been commited. Even if he was too close thats a fine not an arrestable offence. So its forcable confinement.
Great video! I want to give you the perspective of an avid cyclist. You’re 100% right, the entitlement of that Karen was both absurd, and stereotypically ludicrous. For the record, 6 feet of distance between a car and a cyclist, for either one of us passing one another, is perfectly fine! I live in New York City, so 99% of my writing is here. And sometimes you’re lucky to get three or 4 feet of distance. And as long as everybody’s observant, that is more than fine. I’m glad that Cyclist got the ticket and got the conviction, and I’m also very happy to read the update in your description saying that the young motorist had the charges dismissed. Also, another observation. The Cyclist was very lucky that he didn’t get himself handcuffed and arrested for getting in the cop’s face, and not respecting the authority of the officer when he arrived on the scene. One more thing. In my opinion, the way that Utah policeman handled that, was a master class in Law enforcement de-escalation. Anyway, great video thanks for posting it!
Bro ripped open the door multiple times, the teen is obviously uncomfortable wanting to stay in the car to feel safe this old man is crazy and was never told no in his life.

I used to work in loss prevention, and it’s amazing how often people try to walk back their illegal activity when they get caught. We stop someone on their way out the door, bring them back to the office, explain that we need to call the police over the $300+ of stolen merchandise they tried to leave with and… “can’t I just go pay for it?” Nah dude, you committed a misdemeanor. Sit here and wait for the cops and they’ll decide if you can pay your way out of this one. You can’t just apologize your criminal activity away.

Bravo to the young man for remaining chill. The worst thing is that GARY has probably behaved like this in some shape or fashion throughout his life and probably got his way.
This literally happened to me a few weeks ago. Some cyclist slammed into my car and lied and said i hit him but when i checked my car he had dented it. That was all the proof the police needed lol! He had to admit fault.
Dude not going to lie if someone pulls open my car door against my will multiple times my patience would not be as high as the young man. Good for him for handling it the correct way.
Disorderly? That was straight up the definition of false imprisonment, assault, AND battery. That old man should have been cuffed up and taken away. That kid should have NOT been given a citation at all as the officer didn't witness and there was no obvious damage or injured party. I can call and say Gary is selling crack all day, would he be cited or arrested every time based on my word? With the way this was handled by that cop, I could call and make crap up on anyone without a problem, which is not at all how it works. Kid should sue Gary, AND the PD.
The officer did the kid a favor in court the kid obviously will get the ticket dismissed and can even sue for what the other guy did, i agree the kid shouldnt have gotten a ticket but it solidified that the cyclist was lying and it solidifies the ticket that the cyclist would be getting
@Slofuu The officer didnt do the kid any favors at all. He didn't charge the old man properly, WROTE THE KID A TICKET based on 0 evidence, when the kid has the evidence proving his innocence ON SCENE, which means he (the kid) had to waste HIS time to prove the old mans hearsay wrong to the DA for it to be dismissed, not the officer. After the citation is written the cop has no more say in what happens. The officer was 100% in the wrong on BOTH sides here. Favor? Thats laughable.
The ticket was issued based on the word of the Karen, not the officer. The karen was the one who signed the ticket under penalty of perjury... What should happen from here is that Mr. Karens should be taken up on perjury charges...
@sugarsore when he physically touched the kid, and also swiped at his phone. Any unwanted physical contact is battery, motioning like you're going to do it is assualt. We could also add more charges for when the dude ripped open his door numerous times. That alone could also be considered assault, at minimum. You blind or just don't know how it works?

I hope he sues. He's right that without the video footage he could have ended up in jail. That's not okay. This cyclist guy needs to pay just for that.
Because not every absolute violation of law must be charged and prosecuted. And you don’t want it that way. If we all would be charged for every technical violation of a statute, we would all be in jail. Example - Driving: if you adhere to the absolute of the law, most would never get a mile down the road without getting arrested for something. 1 mph over speed limit; following too close, not an absolute perfect cessation of motion with a stop, left turn (judged by an officer) to be just a bit too close to an oncoming veh, impeding traffic because your under the speed limit…just for a start!
@@ynotbloom I mean, you are not wrong, but there is a catch on this case (and I think this one is actually taken very seriously in the USA) - he is acting like a law enforcer. Vigilantism is at least very frowned upon, especially when you are a cop or a judge, the real representatives of the law.
@ you are correct on the Vigilante angle. Depending on state law wordings, the biker could be “unlawful detaining” or “false imprisoning. However, bottom line is he is a cranky old, being self-entitling (and over-argument), and stepping over a line. A D.C. charge more than adequately covers this. At least in Wisconsin, I would have gotten a good talking to by my Lt, the DA, and/or maybe a Judge if I would have tried to escalate this (…based, of course, on ONLY what we see in the videos…) to more severe charges. We would refer that as “piling it on.” The litigation akin to trying to swat a fly with a hammer.
The young man could, and maybe should, sue him. Even if he has no interest in profiting he could donate it to the park or make a non-profit to promote skateboarding, or at worst put it in an emergency/retirement fund.
This being in Utah explains it all. There are not many places left in America where a person would be so calm and polite about a stranger following them, yanking their door open, putting hands on them and preventing them from leaving. Mad props to the kid for keeping his cool and not esculating the situation by being rude. He just hung tight, maintained his composure and let the cops deal with the situation. The bicyclists was way out of line, then he flat out lied to the cop as well about not opening the kids door, that should be another misdemenor, giving false witness, or something.
I was punched in the face by a cyclist , saying I hit him when I went by him with my side mirror. But I had a witness and a police officer right behind me. Thank goodness!
10:12 The cop is saying he has to give the teen a ticket on the account of the cyclist and that it may or may not be discarded by the dashcam footage (it should). He's saying however that Karen's ticket is on the ground of the evidence the teen presented to him, the teen didn't press charges, the cop gave a citation on is own behalf because of disorderly conduct.
I think the cop was just trying to get the Karen cyclist to chill tf out and tell him he's getting a ticket even though he hasn't actually seen the dash cam footage yet. But I did see someone commented the ticker was dropped so doesn't matter either way
BS like this is why they had to heavily change biking laws in my county. They were taking over streets by riding up to 6 wide, not allowing cars to pass, constantly calling 911, and threatening drivers like that. The changes made them disappear within a month to ride in another county after they got hit with ever-increasing fines and eventually jailtime.
It isn't anywhere near that bad here, but there's a bunch of hills and it's pretty common to see cyclists riding in traffic up the hill. They'll go like 3mph tops holding up traffic when there's a sidewalk that they're legally permitted to use within literally feet of the road.
Bike laws might as well not exist where I live (semi-rural PNW). Bicyclists do whatever they want without consequences because the police don't care enough to ticket them. I've nearly hit several blowing red lights and stop signs without even pretending to look and been cussed out because I didn't give them a 'car length' of space (not the law).
@@CassandraY That was the catalyst for change where I live. They started to get way too comfortable with acting like there were no rules and could get away with whatever they wanted to do because the previous laws had no real bite. Now in 2024, people will fight back and press charges. Because we’re sick and tired
This biker 100% blows through stop signs then gets mad at drivers.

I am a long time cyclist but this old cyclist really pisses me off, clowns like him give all us cyclists a bad name.
I’m both a Christian (…on the “my minister has 2 babies with her wife” side) and vegan (was vegetarian, can’t eat cheese, may as well…) so while I’m physically incapable of cycling, I have been there. The secondhand embarrassment stings and one redoubles one’s efforts to visibly Not Be That, which ironically requires you be the thing so Not That people don’t know you are the thing. Though being on a bike is more visible than the plate you are eating from while ignoring everyone else’s so…

Funny thing is that old guy probably yearns for "the good old days".
In the good old days he would've got hurt for trying that stunt.
@@Jaden-eh6rh That's... not how this works.
And his only lesson learned is "next time I won't call the police".
Cyclists are entitled and pick which rules they want to follow. And think they have the right to do what ever they want.
I hope he sues. He's right that without the video footage he could have ended up in jail. That's not okay. This cyclist guy needs to pay just for that.
How did the judge/da not get this guy for unlawful restraint. This is ridiculous
YET! All it needs is one D.A. trying to get some visibility... all hope is not lost yet.

I hope for that man’s sake he never ventures outside of Utah. He may never make it back.
I see polite teenagers all over the USA. Utah has nothing to do with it. I have also seen Utah kids commit mass murder, especially family related. The old man being from Utah is also nothing special. There are entitled old dudes everywhere. Most of them are MAGA and want Trump so they can say and do anything they want with no consequences while everyone not MAGA have limited speech, religious rights, the right to vote, etc. and get serious consequences simply for being alive in the USA and not MAGA.
I will never understand why some people stop everything and cause a massive problem for everyone instead of just moving on with their day.
Because they're miserable, insecure, apathetic Iose®s who have to make everyone else around them miserable so they can feel better about themselves.
Maybe their life miserable and boring to the point that they simply cannot live and not cause a ruccus

It was dropped fyi. Someone posted an update above. So the driver is all good.

Exactly, that's how I read the situation.
The final straw was a mob of 20+ bikers that went after a car that dared pass them while they illegally took up the whole road.

It’s sad how many bodycam videos and dashcam videos I’ve seen involving an older person thinking they are law over a younger person.
The kid is also super polite and calm. He didn't lose his cool like the cyclist. The kids' parents raised him well
Respect your elders is the most BS sentence on the planet, i reapect people who has proven to me that they deserve my respect.
Well that is the rub... You are not an elder just because you are older that a person.. It also requires you be a good role-model for the younger people... So this guy definitely was not an elder.
Please tell us wise one. What does the little old lady coming out of the Dollar Store with an arm load of shopping bags have to do to 'deserve' your respect so you won't let the door hit her in the face? You have it exactly backwards. If you hold the door open for her and she calls you a prick for your troubles, then you have a case. But then, neither one of has ever seen that, have we? Do you know why? She was raised to respect people.
Lmfao this is such a young man’s mentality. No one has to earn anyone’s respect. It’s easier to give it outright and find out who doesn’t deserve it after. That’s what being a good person is
@@tanker335 Your reply’s completely irrelevant to the OPs comment. Are you suggesting we should only hold doors open for our elders? Holding a door open for someone isn’t a way of showing respect, it’s just common human decency. People should be polite and hold doors open for anyone who needs it, it has nothing to do with respecting your elders.
@@tanker335this was more telling on you than you realise. I didn't respect or disrespect about 99.99% of the people I've held doors for over the course of my lifetime. They were strangers I'd never met, the door was the entirety of our interaction, and I made no judgement of their personality and deserved respect. I just held a door open.
To deliberately misinterpret your statement, as you did to op, I would have to infer that you chose not to help a lot of people due to your respect bar not being full, quite a disadvantage considering the size of the population. Quite an uncharitable position, and possibly a sociopathic attitude towards civilisation in general.
You are a terrible person.
